HomeMy WebLinkAbout2001 113 CC RESO2001 113 CC RESO¹òw @˜­RESOLUTION NO. 2001-113 A RESOLUTION OF THE CiTY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA NOMINATING COUNCiLMEMBER MAYOR MANUAL LOZANO TO REPRESENT CITIES WITHOUT PUMPING RIGHTS ON THE BOARD OF THE SAN GABRIEL BASIN WATER QUALITY AUTHORITY WHEREAS, the San Gabriel Basin Water Quality Authority is governed by a Board of Directors composed of seven 7) members, one of which is elected by cities with pumping rights in the San Gabriel groundwater basin, and one of which is elected by cities without pumping rights in the basin city members); and WHEREAS, in the election for each city member, the candidate receiving the second highest number of votes is elected alternate member, to serve in the place of the city member when that member is absent from a meeting or when the member's office becomes vacant, until a successor is elected; and, WHEREAS, in order to be eligible to hold office as a city member or alternate city member of the San Gabriel Basin Water Quality Authority Board of Directors, a nominee must be an elected member of the city council of a city with pumping rights or a city without pumping rights, respectively; and, WHEREAS, on or about October 12, 2001, Assembly Bill 152 Chapter 259 of the Statutes of 2001) amending the San Gabriel Basin Water Quality Authority Act, was signed into law by Governor Gray Davis; and WHEREAS, Assembly Biii 152 states that if a city member or alternate city member ceases to be a city council member during his or her tenure on the San Gabriel Basin Water Quality Authority Board of Directors, the seat on the Board occupied by that member shall be deemed vacant; and WHEREAS, alternate city member Richard Melendez, representing cities without pumping rights, has ceased to be a city council member; and, WHEREAS, the Board of Directors of the San Gabriel Basin Water Quality Authority has called a special ejection for the purpose of filling the vacancy in the office of alternate city member for cities without pumping rights; and, WHEREAS, the City of Baldwin Park is one of the cities in the San Gabriel Basin without pumping rights in the San Gabriel groundwater basin, entitled to vote for city member representing cities without pumping rights; BIB] 37425-U01 2001-U02 113-U02 CC-U02 RESO-U02 LG1-U03 LI3-U03 FO8417-U03 FO8418-U03 DO8670-U03 C6-U03 RESO-U03 02/20/2002-U04 ADMIN-U04 2001 113 CC RESO¹òw @˜­Resolution No. 2001-113 Page 2 of 2 WHEREAS, the City of Baldwin Park may, by resolution submitted to the San Gabriel Water Quality Authority before January 3, 2002, nominate a candidate for the office of city member representing cities without pumping rights. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. The City Council of Baldwin Park nominates Mayor Manuel Lozano, an elected member of the City Council of the Baldwin Park as a candidate for alternate member of the San Gabriel Basin Water Quality Authority representing cities without pumping rights. APPROVED AND ADOPTED THIS 5th day of December 2001.
