AN ORDINANCE OF THE CITY COUNCIL OF UM
CITY OF BALDWIN PARK ADDING NEW SECTIONS TO
TO BALDWIN PARK MUNICIPAL CODE, TO BE KNOWN
AS SECTIONS 4510, 4510.1, 4510.2, 4510.3,
AND PROVIDING FOR THE CARE, RESTITUTION, SALE
AND DESTRUCTION OF UNCLAIMED PROPERTY.
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS:
Section 1. Four new sections are hereby added to the Baldwin Park
Municipal Code, to be known as Sections 4510, 4510.1, 4510.2, and 4510.3,
and to read as follows:
4510. It is hereby made the duty of all officers and employees
of the City of Baldwin Park whenever they find within the corporate
limits of said City, or whenever there comes into their possession
any personal property which such finder or possessor has reason to
believe may have been lost, stolen, or abandoned, to deliver the
same to the Chief of Police,
4510,1, It shall be the duty of the Chief of Police to take
charge of and keep in his possession said property, and he must
within five days inform the owner thereof, if known, and make
restitution to him of such property upon demand without compensation,
Should any such property remain unclaimed by its true owner for a
period of six months from the date of finding, the Chief of Police
is hereby authorized and required to cause the same to be sold at
public auction to the highest Bidder. Notice of such sale shall be
given by the Chief of Police at least five days before the time fixed
therefor, of a statement of the time and place fixed therefor, together
with a schedule of the property to be offered for sale, by publication
in a newspaper of general circulation published in the County of Los
Angdes, State of California. Immediately after the completion of any
such sale the Chief of Police shall give to the City Treasurer a
statement of the proceeds thereof, together with the expense incurred
in concluding such sale. Said Chief of Police shall forthwith pay
such proceeds to the City Treasurer and the City Treasurer after
deducting the necessary expenses actually incurred shall deposit the
balance thereof in the general fund.
44510,2, If there be no bids for any such property offered for
sale at such auction, the property shall be retained by the Chief of
Police, and the same shall be included in the statement and the
schedule of property offered for sale at the next succeeding auction
sale. If such property is not sold at the second auction sale at which
it shall be scheduled, the Chief of Police may make a determination
that the said property is without value, and he shall transmit such
determination to the City Treasurer, Thirty days after the filing of
the said determination that the property is without value the Chief
of Police may make such disposition thereof in the public interest
as he shall deem fit.
4510.3, The provisions of this ordinance shall not apply to
property subject to confiscation under State or Federal law, or as
to property which shall have been seized as evidence or exhibits.
Section 2, The City Clerk shall certify to the adoption of this
ordinance and shall cause the same to be published or posted in the manner
