A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN
PARK REQUESTING EXTENSION OF EMPLOYMENT FOR
PERSONNEL/RISK MANAGER PURSUANT TO GOVERNMENT CODE
SECTIONS 21221(h) AND 21224
WHEREAS, the Public Employees' Retirement Law, Government Code Section 21224, permits a
PERS retiree to be appointed by the governing body of a contracting agency, such as the City, to a position
deemed by the governing body to be of a limited duration in those cases where, in pertinent part, the position
requires specialized skills which are needed in order for the City's business to be implemented for a period
of 960 hours in any calendar year, without the necessity of being reinstated as a full-time permanent employee
and without suffering the loss or interruption of retirement benefits.
WHEREAS, the Public Employees' Retirement Law, Government Code Section 21221(h), permits
the governing body to request approval from the Public Employees' Retirement Board to extend the temporary
employment when the hours are expected to, or will exceed 960 hours in a calendar year and the position is
still needed in order for the City's business to be implemented.
NOW, THEREFORE, BE IT RESOLVED that the governing body of the above agency does hereby
request approval to allow an employment extension for the Personnel/Risk Manager in accordance with
Section 21221(h) and for the appointment not to exceed a total of one year.
