A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BALDWIN PARK, DECLARING ITS OPPOSITION TO SB 350
ALPERT) RELATING METROPOLITAN WATER DISTRICT'S
PROPOSED GUIDELINES GOVERNING THE USE OF
SURPLUS FUNDS
WHEREAS, if enacted, California State Senate Bill 350 would require, on or before
June 30, 2002, the board of directors of the Metropolitan Water District of Southern California
and its member agencies to adopt a resolution establishing guidelines governing the use of
surplus funds something that already exists; and
WHEREAS, the bill, in effect, would take away important financial decision-making
flexibility from Metropolitan's board of directors and threaten impact the district's ability to
maintain stable water rates in the future; and
WHEREAS, imported water rates have not increased in 6 years; and
WHEREAS, Metropolitan's board reduced in size from its former 51 members to 37
members pursuant to legislation enacted in a 1998; and
WHEREAS, the bill would require, by June 30, 2002, the California Research Bureau to
analyze and evaluate Metropolitan's governance structure, including its reduction in size and
handling of finances under the current voting structure; and
WHEREAS, a study of Metropolitan's governance structure by the California Research
Bureau preceded the 1998 legislation; and
WHEREAS, the district's financial policies were established after extensive discussion
and debate among Metropolitan's member agencies, board members and other stakeholders;
and
WHEREAS, any evaluation of board governance at this point would be premature.
NOW, therefore, be it resolved that the City Council of the City of Baldwin Park does
hereby oppose SB 350 on the basis that it would remove the financial flexibility that has kept
Metropolitan's water rates unchanged for six years and is contrary to the spirit and intent of the
prior legislation.
PASSED, APPROVED and ADOPTED this 3rd day of July, 2001.
