HomeMy WebLinkAbout2001 072 CC RESO2001 072 CC RESO¹òw @˜Š^2001 RESO 2001-072–"[Hm¸RESOLUTION NO. 2001-072 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, DECLARING ITS OPPOSITION TO SB 1029 PERATA) RELATING TO WATER TRANSFERS WHEREAS, SB 1029 BY Senator Don Perata D-Hayward) redistributes the risk and costs associated with providing water supplies to taxpayers by public agencies while creating profit opportunities for private water brokers; and WHEREAS, SB 1029 allows third parties to transfer water through public conveyance facilities, which are generally publicly funded, without paying the full cost of providing those facilities; and WHEREAS, SB 1029 would only partly compensate owners of water conveyance facilities for the specific facilities used by third parties; and WHEREAS, conveyance facilities are just one component of the water infrastructure necessary to manage vital water resources and the owner of those facilities must pay for the financing, construction, maintenance and operation of the entire system to protect the integrity and dependability of the system for its customers; and WHEREAS, the inability to recover the full cost for utilizing the facilities will shift costs to existing customers of the water system; and WHEREAS, a facilities-based cost recovery mechanism disregards the fixed obligations of the facilities owners, such as State Water Project contract obligations and conservation and recycling programs which help meet Southern California's goals for long-term water planning; and WHEREAS, SB 1029 is an attempt to deregulate the water market at the risk of inflated rates and decreased water quality which could leave ratepayers holding the bill; and WHEREAS, laws that dictate how water is moved, or wheeled," through publicly-owned facilities mush protect taxpayer investments, offer equal access to the conveyance system with no subsidies for private water marketers, promote competition to secure supplies, and recognize the value of local water management programs; NOW, therefore, be it resolved that the City Council of the City of Baldwin Park does hereby oppose SB 1029 because it does not adequately nor fairly compensate the owners of public water conveyance facilities for the use of those facilities by third parties. PASSED, APPROVED and ADOPTED this 3rd day of July, 2001.
