Sections 3200, 3201, 3203 and 3204 of the Baldwin Park Municipal. Code are hereby amended, and Section 3202 is hereby added to the aldwin Park. I:iunicipal Code, to read as follows: 3200. Registration of Felons. Every person who has been convicted in any Federal or State Court prior to the effective date of this Code, or who, subsequent to the effective date of this Code, is convicted of any crime punishable as a felony in the State of California, and who comes into the City of Baldwin Park from any point outside of the City, whether in transit through the City or otherwise, and every person who, at the effective date of this Section o: this Code is residing, or is present within the City, shall report to the Chief of Police of the City of Baldwvixx Park within forty-eight 48) hours after his arrival within the City, and shall furnish to the Chief o£ Police of the City of Baldwin Park a written statement signed by such person, the true name of such person and each other name or alias by which such person is or has been known, a full and complete description of iir_self, the name of each. crime punishable as a felony in the State of California, whether such conviction shall have occurred in the State of California or in some other State or Federal Court, and he: shall also state t^.e name of the place where such crime was committed, the name under which he was convicted and tile date of the conviction thereof, the name, if any, and the location of each prison, reformatory or other penal institution in which lie shall have been confined as punishment there- for, tog=ether with tie location or address of his residence, stopping place or living quarters in said City, and each one thereof, if any, or the address or location of his intended residence, stopping place, or living; quarters, and each one thereof, with a description of the character of each such place, whether a hotel, apartment house, dwelling house, or otherwise, ivi.ng the street number thereof, if any, or such description of the address or location as will so identify the same as to maze it possible of location and tae length of time for which he expects or intends to reside within the City, and to further furnish in writing, to the Chief of Police the license number of any wator.-:obile which he owns or has under iris control, or has the use thereof. At the time of furnisAing such information, said person shall be photographed and fingerprinted by the Chief of Police of the City of Baldwin Par':, and said photograph and fingerprints shall be made a part of the permanent, confidential record herein provided for, and the same shall not be open to inspection by the public or by any person other than a regularly employed peace officer or other law enforcement agency of a municipality, of a State, or a Federal governmental agency. 3201. Change of Address. In the event that any person specified in the preceding section shall change any place of residence, stopping place or living quarters to any new or different place or places within said City other than any place last shown in said report to the Chief of Police of the City of Baldwin Park, or shall change the license nuxaber of the automobile which lie owns or has under iris control, or shall secure a new or different autommobile, lie shall, within forty-eight 48) hours after makin° such change, notify said Chief of Police of the City of Baldwin Park, in a written anti signed statement, of such change of address or change of ORD 038ê79wT ×PíK Ordinance No. 36 automobile or license number, and shall furnish stich written statement to said Chief of Police of the City of Baldwin Park. It shall be unlawful for any person required by any provision of this section of the Baldwin Pare. b-:unicipal Code to furnish in any such report any false or fictitious address, or any address other than a true address or intended address, or furnisi~ in makin;; any such. report, any false, untrue, or misleafing information or statement relating to any information required by any provision of this Code to be mare or furnished. 3202. Records. The Chief of Police of the City of Baldwin Park shall cause to be made a permanent record of all information, photographs and fingerprints required by the provisions of the preceding sections to be furnished to or by him, and said records, photographs and fingerprints shall be deemed confidential information and shall not be available to any persons except inspection by regularly employed peace officers or other law enforcement agency of a municipality or of a State or of a Federal governmental agency. 3203. Persons Exempted. The provisions of this Code relating to the registering of felons shall not apply to any person who has received a full pardon for each such crime whereof he shall have been convicted, nor to any person who is on parole or probation under the laws of the State of California. 3204. Sex Registration. Every person convicted of those sex crimes as enumerated in Section 290 of the Penal Code of the State of California, must register with the Chief of Police within forty-eight 4s) hours of his coming into the City of Baldwin Par'.:, or shall be temporarily domociled within the City of Baldwin Park for a period of thirty 30) days, or in the event he shall reside in tale City o£ Baldwin Park. SECTIO14 2. Seyerability. If any provision of this Ordinance, or the application thereof, to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without-die invalid provisions or applications, and to this end the provisions of this Ordinance are declared to be severable. SECTION 3. This ordinance is hereby declared to be an emergency ordinance measure necessary for the immediate preservation of the public peace, health and safety, and shall take e ffect immediately. The following is a statement of facts showing its urgency; A survey by the police department of the City of Baldwin Park has shown that of the recorded persons subject to registration with the police depart- ment as a person previously convicted of a felony is approximately only ten percent of those which the police department has reasonable grounds to believe reside within the City of Baldwin Park; that persons previously convicted of a felony are generally of a transitory type. That to allow a period of thirty 30) days in which they shall be required to register is too great a period of time, and such excessive period of time would endanger the protection of life and property within the said City; furthermore, in order that the laws of this City relating to the registration of persons previously convicted of a felony may be brought into conformity with State and other governmental subdi- visions of the State at the earliest possible date, it is necessary that this Ordinance take effect immediatel-. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published or posted in the manner required by 22f ORD 038ê79wT ×PíK Ord.
