HomeMy WebLinkAboutORD 013ORD 013ê79wS ×Pì ORDINANCE NO. / ORDINANCE OF THE CITY COUNCIL OF THE CITY OF 13ALa1N PARK ADDING NEW SECTIONS TO TIE; BALIX:N PARK MUNICIPAL CODE TO BE KNOWN AS SECTION NO. 4508 PROHIBITING THE USE OF CERTAIN SIGNS ON VEHICLES; SECTION NO. 45o9 PROVIDING FOR OFFICIAL PGLICE BADGES AM IDENTIFICATION CARD: SECTION NO. 4260.1 PROHIBITING TILL USE OF THE CITY NAME IN SOLICITING FUlTT)S; AND ARTICLE III, CHAPTER 6, SECTIONS 3600, 3601, 3602, 3603, and 3604 PROHIBITING CERTAIN' DEADLY OR DAN CZHItOUS WEAPONS. THE CITY COUNCIL OF THE CITY OF BALhtaaN PARK DOES ORDAIN AS FOLLOWS: SECTION l.- A new section to be known as Section 4508 is hereby added to the Baldwin Park Municipal Code to read as follows: 4508. USE OF CERTAIN SIGNS ON VEHICLES PROHIBI'T'ED No person shall drive any vehicle of any kind on any public street which has placed thereon or affixed thereon any sign plate or other fixed object or painting which contain the words Police" Police DePt", Baldwin Park Police Deptt", Dep't of Police", or any other words or letter or group of words or letters of like or similar character or nature, unless such v:;hicle is operated by a regular organized department of police o£ a body politic, or such vehicle which though privately owned, is used by a duly authorized officer or employee of a department o£ police of a body politic in the performance of his duties as a police officer. TECTION 2.- Baldwin Park Municipal Code to read as follows 4509. OFFICIAL POLICT-,; BADGES AND IDENTIFICATION CARD a) Official Police Badge description of The official police badge of the City of Baldwin Park shall be a gold plated seven pointed star having the City Seal in the center, the lettering Baldwin Park Police" on the lower portion of the badge below the seal, and the lettering of the rank of the Police Officer, to whom it was issued, on the top portion of the badge above the seal. The official police badge shall have the speci- fications according to style number N.S. 715 of the Los Angeles Stamp and Stationery Co., as shown in Catalog number 40. b) Official Police Badge issuance of The official police badge shall only be issued to regular police officers who are members of the Police Department of this City, duly commissioned and sworn in as provided by law to perform regularly the duties of peace officers and not retired, suspended, or discharged. No person shall issue to any other person or to himself whatsoever an honorary police badge or any other badge calculated to indicate that the holder thereof is a member of the police department of this city, except that official police badges may be issued to persons lawfully entitled thereto. No person shall sell, give away, or assign the official police badge. c) Official Police Badge possession of No person, except that person lawfully entitled thereto to possess an official police badge, shall possess, wear, display, or carry an official police badge. No person shall possess, wear, or display any other badge, regardless of the size, shape, or design thereof, which has on it the words Baldwin Park Police" whether used separately, together or in combination with any other words that it may be readily mistaken for such badge. d) Official Police Identification Card description of The official police identification card shall be wallet size and shall leave on the face of the card a facsimile of the Official Police Badge, the name, photograph, serial number, right index fingerprint, and signature of the police officer to whom it was issued. Each card on the face shall have the lettering Regular Police Officer". The back of the card shall indicate the ORD 013ê79wS ×Pì Ord. No. 13 Page 2 sex-, height, weight, color eyes, color hair, birth date, blood type, and RH factor of the police officer indicated on the face of the card. Mach such card on the back shall bear the signature of the Chief of Police. Mach such card on the back shall briefly state the ordinance regulating possession of such card. e) Official Police Identification Card possession of No person, except that person lawfully entitled thereto and described on the card, shall possess, carry, or display the official police identification card. No person shall print, issue, or have in his possession any identification card similar to the official police identification card, or any identification card stating that the person whose name appears thereon is a regular police officer of this City. f) Official Police Identification Card issuance of The official police identification card shall only be issued to every regular police officer of this City, duly commissioned and sworn in as provided by law to perform the duties of peace officers and not retired, suspended, or discharged. No person shall sell, give away, or assign the official police identification card. g) Official Police Badges and Police Identification cards control of The Chief of Police of this City shall have control of the issuance of official police badges and official police identification cards. All such badges and cards are the property of this City. h) Official Police Uniform imitation of No person, other than a sworn police officer of the City of Baldwin Park, shall wear any uniform of a pattern, or design, or in the semblance of the uniform adopted or hereafter adopted, for use of the regular police officers of this City. SECTION 3.- Section 4260.1 is hereby added to the Baldwin Park Municipal Code to read as follows: 4260.1 SOLICITING USE OF CITY NAME. No person shall solicit funds in the name of the City and for that purpose no person shall use the name of any department or officer of t the City in solicitation of fluids for any private business or in the sale or offer for sale of advertising space or matter in any newspaper, magazine, book, periodical, pamphlet or any publication of any kind or character, or state to any other person from whom funds are being so solicited to whom such offer to sell or sale is made, either orally, in writing, or in printed matter, that such solicitation of such advertising medium bears the endorsement or approval of any department or officer of the City. SECTION 4, ARTICLE III, PUBLIC SAFETY, CHAP= 6, DEADLY OR DANGEROUS WEAPONS, Section 3600, Section 3601, Secticm 3602, Section 3603, Section 3604 is hereby added to the Baldwin Park Municipal Code to read as follows: Chapter 6. DEADLY OR DAN(WOUS WEAPas. 3600. Dangerous or deadly weapons" includes, but is not limited to: any knife with a blade tree inches or more in length; and any snap-blade or spring-blade knife, regardless of the length of the blade; any ice prick or similar sharp stabbing tool; any straight-edge razor or any razor blade fitted to a handle; and any cutting, stabbing, or bludgeoning weapon or device capable of inflicting grievous bodily harm. 3601. It shall be unlawful for any person whale carrying concealed upon his person any dangerous or deadly weapon, to loaf or miter upon any public street sidewalk or alley, or to wander about from place to place with no lawful business thereby to perform, or to hide, lurk or loiter upon or about the premises of another. 3602. It shall be unlawful for any person who has concealed upon his person or who has in his immediate physical possession any dangerous or deadly weapon, to loiter about any place where intoxicating liquors are sold or any other place of public resort. 3603. It shall be unlawful for any person to have in his possession, in any motor vehicle, any dangerous or deadly weapon, but this restriction shall not be deemed, to prohibit the carrying of ordinary tools or equipment carried in good faith for ORD 013ê79wS ×Pì Ord. No. 13 Page 3 uses of honest work, trade or business, or for the purpose of legitimate sport or recreation. 3604. Any such weapons taken from the person or vehicle of any person unlawfully carrying the same are hereby declared to be nuisance and shall be surrendered to the head of the police department, who, except upon the certificate of a judge of a court of record, or of the district at- torney of the County that the preservation thereof is necessary or proper to the ends of justice, shall annually, between the first and tenth days of July, in each year, destroy or cause to be destroyed such weapons. SECTION 5. This Ordinance shall take effect thirty days after the date of its adoption and prior to the expiration of fifteen d,-;-s from the pas- sage hereof it shall be published or posted in the manner required by law, together with the names of the members of the City Council voting for and against the same.
