A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN
PARK TO ESTABLISH, PURCHASE, AND/OR OPERATE A PUBLIC
UTILITY, PURSUANT TO PUBLIC UTILITIES CODE SECTION 10001,
ET. SEQ, AND THE CONSTITUTION OF THE STATE OF CALIFORNIA,
ARTICLE 11, SECTION 9
WHEREAS, the City of Baldwin Park, the City"), a municipal corporation, is
authorized pursuant to Government Code Section 39732, Public Utilities Code Section 330,
and Section 1001, et. Seq., and Article 11, Section 9(a) of the California Constitution to
establish, purchase and operate public works to furnish its inhabitants with light, water,
power, heat, transportation, or means of communication;
WHEREAS, the City desires to ensure its citizens and businesses are provided with
utilities that meet the current and future needs of the community, that utilize advanced
technology, that provide utility services at rates and charges that are fair and reasonable,
that provide high quality customer services, that provide alternatives to existing providers of
utility services and that protect the health, safety, and welfare of its citizens;
WHEREAS, the City desires to potentially own and operate municipally-owned
natural gas and electric utility systems for new development, where appropriate;
WHEREAS, the City if concerned about the current status of deregulation of electric
and natural gas utilities in the State of California;
WHEREAS, as a result of deregulation of electric and natural gas utility industries in
California, the City has identified numerous potential benefits that would derive from
providing a municipally-owned utility, including but not limited to insuring the availability of
utility services at all times, additional revenues for community improvements, the ability to
offer competitive rates to citizens and businesses for utility; and
WHEREAS, the City Council has found and determined that the creation of a
municipally owned utility will significantly enhance the quality of life and provide significant
benefits to the citizens and businesses of the City.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Baldwin
Park as follows:
SECTION 1. That the City of Baldwin Park does hereby establish a municipally-
owned electric and natural gas utility in the City of Baldwin Park for new development.
SECTION 2. The Chief Executive Officer or her designee is hereby authorized to take
all necessary steps to assist the Council in gathering information and taking steps towards
creation and commencement of the operation of a municipally-owned utility the Municipal

by the City Council, to the residents and businesses of new developments of the City and to
extraterritorial customers in accordance with applicable law.
SECTION 3. The City Clerk shall certify to the passage and adoption of this
resolution, and it shall thereupon be in full force and effect.
