Home My WebLink AboutORD 018ORD 018ê79wV ×Pì ORDINANCE NO. 18 AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF BALDWIN PARK BY AMENDING SECTIONS 3500, 3508s 3509, 3512, 3520.3, 4247, 4247.1, 4247.2, 4247.3, 4249.1, and REPEALING SECTIONS 3501, 3502, 3503, 3504, 3505, 3506, 3507, 3510, 3511, 4200, 4246, 4406, 4502, and 45o6. THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION l. Section 3500 of the Baldwin Park Municipal Code is hereby amended to read as follows: 3500. No person shall. shoot or discharge within the City any gun, pistol or other firearm, or any air-gun or pistol, or spring-gun or pistol, or bow or similar device used for the pro- jecting of an arrow.. or any slung shot, or sling shot or device used for propelling of a slug, shot, arrow, or missle, without first having obtained a written permit from the Chief of Police. SECTION 2. Section 3508 of the Baldwin Park Municipal Code is hereby amended to read as follows: 3508. No person shall sell at retai,t within the city, pistols, revolvers, or other firearms capable of being concealed upon the person without first having obtained a permit from the Chief of Police authorizing such person to make such sale. For the pur- pose of this section the Chief of Police is hereby designated as the licensing authority. SECTION 3. Section 3509 of the Baldwin Park Municipal Code is hereby amended to read as follows: 3509. The Chief of Police may issue a permit for the sale of firearms upon receiving an application in conformity with the form prescribed by the Attorney General and further in conformity with Article 4, Chapter 1, Title 2, Part 4 of the Penal Code of the State of California. SECTION 4. Section 3.512 of the Baldwin Park Municipal Code is hereby amended to read as follows: 3512. It shall be unlawful for any person, firm, or corporation to take, carry, or otherwise transport any firearm, dangerous weapon, or deadly weapon, as defined in Section 3600 of this Code, into any of the public parks or other public property under the jurisdiction of the Public Parks Department of the City of Baldwin Park, or of the Public Parks Department of the County of Los Angeles, or to have in their possession any fire- arms, dangerous weapon, or deadly weapons within all of said parks. SECTION 5. Section 3:520.3 of the Baldwin Park Municipal Code is s hereby amended to read as follows: 3520.3. Nothing in this chapter shall be deemed or construed tp prohibit in the City of Baldwin Park the giving, loaning, or furnishing to any person under the age of 18 years any articles mentioned in Sections 3520, and 3521 hereof, nor to prohibit airy persons under the age of 18 years from having in his or her care, custody, or control, any article mentioned in Section 3520.2 hereof, in the event that such possession, care, custody or control of such article is had with the consent of the parent or guardian of such person, or in the event that such person is under the direct supervision and control of some adult person. Section 4'247 of the Baldwin Park Municipal Code is hereby amended to read as follows: 4247, No person shall hold, manage, conduct, carry on, or participate in, any parade, march or procession of auy kind or any other similar activity or bear or play any drum, triangle, tambourine, or any wind or string instrument upon any public street or alley in the City without first having applied for and obtained a permit therefor from the Chief of Police with the approval of the City Clerk as provided in this chapter. SECTION 7. Section 4247.1 of the Baldwin Park Municipal Code is hereby amended to read as follows: 4247.1. Any person desiring to do any of the acts specified in Section 4247 hereof shall file an application with the Chief of Police upon a form to be supplied by the city without charge to the applicant setting forth the following information in regard to the proposed event. 1) the name and address of the applicant; 2) the purpose of the parade, march, or procession; 3) the date and time; 4) the place and/or route SECTION 8. Section 4.2117.2 of the Baldwin Park Municipal Code is hereby amended to read as follows: 42117.2. All applications filed pursuant to Section 11247.1, shall be acted upon by the Chief of Police within a reasonable time from the date of filing. Should the Chief of Police after an investigation of the applicant and the facts contained in the application determine that the applicant has stated true facts in his application and the event as proposed will not interfere unduly with the use of the streets anal will not tend to cause a breach of the public peace, he shall issue a permit, with the approval of the City Clerk endorsed thereon, designating the time, place and route of such event. SECTION 9. Section 42)17.3 of the Baldwin Park Municipal Code is hereby amended to read. as follows: 4247.3. In the event the application is denied, applicant may file with the City Clerk a statement and the reasons why it is believed the City Clerk or Chief of Police acted improperly. The City Council at its next regular meeting held after the date on which such appeal is filed with said City Clerk, shall hear the appeal and determination of said City Council thereon shall be final. SECTION 10. Section 11249.1 of the Baldwin Rark Municipal Code is hereby amended to read. as follows: *4249.1. The City Clerk must refer the application to the Chief of Police and may in his discretion rely on the decision of the Chief of Police whether the same will be inimical to the public welfare, health or safety, or will disturb the peace. ORD 018ê79wV ×PìSECTION 11. The following sections of the Baldwin Park Municipal Code are ereby repealed: Section 3501 is hereby repealed. Section 3502 is hereby repealed. Section 3503 is hereby repealed. Section 3504 is hereby repealed. Section 3505 is hereby repealed. Section 3506 is hereby repealed. Section 3507 is hereby repealed. Section 3510 is hereby repealed. Section 3511 is hereby repealed. Section 4200 is hereby repealed. Section 4246 is hereby repealed. Section 4406 is hereby repealed. Section 4502 is hereby repealed. Section 4506 is hereby repealed. SECTION 12. This ordinance hereby is declared to be for the immediate preservation of the public peace, health and safety. A declaration of the facts constituting its urgency is as follows: Prior to the date upon which this ordinance becomes effective the area of the County of Los Angeles, now known and incor- porated as the City of Baldwin Park, was an unincorporated area within the County of Los Angeles subject to the general laws of the State of California, and to the ordinances of the County of Los Angeles. Upon the incorporation the ordinances of the County of Los Angeles no longer have any effect upon or application to persons or property within the City of Baldwin Park. The only laws pertaining to said City are the general laws of government and provisions of the State and Federal Constitutions. It therefore is necessary that there be enacted to take effect immediately the legal administrative ordinances and regulations and exercises of the police power set forth in Ordinance No. 1 of the City of Baldwin Park, and that this ordinance as amending Ordinance No. 1 for the same reasons mast take effect immediately; that to enact such ordinance only after two readings thereof, and to wait the thirty 30) day period would cause chaos within the City of Baldwin Park as there would be no restraint upon persons in regard to any of their present actions, nor in regard to the use of their property, regardless of the manner in which others might be affected, in the safety of their persons or protection of their property. The City Clerk shall certify, to the adoption of this ordinance and shall cause same to be publicly posted in the manner re- gaired by law and this ordinance shall take affect immediately upon its adoption.
