HomeMy WebLinkAboutORD 039ORD 039ê79wS ×Píg ORDINANCE N0. 39 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK RELATING TO THE REGULATION OF SWIMMING POOLS, AND ADDING NEW SECTIONS TO 111E BALDWIN PARK MUNICIPAL CODE, TO BE KNOM AS SECTIONS 8190, 8191, 8192, 8193 and 8194, AND TO BE DESIGNATED AS ARTICLE 8, BUILDING REGULATIONS, CHAPTER 1, BUILDING CODE, PART 1.9; SWI1,9IING POOL REGULATIONS. TIE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: Section 1. A new part is hereby added to the Baldwin Park Municipal Code, to be known as Part 1.9, Article VIII, Chapter 1, and there is hereby enacted new Sections, numbers 8190, 8191, 8192, 8193 and 8194 of the Baldwin Park Municipal Code, to read as follows: Section 8190. SWIMMING POOLS TO BE ENCLOSED. Every person in possession or control of land within the City, either as owner, purchaser, purchaser under contract, Lessee, Tenant, or Licensee, upon which is situated a swimming pool, shall at all times maintain a fence or wall which completely surrounds such pool or lot or premises upon which the pool is situated, which fence or wall is not less than four feet in height above the underlying ground. No opening in said fence or wall shall be larger than four 4) inches square, except where means of ingress and egress are provided for by doors or gates. All doors or gates providing means of access through such enclosure shall be equipped with a self-closing and self-latching device designed to keep and capable of keeping such door or gate securely closed at all times when not in actual use; provided that the door of any dwelling occupied by human beings and forming any part of the enclosure need not be equipped with a self-closing device. Section 8191. SWID4h1ING POOL. MAY BE COVERED IN LIEU OF ENCLOSURE. Any person required to maintain an enclosure of a swimming pool may, in lieu thereof, cover said pool when the same shall not be in use, with a pool cover or other protective device. Such pool cover or protective device shall be securely attached at or near the edges of the said pool, and said points of attachment shall not be spaced greater than one foot apart, and provided further that the said protective cover or protective device shall be capable of supporting 400 lbs. at any point where it shall be suspended above the pool. Any pool cover or protective device shall be approved by the building inspector before the same may be used in lieu of the fence or wall required. Section 8192. MODIFICATIONS SUBSTITUTIONS. The building inspector may, to avoid undue hardship to an individual, make modifications with respect to the height of the enclosure, or the nature or position of the latch, provided that such modifications do not modify the degree of protection afforded. The building inspector may permit other protective devices or structures to be used, provided the degree of protection afforded by the substitute devices or structures is equal to or greater than the protection afforded by the fence, wall, structure, door, gate, latch and cover described in Sections 8190 and 8191. Section 8193. FINAL INSPECTION; APPROVAL. All plans submitted to the City for swimming pools shall show compliance with this Code, and final inspection and approval by the building inspector of all swimming pools constructed after the effective date of this Ordinance shall be withheld until all requirements have been complied with. All persons ORD 039ê79wS ×Píg ORD. NO. 39 maintaining swimming pools shall comply with the provisions of Sections 8190, 8191 or 8192 within ninety 90) days after the effective date of this Ordinance. Upon application of any such person, the building inspector may, for good cause shown, grant, from time to time, extensions of time for compliance, but no extension of time for compliance shall exceed thirty 30) days. Section 8194. Nothing contained herein shall authorize the installation, nor shall approval by the building inspector authorize the installation of a swimming pool for commercial purposes when such commercial swimming pool shall not comply with all the ordinances of the City of Baldwin Park. Section 2. The City Clerk shall certify to the adoption of this Ordinance, and cause the same to be published or posted in the manner required by law, and this ordinance shall take effect thirty 30) days after its adoption.
