AN ORDINANCE OF THE CITY COUNCIL OF ME CITY OF BALDWIN PARK AMENDING THE INTERIM ZONING ORDINANCE OF THE CITY OF BALDWIN PARK BY AMENDING SECTIONS 9100.633, 9100.63.4 and 9100,636, and BY ADDING TWO NEW SECTIONS TO BE KNOWN AS SECTIONS 9100,260 and 9100,5251, AND PROVIDING FCR THE WAINEt OF THE AUTOMOBILE PARKING AREA REQUIREMENTS IN THE C-2 ZC?NE, AND ESTABLISHING A PROCEDURE FOR SUCH WAIVER, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: Section 1, Two new sections are hereby added to the Baldwin Park Municipal Code, to be known as Sections 9100.260 and 9100.5251, and shall read as follows: Section 9100,260, Waiver of Parking Requirements in C-2 Zone, a) When Parking Area May be Waived. At the time when the use or occupation of a building is changed to another different use or occupation the parking area requirements provided by Section 9100,259 may be waived pursuant to Part 2, Division VI, of this Zoning Ordinance, when it is found by the Planning Commission that: 1. Such automobile parking area requirements in the C-2 zone cause the applicant undue hardship. 2. That the applicant has made a reasonable effort to provide the required automobile parking area, b) No waiver of the automobile parking area requirements in the C-2 zone shall be for a period longer than five 5) years. However, nothing contained herein shall prohibit the refiling of an application for a waiver upon the expiration of the period for which it is granted, Section 9100,5251, Waiver of the C-2 Parking Requirements. An exception in the nature of a waiver of the automobile parking area requirements in the C-2 zone, but limited to said C-2 zone, may be made by the Planning Commission with or without a public hearing in accordance with the provisions of Part 2, Division VI, of this ordinance. ection 2, Section 9100,633 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 9100,633, Any person desiring any permit, exception, variance, waiver of the parking area requirements in the C-2 zone, or other approval required by or provided for in this ordinance, shall file an application therefor with the Commission. Section 3, Section 9100,634 of the Baldwin Park Municipal Code is hereby amended to read as follows: Section 9100,634. Contents of Application, Such application shall state: a. The name and address of the applicant, b. Evidence that the applicant: 1. Is the owner of the premises involved, or 1- ORD 052ê79wS ×Pí¤ ORDINANCE NO, K2 2, Has the permission of such owner to make such application, or 3, Is or will be the plaintiff in an action in eminent domain to acquire the premises involved, c. The legal description of, and, if there be a street address, the street address, otherwise a description of, the premises upon which the requested use is to be maintained, d, Such other information as specified elsewhere in this Chapter, or which the Director of Planning may deem necessary to enable the Planning Commission to determine that an application falls within the provisions of the zoning regulations of the City of Baldwin Park or necessary or convenient for the determinations of the Planning Commission, Section 4, Section 9100,636 of the Baldwin Park Municipal Code is hereby amended by adding a new Sub-section thereto, to be known as Sub-section a-5, and the said Section 9100,636 by this amendment shall read as follows: Section 9100,636, Fees and Deposits, a, For the purpose of partially defraying the expanses involved in connection with any application or petition) required by this ordinance, the following filing fee shall accompany the application or petition): 1, For changes of zone or variance, ONE HUNDRED DOLLARS $100,00) plus FIFTEEN DOLLARS $15,00) for each parcel more than one, 2, For special permits, ONE HUNDR33D DOLLARS $100,00), 3. For exceptions, ONE HEW RED DOLLARS $100,00), 4. For house moving, TWENTY--FIVE DOLLARS $25,00), 5. For a waiver of the parking area requirements in the C-2 zone, the following fee: where no public hearing is required by the Planning Commission, no filing fee; where a public hearing is required by the Planning Commission, the applicant shall pay the actual cost which is necessary to compensate the City of Baldwin Park for direct costs of printing, mailing and map- making. For the purpose of defraying such actual cost the applicant shall deposit with the Director prior to the initiation of the said public hearing, the sum of THIRTY--FIVE DOLLARS $35,00),and in addition thereto any additional amounts that may be expended, b, In addition to the required filing fee, the applicant or petitioner) shall deposit with the Director the following amounts: 1.
