Home My WebLink About1998 085 CC RESO1998 085 CC RESO¹òw @˜’¹RESO 98-85 DEC 2 1998[H.8 RESOLUTION NO.98 85 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, DECLARING ITS INTENTION TO ESTABLISH UNDERGROUND UTILITY DISTRICT NO.98-I WHEREAS, by Resolution No.98-85 a public hearing was called for December 2, 1998 at the hour of 7:00PM in the Council Chambers in the City Hall, Baldwin Park, California, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electricity, communication or similar or associated service, within those certain areas of the City of Baldwin Park, County of Los Angeles, State of California, generally described as Underground Utility District No.98-I located generally along the Ramona Boulevard between Francisquito Avenue to Merced Avenue and Stewart Avenue to La Rica Avenue; and WHEREAS, District 98-1 is a Rule 20A Project; and WHEREAS, notice of such hearing has been given to all affected property owners as shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Baldwin Park, decrees that pursuant to Chapter 97.060 to 97.080 of the City of Baldwin Park Municipal Code, the area described herein is hereby declared an Underground Utility District, and is designated Underground Utility District No.98-i of the City of Baldwin Park. Attached hereto and hereby incorporated as part of this Resolution, is the map marked Exhibit A" delineating the boundaries of said District; and SECTION 2. The City Council does hereby set December of 2000 as the date in which affected property owners must be ready to receive underground service, and does hereby order the removal of all poles, overhead wires and associated overhead structures and the underground installation of wires and facility for supplying electricity, communication or similar or associated service within Underground Utility District No.98-i on or before twenty-four 24) months from the date of adoption of this Resolution; and SECTION 3. The City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within Underground Utility District No.98-I of the adoption of this Resolution within thirty 30) days after the date of such adoption; and SECTION 4. Said City Clerk shall further notify, if necessary, said property owners that if they or any person occupying such property desire to continue to receive electricity, communication or other similar or associated service, they or such occupant shall, by the date fixed in this Resolution, provide all necessary facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utilities or utilities on file with the Public Utilities Commission of the State of California. Such notifications shall be made by mailing a copy of this Resolution together with a copy of said Chapter 97.060 to 96.080 of the City of Baldwin Park Municipal Code to all affected property owners as shown on the last equalized assessment roll and to the affected utilities. That the City Council hereby finds and determines that the Underground District herein created is in the general public interest and that the public necessity, health, safety and welfare require the removal of poles, overhead wires and associated structures for the following reasons: A. The underground to be accomplished will avoid or eliminate an unusually heavy concentration of overhead distribution facilities. B. The streets, roads or rights-of-way in the District are extensively used by the general public and carry a heavy volume of pedestrian or vehicular traffic. C. The said streets, roads or rights-of-way adjoin or pass through a civic area. D. That the City of Baldwin Park pay as part of the underground utility project to extend the private services laterals for a distance of up to 100 feet. E. The City of Baldwin Park will provide loans to property owners depending upon eligibility to convert overhead service to underground. SECTION 2. That the City Clerk shall certify to the adoption of this Resolution. APPROVED AND ADOPTED this 2nd day of December 1998.
