HomeMy WebLinkAboutORD 058ORD 058ê79wU ×Pí ORDINANCE N0,58 AN ORDINANCE OF THE CITY OF~BALDWIN PARK AMENDING THE BALDWIN PARK.MUNICIP4±.C0DE_$Y ADDING SECTIONS THERETO,,WHICH„SECTIONS,CREATE,,THIS OFFICE OF CHIEF ADMINISTRATIVE OFFICER, IN THE„CITY Oh'.,BALDWIN PARK AND PROVIDE,FOR HIS POWEAS.AND DUTIES, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1: ADDING SECTIONS TO MUNICIPAL CODE. Chapter 9 is added to Article II of the Baldwin Park Municipal Code, the sections of which shall read as follows: CHAPTER 9 Section 2901. Creation of Office. The office of Chief Administrative Officer is hereby created. Section 2902. Appointment of Chief Admin- istrative Ofd r. The Chief Administrative Officer shall be appointed by.majority vote of the City Council solely on the basis of his executive and administrative qualifications with special reference to his actual experience in or his knowledge of accepted practice in respect to the duties of his office hereinafter set forth. At the time of his appointment he need not be a resident of the City or the State, but during his tenure of office he shall reside within the City. No Councilman shall receive such appointment during the term for which he shall have been elected nor within one year after the expiration of his term. Section 2903. Removal of Chief Adminis- trative Officer. The City Council may remove the Chief Ad- ministrative,Off cer at any time by a majority vote of its members. If requested, the Council shall grant him a public hearing within 30 days following notice of re- moval. During the interim the Council may suspend the Chief Administrative Officer from duty, but shall con- tinue his salary and, if the removal becomes final, shall pay his salary for one calendar month following the final removal date. Section 2904. Powers and Duties of Chief Administrative cer. The Chief Administrative Officer shall be the chief administrative officer of the City. He may head one or more departments and shall be responsible to the City Council for the proper administration of all affairs of the City. To that end, he shall have power and shall be required to: /' ORD 058ê79wU ×Pí ORDINANCE N0. 58 Council for approval, and advise the Council, on the advantages or disadvantages of contract and bid proposals. No purchase shall be made, contract let or obligation incurred for any item or service which exceeds the current budget appropriation with- out a supplemental appropriation by the Council. No contract in excess of $300.00 and no contract for, new construction shall be let except.by the City Council. The Chief Administrative Officer may issue such rules governing purchasing procedures within the administrative organization as the Council shall ap- prove. J) See that all laws and ordinances are duly enforced. k) Investigate the affairs of the City or any depart- ment or division thereof. Investigate all complaints in relation to matters concerning the administration of the government of the City, and in regard to service maintained by the public utilities in the City, and see that all franchises, permits, and privileges granted by the City are faithfully observed. 1) Devote his entire time to the discharge of his of- ficial duties. m) Keep the members of the City Council informed at least once-a week of the administrative affairs and happenings of the City. n) Perform such other duties as may be required by the Council, not inconsistent with the State law or the Baldwin Park Municipal Code. Section 2905. Council Not to Interfere with Appointments or Remov'Ss Neither the Council nor any of its members shall direct or request the appointment of any person to, or his removal from, office by the Chief Administrative Officer or any of his subordin- ates, or in any manner take part in the appointment or removal of officers and employees in the administrative service of the City, except as specified in Section 2904 of this Chapter. Ex- cept for the purpose of inquiry, the Council and its members shall deal with the administrative service solely through the Chief Administrative Officer and neither the Council nor any member thereof shall give orders to any subordinates of the Chief Administrative Officer, either publicly or privately. Section 2906. Bond. The Chief Administrative Officer shall furnish a surety bond to be approved by the Council, said bond to be conditioned on the faithful performance of his duties. The premium of the bond shall be paid by the City. Section 2907. Compensation. The Chief Administrative Officer shall receive such com- pensation as_the Council shall fix from time to time by ordin- ance or resolution." ORD 058ê79wU ×Pí ORDINANCE NO. 58 Council appoint and, when necessary yoforhthe good of the City, suspend or remove department heads including the Chief of Police, Planning Director, Finance Officer, City Engineer, Director.of Civil Defense and such other specifically named depart- ment heads as the City Council may from time to time determine by Minute Action. Appoint, and when necessary for the good of the City, suspend or remove all other officers and employees of the City, except the City Clerk, the City Treasurer and the City Attorney, or as other- wise provided by law. He shall authorize the head of a department or office to appoint, suspend or remove subordinates in such department or office. b) Prepare the budget annually and sub- mit it to the council together with a message describ- ing the important features and be responsible for its administration after adoption. c) Prepare and submit to the Council as of the end of the fiscal year, a complete report on the finances and administrative activites of the City for the preceding year. d) Keep the Council advised of the fin- ancial condition and future needs of the City, and make such recommendations as he may deem desirable. e) Recommend t o the governing body a standard schedule of pay for each appointive office and position in the city service, including minimum, intermediate, and maximum rates. Vf) Recommend to the governing body from time to time,, adoption of such measures as he may, deem necessary or.expedient for the health, safety, or wel- fare of the community or for the improvement of adminis- trative services. g) Consolidate or combine offices, posi- tions, departments, or units under his jurisdiction, with the approval of the City Council. The Chief Ad- ministrative Officer may be the head of one or more departments. h) Attend all meetings of the City Council unless. excused therefrom and take part in the discussion of all matters coming before the Council when requested by the Council. He shall be entitled to notice of all regular and special meetings of the Council. I) Supervise the purchase of all materials, supplies, and equipment for which funds are provided in the budget; let contracts necessary for operation or maintenance of city services for amounts up to and in- cluding $300.00; receive bids for purchases or con- tracts in excess of $300.00 and present them to the ORD 058ê79wU ×Pí ORDINANCE o. 58 SECTION 2: CERTIFICATION AND PUBLICATION. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published or posted in the manner required by law, and this Ordinance shall take effect thirty 30) days after its adoption.
