THE CITY CO UN CI L OF THE CI TY OF 13ALDV N PARK DCES ORDAI N AS FOLLOWS Section l. Section 3300 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 3300. Intersection" is that area embraced within the prolongation of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways, of two high- ways which join one another at al-proximately right angles or the area within which vehicles traveling upon different highways joining at any other angle may come in conflict„ Section 2. A new section is hereby added to the Baldwin Park Municipal Code to read as follows: Section 3300.1. Alley" is any unnamed street which is less than twenty-five feet in width between the abutting property lines and for the convenience of the owner of the property abutting thereon and of the persons dealing with them. Section 3. Section 3301 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 3301. Loading Zone" Js tft space adjacent to a curb, or i£ no curb exists, then the property line of the abutting property owner, which space is reserved for the exclusive use of vehicles actually engaged in loading or unloading of materials. Section 4. Section 3302 of the Baldwin Park Municipal Code is hereby amended to read as follows. Section 3302. Official traffic control signal" means any device, whether manLally, electrically or mechanically operated, by which traffic is alternately directed to stop and proceed and which is erected by the authority of a public body or official having jurisdiction. Section 5. Section 3303 of the Baldwin Park Municipal Code is hereby amended to read as follows. Official traffic control device" means any signal, s ign, device or marking not inconsistent with the Vehicle Code of the State of California, placed or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warninL or guiding traffic. Section 6. Secti or: 3304 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 3304. Driver" is a person who drives or is in actual physical control of a vehicle and shall include a person who is an operator, a person who is a chauffeur, and the driver, rider or leader of a horse, mule or donkey, and every person riding a bicycle or who pushes, draws, propels, opera-~es or who is in charge of a vehicle. Section 7. Section 3305 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 3305. Park" is the stopping, standing, or larking of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of, and while actually engaged in, the loading or unloading of passengers or materials. Section 6. A new section is hereby added to the Baldwin Park Municipal Code is to read as follows: Section 3305.1 Temporarily" shall mean a period of t- me not in excess of the period of time allowed for such purpose in this chapter. Section 9, Section 3307 of the Baldwin Park Municipal Code is hereby amended to react as follows: Section 3307. Section 10. Section 3309 of the Baldw7.n Park Municipal Code is hereby amended to read as follows: Section 3309. Roadway" is that portion of a highway improved, designed or ordinarily used for vehicular travel. Section 11. Section 3310 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 3310. Right of Way," is the privilege of the immediate use of the street or highway. Section 12. Section 3312 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 3312. Sidewalk" is that portion of a highway other than the roadway, set apart for pedestrain travel. Section 13. Section 3313 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 3313. Stop" or Stop When Required" or Stand" or Standing" or StoppinL when prohibited", shall mean any cessation of movement of a vehicle whether occupied or not. Section 14. Section 3314 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 337.1x.. Street or Highway" is a way or place, of whatever nature, publicly maintained and open to the use of the public for purposes of vehicular travel. Section 15. Section 3316 of the Daldwin Park Municipal Code is hereby amended to read as follows: Traffic" shall mean and include pedestrains, ridden animals, vehicles, street cars, and other conveyances either singly or tobether, while using arty highway for purposes of travel. Section 16. Section 3319 of the L'aldwin Park municipal Code is hereby amended to read as follows: Section 3319. Obedience to Law Enforcement x-ency. The Chief of Police and his auly appointea police officers are hereby authorized to direct all traffic by means of visual or audible signals, and no person shall fail or refuse to comply with any lawful order, signal or direction of arty Police Officer of this City. Section 17. Section 3320 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 3320. Official Traffic Signals, Vjhenever traffic is controlled by official traffic control signals exhibiting the words Go," Caution," or Stop," or exhibiting different colored lights successively, one at a time, or with.arrows, the following colors only shall be used, and said terms and lights shall indicate and apply to drivers of vehicles and pedestrians as follows: a) Green alone or go". 1. Vehicular traffic facing the signal shall proceed straight through or may turn right or left or make a semicircular or U-turn unless a sign at such place prohibits any such turn. But vehicular traffic, including vehicles turninL right or left, shall yield the right of way to other vehicles and to pedestrians lawfully within the intersection or an adjacent crosswalk at the time such signal is exhibited. 2. Pedestrians facinE the signal may proceed across the roadway within any marked or unmarked crosswalk. b) Yellow or caution" men shoum following the green or go" signals. l. Vehicular traffic facing the signal is thereby warned that.the red or stop signal will be exhibited immediately thereafter and vehicular traffic trill be required to stp when the red or stop signal is exhibited. 2. No pedestrian shall enter the roadway or cross any part of a roadway or from or to a safety zone Loainst a yellow or Caution" signal. c) Red alone or stop". l. Vehicular traffic facing the signal shall stop at a limit line, if marked,.otherwise before entering the crosswalk on the near side of the intersection, or, if none, then before entering the intersection and shall remain standing until green or go" is shown alone, except as provided in the next succeeding paragraphs. The driver of a vehicle which is stopped as close as practicable at the entrance to the crosswalk on the near side of the intersection or, if none, then at the entrance to the intersection in obedience to a red or stop" signal, may make a right turn but shall yield the right of way to pedestrians and other traffic proceeding as directed by the signal at said intersection, except that the driver of a vehicle shall remain standing until green or rrgon is shown alone when the City Council by ordinance shall cause to be erected a sign prohibiting any such right turn against a red or stop" signal. d) Red with green arrow and green with red arrow. 1. Red with Green Arrow, Vehicular traffic facing such signal may cautiously enter the intersection only to make the movement indicated by the green arrow but shall yield the right of way to other vehicles and to pedestrians lawfully within the intersection or an adjacent crosswalk at the time such green arrow is exhibited. 2. Green with Red Arrow Prohibited. It is unlawful to operate a traffic signal. which is equipped with a green light and a red arrow which are shown simultaneously. e) The motorman of any street car shall obey all official traffic signals as applicable to vehicles except that the motorman of a streetcar shall not make a right or left turn when facing a red alone or stop signal. f) No person shall disobey the directions of this section except when it is necessary for the purpose of avoiding a collision or in case of other emergency or when otherwise directed by a police officer or traffic officer, or as permitted under Section 3326 of the Bald-vin Park I'iunicipal Code. Section 18. Section 3321 of the aldwin Park Iunicipal Code is hereby amended to read as follows: Section 3321. No provisions of this chapter for which signs or markings are required, shall be enforced against an alleged violation, if, at the time and place of the alleged violation, an official sign or marking is not in place and sufficiently legible to be seen by an ordinary, observant person. Section 19. Section 3321. of the baldwin Park Municipal Code is hereby repealed. Section 20. Section 3326 of the Daldwin Park Municipal Code is hereby amended to read as follows: Section 3326. Exemptions to Authorized Emergency Vehicles. The driver of an authorized emergency vehicle shall be exempt from those provisions of this code herein set forth under tha; following conditions: a) Said exemptions shall apply whenever any said vehicle is being driven in response to an emergency call or when used in the immediate pursuit of an actual or suspected violator of the law, or when responding to but not upon returning from a fire alarm. b) Said exemptions shall apply only when the driver of said vesicle sounds a siren as may be reasonably necessary and the vehicle displays a lighted red lamp visible from the front as a warninL, to others. Under the circumstances hereinablve stated, said driver shall not be required to observe those regulations contained in Chapter 3 or in Chapters b to and including Chapter 13 of Division 9 of the California Vehicle Code, or Section 3326.1 of the Baldwin nark Municipal Code, but said exemptions shall not relieve the driver of any said vehicle from the duty to drive with due regard for the safety of all persons using the highway, nor shall the provisions of this section protect any such driver from the consequences of an arbitrary exercise of the privileges declared in this section. Section 21. A new section is hereby added to the Baldwin Park Municipal Code to read as follows: Section 3326.1. Stopping, standing or Parking of Utility Vehicles. The foregoing restrictions in this Chapter prohibiting the stopping, standing or parking of vehicles shall not apply to the driver or owner of any service vehicle owned or operated by or for or operated under contract with a. utility or public utility, whether privately, ORD 019ê79wS ×Pì³C RJINANCE NC. municipally, or publicly owned, engaged in authorized work on the highway; provided, that warnin_:devices are displayed as hereinafter specified 1. iJaring daylight such warning devices shall consist of a) A warning flag or barricade striping on the front and rear of such vehicle, or b) A warning flag, sign or barrier on the highway not more than fifty feet in advance of the vehicle and not more than fifty feet to the rear thereof; provided, however;, that in zones where the maximum speed limit is in excess of twenty-five miles per hour said 50-foot distance may be increased up to five hundred feet from the vehicle as circumstances may warrant. 2. During any time from a half hour after sunset to a half hour before sunrise, and at any other time when there is not sufficient Light to render clearly discernible any person or vehicle on the highway at a distance of five hundred feet. Such warning devices shall consist of: a) One or more lights or fusees on the vehicle giving warning to approaching traffic from each direction, or b) A warning light, flare, fusee or reflector on the highway not more than fifty feet in advance of the vehicle and not more than fifty feet to the rear thereof; provided, however, that in zones where the maximum speed limit is in excess of twenty-five miles per hour said 50-foot distance may be increased up to five hundred feet from the vehicle where circumstances may warrant. 3. The provisions of paragraphs 1 and 2 shall not be deemed to prevent the proper display of the warning; devices specified in a) and b) of each of said paragraphs respectively. 4. During either daylight or tine time referred to in said paragraph 2 above, no other warning devices shall be necessary if the vehicle is an authorized emergency vehicle and. is equipped with a flashing red light or lights visible to approaching: traffic from each erection. Section 22. Section 3327 of the llaldwin Park Municipal Code is hereby amended to read as follows: Section 3327. Pedestrians' Right to Use of Roadway. No pedestrian shall cross a street or roadway other than by a crosswalk in any business district between adjacent intersections controlled by traffic signal devices or by police officers. Section 23. Section 3328 of the Baldwin Park Municipal Code is hereby repealed. Section 24. Section 3331 of the baldian Park municipal Code is hereby repealed. Section 25. Section 3332 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 3332. Driving on Sidewalk or Curb. No vehicle shall be driven on, along, or upon any sidewalk, parkway or curb, other than on or over a regularly established driveway or roadway. Section 26. Section 3334 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 3334. No Parking on Parkway. No driver shall park or leave standing a vehicle on a parkway when the parkway is separated from the street by a regularly established curb. Section 27. Section 3335 of the B ldwin Park Municipal Code is hereby repealed. Section 28. Section 3336 of the Baldwin Park Municipal Code is hereby repealed. Section 29. Section 3343 of the Baldwin Park Municipal Code is hereby repealed. Section 34. Section 3;14,1 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 3344.1. The enforcement of the rules, regulations and laws of this chapter shall be by the Police Department of the City of Bald-win Park, provided, however, that the enforcement of the rules, regulations and laws of this city may be by the Califomia State Highway Patrol or the Sheriffts Department of the County of Los Angeles. Section 35. Section 3345 of the Baldwin Park Municipal Code is hereby repealed. Section 36. Section 3346 of the Baldwin Park Municipal Code is hereby repealed. Section 37. Section 3347 of the Baldwin Park Municipal Code is hereby repealed. Section 38. Section 3:.48 of the Baldwdn Park Municipal Code is hereby amended to read as follows: Section 3348. Standing or Parking in Alleys. No person shall park a vehicle in an alley, except t o unload materials or passengers; commercial vehicles, not more than twenty consecutive minutes; other vehicles, not more than three consecutive minutes. Section 39. Section 3348.1 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 3348.1. Commercial Parking. Every commercial vehicle must be parked so that the right hand wheels are within eighteen inches of. the curb. When no curbs or barriers bound the roadway, parallel parking is required at the edge of the roadway. Section 40. Section 3348.3 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 3348.3. Parking Prohibited. No person shall park a vehicle on public property for the purpose of displaying it for sale or rent. Section 41. Section 3348.4 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 3348.4. Parking Prohibited. No person shall park a vehicle other than a commercial vehicle in a loading zone to load or unload materials for more than twenty consecutive minutes between the hours of 7:00 AM and 6:00 PM, except on Sundays and holidays; no person shall park any vehicle in a loading zone to load or unload passengers for more than three consecutive minutes between the hours of 7:00 AM and b:00 PM, except on Sundays and holidays. Section 42. Section 3348.6 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 3348.6. Parking Prohibited. No person shall park any vehicle in such a manner or position as to obstruct the normal movement of traffic. Section 43. Section 3348.7 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 3348.7. Parking Prohibited. a) No person shall park, stop, stand or leave standing any vehicle in a red painted zone, whether the ve:lacle is attended or unattended, except that a bus may stop in a red zone marked or signpou ted as a bus loading zone. ORD 019ê79wS ×Pì³ OP.BIm= I,?0. b) No person shall park, stop, stand or leave standing any vehicle in a yellow painted zone, except for the loading or unloading of passengers and freight for such time as may be indicated in this chapter. c) No person shall park, stop, stand or leave standing any vehicle in a white painted zone, except for the loading or unloading; of passengers for such time as may be indicated in this chapter, or for the purpose of depositing mail in an adjacent mailbox. d) No person shall park, stop, stand or leave standing any vehicle in a green painted zone in excess of fifteen consecutive minutes. Section 42. Section 3348.8 of the Baldwin Park Ivfunicipal Code is hereby amended to read as follows: Section 3348.8. Vehicles Left Standing. No person shall park or leave standing ariy vehicle on any street for one hundred twenty or more consecutive hours. If such vehicle is determined to have been standing or parked in violation of this section, the vehicle may be removed from the street and impounded. Section 44. Section 3348.10 of the Baldwin Park Municipal Code is hereby repealed. Section 45. Section 334.8.1.1 of the Baldwiri Park Municipal Code is hereby repealed. Section 46. Section 3348.12 of the Baldwin Park Municipal Code is hereby repealed. Section 47. A new section is hereby added to the Baldwin Park Municipal Code to read as follows: Section 3348.13. Parking Prohibited. No person shall park or stand any vehicle upon a highway or portion thereof when the parking of such vehicle would prohibit or interfere with the repair, construction, or installation of underground utilities, or the use of the highway or any portion thereof authorized by the City Council for a purpose other than the normal flow of traffic or for the movement of equipment, articles, or structures of unusual size. Any vehicle left standing or parked after Temporary No Parking" signs have been erected for a period longer than twenty- four hours shall be removed and impounded. Section 48. Section 3349 of the Baldidn Park Municipal Code is hereby amended to read as follows: Section 3349. No person shall park or leave standing a commercial vehicle on a street in a residential area for more than five consecutive hours unless such commercial vehicle shall be actively and continuously used in rendering services at a location in the immediate area. Section 49. Section 3351 of.' the Baldwin Park Municipal Code is hereby repealed. Section 50. Section 3352 of the Baldtd n Park Municipal Code is hereby repealed. Section 51. Section 3355 of. the Baldwin Park Municipal Code is hereby repealed. Section 52. Section 3356 of the Bal dvu n Park Municipal Code is hereby repealed. Section 53. Section 3357 of the Bald-rAin Park Municipal Code is hereby repealed. Section 54. Section 3358 of the Baldidn Park Municipal Code is hereby repealed. Section 55.
