OF TIE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE BALDWIN PARK., NUETICIPAL CODE BY AMENDING SECTIONS 6107. f), 6112 b), 6128.11, 6128.18, 6126.19, 6128.21, 6128.22, 6128.29, 6128.31, 6128.32, 6128.35, 612848, 6128.53, 6128.56, 6128.59, 6128.60, 6128.61, 6128.62 and 6128.63, AND ADDING SECTION 6107 h) AND REPEALING SECTIONS 6128.12, 6128.113 and 6128.55. THE CITY COUNCIL OF THE CITY OF BALDWIN PARK does ordain as follows: SECTION 1. Section 6107, Sub-section f), of the Baldwin Park Municipal Code, is hereby amended to read as follows: 116107 f). Where it is provided that an annual license fee shall be paid for each year, or fraction thereof, any application.for said yearly license made on or before the 30th day of June of any calendar year shall be accompanied by the full annual fee regardless of the number of months which may have expired of the annual term prior to the filing of the application. Where it is provided herein that a yearly license fee shall be paid or.each year, or fraction thereof, any application for said yearly license which is filed on or after the first day of July of any calendar year shat be accompanied by one-half of the amount of the full annual fee regardless of the number of months which may have expired of the annual term prior to the filing of the application. The license collector is authorized to accept one-half of the annual fee when an annual license is issued on or after the 1st day of July of any calendar year, provided that the licensee shall othen~aise comply with all of the terms and conditions of the licensing provisions of this Code. SECTION 2. Section 6112, Subsection b), of the Baldwin Park Ilznicipal Code, is hereby amended to read as_.follows= 116112 b). All annual license fees shall be due on January 1st for the ensuing calendar year, and if not paid on January 1st then the same shall. be delinquent or. and after February 15th of the year in which they fall due, except as provided._in Sub-section f) of Section 6107; and further provided, that if the license fee shall not be an annual fee, then the said license fee shall be deemed delinquent if not paid within 10 days after the first day when the payment of such license sha11 be prescribed. SECTION 3. Section 6128.11 of the Baldwin park i°Mnicipal Code is hereby amended to read as follows: 612&.11 AUTOMOBILE ACCESSORIES. For every person engaged in the business of selling automobile accessories or automobile parts from a fixed place of business, the sum of Twenty-four $211.00) Dollars per annum, or fraction thereof. For every person engaged in the business of selling or delivering automobile accessories or automobile parts where no regular established place of business is maintained in Baldwin Park, the sun of Forty-eight $h8.00) Dollars per annum, or fraction thereof. SECTION I1. Section 6128.12 of the Baldwin Park Municipal Code is hereby repealed. e f r 1- ORD 028ê79wV ×Pí SECTION 5. Section 6128.18 of the,Baldwin park Municipal Code is hereby amended to read as follows: 6128.18. BARBER SHOPS. For every barber shop, the sum of Eighteen Dollars 18.00) per annum, or fraction thereof. 3XTION 6. Section 6128.19 of the Baldwin Park Municipal Code is hereby amended to read as follows: 6128.19 BEAUTY PARLORS. For every beauty parlor the sum of Eighteen Dollars w18.00) per.. annum, or fraction thereof. SECTION 7. Section 6128.21 of the Baldwin Park Municipal Code is hereby amended to read as folI ows: 6128.21. For every erson engaged in the business of real estate broker, the sum of y 2E.00 per annum, or fraction thereof, plus the sun of X6.00 per annum for each employee, or salesman, other than the broker proprietor. SETION u. Section 6126.22 of the Baldwin Park 1,11unicipal Code is hereby amended. to. read as follows 6128.22. For every person engaged in the business of stock broker, the sum of 42490 per annum, or fraction thereof, plus the swn of i~'6.00 per annum for each salesman or employee other than the broker proprietor. SECTION 9. Section 6128.29 of the Baldwin Park municipal Code is hereby amended to read as follows; 6128.29. COBBLERS. For every cobbler shop the sum of Twelve Dollars 012.00) per annum, or fraction thereof. SECTION 10. Section 6128.31 of the Baldwin Park Municipal Code is hereby amended to read as follows: 6128.31 COMMCIAL BUSINESS. For every person conducting a commercial business, not otherwise herein specifically provided for, the sum of Twenty-four $24.00) Dollars per annum, or fraction thereof, plus the sum of Three Dollars $3.00) for each employee in excess of three in number. The number of employees shall mean the average monthly number of persons employed by said business daring the preceding calendar year, and shall be determined by the following foxmala: one-twelfth 112) of the total number of employees during the preceding year earning wages during any pay periods ending nearest the fifteenth 15th) day of each s ar month. When a business has existed less than twelve 12 months of the prior year, the actual number of months of existence shall be the computing fraction. If an employer has not previously engaged in business, he may estimate the average number of employees who will be employed by him daring the remainder of the calendar year. Provided, however, that where the stock in trade of the person conducting said commercial business shall be less than Five Hundred Dollars 0500.00) and the license fee shall be Twenty- four Dollars WWO) per annum, or fraction thereof. SECTION 11. Section 6128.32 of the Baldwin Park Municipal Code is hereby amended to read as follows; 6128.32. CONTRACTORS, GENERAL. A) For every General Engineering Contractor or General. Contractor the sum of Forty-eight $48.00) Dollars per annum, or fraction thereof. A general engineering contractor is a contractor whose 2- ORD 028ê79wV ×Pí principal contracting business is in connection with fixed works for any or all of the following provisions or subjects; irrigation, draining, water, power, water supply, flood control, inland waterways, harbors, railroads, highways, tunnels, airports, airways, sewerage, and bridges. A general building contractor is a contractor whose principal contracting business is in connection with any structure or building being built or to be built for the support, shelter, and enclosure of persons, animals, chattels, or movable property of any kind, requiring the use of more than two unrelated building trades or crafts, or to do or superintend the whole or any part thereof. b) SPECIALTY CONTRACTORS. For every Specialty Contractor the sum of Twenty-four 32L.00) Dollars per annum, or fraction thereof. SECTION 12. Section 6125.35 of the Baldwin Park inanicipal Code is hereby amended to read as follows: 6128.35. MXTRICAL.FIXTURES & SUPPLIES. For every person engaged in the business of selling electrical fixtures and supplies, the sure of Twenty-four 24.00) Dollars per annum, or fraction thereof. SECTION 13. Section 612S.62 of the Baldwin Park 1-unicipal Code is hereby amended to read as follows? 6128.62. V'` ITMIG IMCHDIE OPM?ATORS: JUKE BOXES, GAME, SIGHING OR VENDING I'1ACHINES. For every person carrying on the- business of renting,.leasing or.maintaining any juke box, game machine, weighing machine, or vending machine, or any other similar machine or device, whereby a sum is charged by means of a coin, slot, or otherwise, except as provided herein, the stun of Twenty-four $214.00) Dollars per annum, or fraction thereof. ORD 028ê79wV ×Pí A person owning and operating his own business at a fixed place of business within the City of Baldwin Park, who is also that bonafide owner of the weighing or vending machine, shall not be required to secure a vending machine operator's license. Provided, however, that each owner of a vending machine or weighing machine shall secure a license for each machine, as follows a) Juke Boxes. Coin operated devices used for the disbursing o music, the sum of Twelve Dollars 312.00) per machine per annum, or fraction.thereof, whether the same is owned by the owner of the place of-business whereat the device is located, or is independently owned by a vending machine operator. b) Game Machines. Any game machine or device, not prom M y aw, where any sum is charged by means of a coin, slot or otherwise, and the licensing for which is not herein otherwise provided for, the sum of Forty-eight OL8.00) Dollars per annum, or fraction thereof, for each such machine. Each application for such a license shall describe the type of machine, the serial number, if any, the name of the manufacturer, and the location where each machine is to be operated. Each machine is to bear the name of the Iicensee, in plain view in letters of not less than-one-quarter inch 1/h"j in height. c) Weighing Machines. Coin operated devices used for the purpose o weighing, the sum of One Dollars 1.00) per machine per annum, or fraction thereof, whether the same is owned by the owner of the place of business whereat the device is located or is independently owned by a vending machine operator. d) Ven Machines. Vending Machines requiring eleven dens 11¢), or less, to activate the mechanism, and soft drink vending machines, the sum of One Dollar $1,00) per machine per annum, or fraction thereof, whether the sane is owned by the owner of the place of business whereat the device is located, or is independently owned. SECTION 22. Section 6128.63, of the Baldwin Park Municipal Code is hereby amended to read as follows; 6128.63. WIOLr For every person engaged in the business of selling merchandise at wholesale from a fixed place of business in the city of Baldwin Park, the sum of Twenty-four Dollars w21~.00) er annum, or fraction thereof, and Si.c Dollars 36.00 for each. additional employee or partner in excess.of one. SXTION 23. erection 6107 of the Baldwin Park Taunicipal Code is hereby amended by adding a new Section thereto, to be known as Section 6107, Sub-section h).. 6107 h) Where it is provided herein that a license 5- ORD 028ê79wV ×Pí fee shall be payable by the owner, operator or user of a truck, wagon or vehicle, and the amount of the license is detexmined or measured by the number of vehicles used by the Licensee within the City, the number of vehicles shall be for the purpose of detexminin-f the number of vehicles within the City, and shall not refer to the specific vehicle, wagon or truck. Any license issued pursuant to such provisions may be transferred from one vehicle to another, provided that the I censee shall not have within the City at any one tithe more vehicles, wagons or trucks than he shall have licenses.
