HomeMy WebLinkAbout2002 022 CC RESO2002 022 CC RESO¹òw @˜âRESOLUTION NO. 2002-022 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK CASTING ITS VOTES FOR MAYOR MANUEL LOZANO TO REPRESENT CITIES WITHOUT PUMPING RIGHTS ON THE BOARD OF THE SAN GABRIEL BASIN WATER QUALITY AUTHORITY WHEREAS, the San Gabriel Basin Water Quality Authority is governed by a Board of Directors composed of seven 7) members, one of which is elected by cities with pumping rights in the San Gabriel groundwater basin, and one of which is elected by cities without pumping rights in the basin city members); and WHEREAS, at the election for each city member, the candidate receiving the second highest number of votes is elected alternate member to serve in the place of the city member when that member is absent from a meeting or when the member's office becomes vacant, until a successor is elected; and WHEREAS, in order to be eligible to hold offices as a city member or alternate city member of the San Gabriel Basin Water Quality Authority Board of Directors, a nominee must be an elected member of the city council of a city with pumping rights or a city without pumping rights, respectively WHEREAS, on or about October 12, 2001, Assembly Bill 152 Chapter 259 of the Statutes of 2001) amending the San Gabriel Basin Water Quality Authority Act, was signed into law by Governor Gray Davis; and WHEREAS, Assembly Bill 152 states that if a city member or alternate city member ceases to be a city council member during his or her tenure as a city member of the San Gabriel Basin Water Quality Authority, the seat on the Board occupied by that member shall be deemed vacant; and WHEREAS, alternate city member Richard Melendez has ceased to be a city council member; and WHEREAS, the Board of Directors of the San Gabriel Basin Water Quality Authority has called a special election to fill the vacancy in the office of alternate city member representing cities without pumping rights; and WHEREAS, the City of Baldwin Park is one of the cities in the San Gabriel Basin without prescriptive water pumping rights, entitled to vote for alternate city member representing cjties without pumping rights; and WHEREAS, the City of Baldwin Park may cast its vote for the office of alternate city member of the San Gabriel Basin Water Quality Authority representing cities without pumping rights by resolution delivered to the Authority no later than March 4, 2002 at 5:00 p.m. BIB] 37425-U01 2002-U02 022-U02 CC-U02 RESO-U02 LG1-U03 LI3-U03 FO8417-U03 FO8678-U03 DO8703-U03 C6-U03 RESO-U03 03/11/2002-U04 ADMIN-U04 2002 022 CC RESO¹òw @˜âResolution No. 2002-022 Page 2 NOW, THEREFORE, BE IT RESOLVED that the City Council of the Crty of Baldwin Park does hereby resolve as follows: SECTION 1. The City Council of the City of Baldwin Park casts its full votes for Mayor Manuel Lozano as alternate member of the San Gabriel Basin Water Quality Authority representing cities without pumping rights. PASSED, ADOPTED, AND APPROVED by the City Council of the Crty of Baldwin Park, California, this 20th day of February 2002.
