HomeMy WebLinkAboutORD 071ORD 071ê79wS ×Píè ORDINANCE NO. 71 Aid ORDINANCE OF THE CITY OF BA.LDWIN PARK AMENDING THE ivUIJICIPAL CODE PERTAINING TO THE LICENSING THE TRAhTSACTION Ai4D CARRYING ON OF CERTAIN BUSINESSES, TRADES, PROFESSIO11JS, CALLINGS AND OCCUPATIONS IN THE CITY OF BA.LDWIN PARK FOR THE PURPOSE OF RAISING r"I'UN IC I PAL REVENUE THE CITY COUNCIL OF THL CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS SECTION 1: AMENDING MUNICIPAL CODE. Chapters I, II, III and IV of Article VI of tine Baldwin Park Municipal Code are hereby repealed, and the following Chapter to said Article VI is hereby enacted in lieu thereof in their place and stead: ARTICLE VI Business Licensing Chapter I Licensing for Revenue Part I General SECTION 6100. DEFINITIONS. a) Person. As used in this Chapter, tperson' includes all domestic and foreign corporations, associ- ations, syndicates, joint stock corporations, partner- ships of every kind, clubs, Massachusetts, business, or common law trusts, societies, and individuals transacting and carrying on any business in the City of Baldwin Park other than as an employee. b) Business. As used in this Chapter, business' includes professions, trades, and occupations and all and every kind of calling whether or not carried on for profit. 11(c) Tax Collector. As used in this Chapter, tax collector' shall mean the officer appointed by the City Council from time to time by ordinance or resolution, to carry out the duties and to have the authority of the tax collector as set forth in this Article. SECTION 6101. REVENUE MEASURE. This Chapter is enacted solely to raise revenue for municipal purposes, and is not intended for regulation. SECTION 6102. SUBSTITUTE FOR OTHER REVENUE REGULATIONS. Persons required to pay a license tax for transacting and carrying on any business under this Chapter shall not he relieved from the payment of any license tax for the privilege of doing such business required under any other regulation of the City of Baldwin Park, and shall remain subject to the regulatory provisions of this Code. 1- ORD 071ê79wS ×Píè SECTION 6103. EFFECT OF CHAPTER ON PAST ACTIONS AND OBLIGATIONS PREVIOUSLY ACCRUED. Neither the adoption of this Chapter nor its super- seding of any portion of.' this Code of the City of Baldwin Park shall in any manner be construed to affect prosecu- tion for violation of any other regulation committed prior to the effective date hereof, nor be construed as a waiver of any license or any penal provision applicable to any such violation, nor be construed to affect the validity of any bond or cash deposit required by any regulation to be posted, filed, or deposited, and all rights and obligations thereunto appertaining shall continue in full force and effect. SECTION 610 LICENSE REQUIRED. There are hereby imposed upon the businesses, trades, professions, callings and occupations specified in this Chapter license taxes in tine amounts hereinafter prescribed. It shall be unlawful for any person to transact and carry on any business, trade, profession, calling or occupation in the City of Baldwin Park without first having procured a license from said City so to do or without complying with any and all applicable provisions of this Chapter. This section shall not be construed to require any person to obtain a license prior to doing business within the city if such requirement conflicts with applicable statutes of tine United States or of the State of California. Persons not required to obtain a license prior to doing business within the city because of conflict with applicable statutes of The United States or of the State of California shall be liable for payment of the tax im- posed by this Chapter. SECTION 6105. BFANCH ESTABLISHTdIENTS. A separate license must be obtained for each branch establishment or location of the business transacted and carried on and for each separate type of business at the same location, and each license shall authorize the licensee to transact and carry on only tine business licensed thereby at the location or in the manner desig- nated in such license; provided that warehouses and dis- tributing plants used in connection with and incidental to a business licensed under tine provisions of this Chapter shall not be deemed to be separate places of business or branch establishment. SECTION 6106. ExF_TJPTIONS. a) Nothing in this Chapter shall be deemed or construed to apply to any person transacting and carrying on any business exempt by virtue of the Constitution or applicable statutes of The United States or of the State of California from the payment of such taxes as are herein prescribed. 2- ORD 071ê79wS ×Píè None of the license taxes provided for by this Chapter shall be so applied as to occasion an undue burden upon interstate commerce. In any case where a license tax is believed by a licensee or applicant for a license to place an undue burden upon such com- merce, he may apply to the Tax Collector for an adjust- ment of the tax so that it shall not be discriminatory or unreasonable as to such commerce. Such application may be made before, at or within six months after payment of the prescribed license tax. The applicant shall, by affidavit and supporting testimony, show his method of business and the gross volume or estimated gross volume of business and such other information as the Tax Collector may deem necessary in order to determine the extent, if any, of such undue burden on such commerce. The Tax Collector shall then conduct an investigation, and, after first having obtained the written approval of the City Attorney, shall fix as the license tax for tine applicant, an amount that is reasonable and non- discriminatory, or if the license tax has already been paid, shall order a refund of the amount over and above the license tax so fixed. In fixing the license tax to be charged, the Tax Collector shall have the power to base the license tax upon a percentage of gross re-, ceipts or any other measure which will assure that the license tax assessed shall be uniform with that assessed on businesses of like nature, so long as tine amount assessed does not exceed the license tax as prescribed by this Chapter. Should the Tax Collector determine the gross receipts measure of license tax to be the proper basis, he may require the applicant to submit, either at the time of termination of applicant's busi- ness in the City of Baldwin Park, or at the end of each three-month period, a sworn statement of the gross re- ceipts and pay the amount of license tax therefor, pro- vided that no additional license tax during any one calendar year shall be required after the licensee shall have paid an amount equal to the annual license tax as prescribed in this ordinance. Any person claiming an exemption pursuant to this section shall file a verified statement with the Tax Collector stating the facts upon which exemption is claimed. The Tax Collector shall, upon a proper showing contained in the verified statement, issue a license to such person claiming exemption under this section without payment to the city of the license tax required by this ordinance. The Tax Collector, after giving notice and a reasonable opportunity, for hearing to a licensee, may revoke any license granted pursuant to the provisions of this section upon information that the licensee is not entitled to the exemption as provided herein. b) Charitable and Non-profit Organizations. The provisions of this Chapter shall not be deemed or con- strued to require the payment of a license tax to conduct, ORD 071ê79wS ×Píèmanage, or carry on 0.ny i~us ine o<<;~,upation, or activity from any institution or organization which is conducted, managed or carried on wholly for the benefit of charitable purposes or from which profit is not derived, either directly or indirectly, by any individual; nor shall any license tax be required for the conducting of any entertainment, concert, exhibi- tion, or lecture on scientific, historical, literary, religious, or moral sut,jects within the City whenever the receipts of any such entertainment, concert, ex- hibition, or lecture are to be appropriated to any church or school or to any religious or benevolent purpose; nor shall any license tax be required for the conducting of any entertainment, dance, concert, ex- hibition, or lecture by any religious, charitable, fraternal, educational„ military, state, county, or municipal organization or association whenever the receipts of any such entertainment, dance, concert, exhibition, or lecture ar,e to be appropriated for the purpose and objects for which such organization or association was formed and from which profit is not derived, either directly or indirectly, by any in- dividual; provided, however, that nothing in this section shall be deemed to exempt any such organiza- tion or association from complying with any of the provisions of this Code requiring a permit from the City Council or any commission or officer to conduct, manage, or carry on any profession, trade, calling or occupation. t(c) Disabled Veterans. No license tax payable hereunder shall be payable by any person who has re- ceived an honorable discharge or release from active duty in one of the United States armed services, who is physically unable to obtain a livelihood by manual labor, and who is a voter of this state. SECTION 6107. APPLICATION CONTENTS OF LICENSE. Every person required to have a license under the provisions of this ordinance shall make application for the same to the Tax Collector of the City of Baldwin Park, and upon the payment of the prescribed license tax the Tax Collector shall issue to such person a license which shall contain 1) the name of the person to whom the license is issued, 2) the business licensed, 3) the place where such business is to be transacted and carried on, 4) the date of the expiration of such license, and such other information as may be necessary for the enforcement of the provisions of this Chapter.,,,-', SECTION 6108. AFFIDAVIT. FIRST LICENSE. Upon a person making application for the first license to be issued hereunder or for a newly estab- lished business, such person shall furnish to the Tax Collector for his guidance in ascertaining the amount 11- ORD 071ê79wS ×Píè1 of license tax to be paid by the applicant, a written statement, upon a form provided by the Tax Collector, sworn to before a person authorized to administer oaths, setting forth such information as may be therein re- quired and as may be necessary to determine the amount of the license tax to be paid by the applicant. The Tax Collector shall not issue to any such person another license for the same or any other busi- ness, until such person shall have furnished to him the written statement and paid the license tax as herein required. SECTION 6109. AFFIDAVIT. REidEWA.L LICENSE. In all cases, the applicant for the renewal of a license shall submit to the Tax Collector for his guidance in ascertaining the amount of the license tax to be paid by the applicant, a written statement, upon a form to be provided by the Tax Collector, written under penalty of perjury, or sworn to before a person authorized to administer oaths, setting forth such information concerning the applicantts business during the preceding year as may be required by the said Tax Collector to enable him to ascertain the amount of the license tax to be paid by said applicant pursuant to the provisions of this Chapter. SECTION 6110. STATETVIENTS NOT CONCLUSIVE. No statements shall be conclusive as to the matters set forth therein, nor shall the filing of the same preclude the City of Baldwin Park from collecting by appropriate action such sum as is actually due and payable hereunder. Such statement and each of the several items therein contained shall be subject to audit and verification by tine Tax Collector, his deputies, or authorized employees of the City, who are hereby authorized to examine, audit and inspect such books and records of any licensee or applicant for license, as may be necessary in their judgment to verify or ascertain the amount of license fee due. All licensees, applicants for licenses, and persons engaged in business in the City of Baldwin Park are hereby required to permit an examination of such books and records for the purposes aforesaid. The information furnished or secured pursuant to this section or Sections 6106 and 6109 of this Chapter shall be confidential. Any unauthorized disclosure or use of such information by any officer or employee of the City of Baldwin Park shall constitute a misdemeanor and such officer or employee shall be subject to the penalty provisions of this ordinance, in addition to any other penalties provided by law. 5- ORD 071ê79wS ×Píè SECTION 6111. FAILURE TO FILE STATEIvENT OR 7_ORRECTED STATEMENT. If any person fails to file any required statement within the time prescribed, or if after demand therefore made by the Tax Collector lie fails to file a corrected statement, the Tax Collector may determine the amount of license tax due from such person by means of such in- formation as he may be able to obtain. If such a determination is made, the Tax Collector shall give a notice of the amount so assessed by serving it personally or by depositing it in the United States Post Office at Baldwin Park, California, postage prepaid, addressed to the person. so assessed at his last known address. Such person may, within fifteen 15) days after the mailing or serving of such notice, make application in writing to the Tax Collector for a hearing on the amount of the license tax. If such application is made, tine Tax Collector shall cause the matter to be set for hearing within fifteen 15) days before the City Council. The Tax Collector shall give at least ten 10) dayst notice to such person of tine time and place of hearing in the manner prescribed above for serving notices of assessment. Tine Council shall consider all evidence produced, and shall make findings thereon, which shall be final. Notice of such findings shall be served upon the applicant in the manner prescribed above for serving notices of assessment. SECTION 6112. APPEAL. Any person aggrieved by any decision of the Tax Collector with respect to the issuance or refusal to issue such license may appeal to the Council by filing a notice of appeal with the clerk of the Council. The Council shall thereupon fix a time and place for hearing such appeal. The clerk of the Council shall give notice to such person of the time and place of hearing by serving it personally or by depositing it in the United States Post Office at Baldwin Park, California, postage prepaid, addressed to such person at his last known address. The Council shall have authority to determine all questions raised on such appeal. No such determination shall con- flict with any substantive provision of this ordinance. SECTION 6113. ADDITIONAL POUTER OF TA.. COLLECTOR. In addition to all other power conferred upon him, the Tax Collector shall. have the power, for good cause shown, to extend the tJ:me for filing any required sworn statement for a period not exceeding thirty 30) days, and in such case to waive any penalty that would other- wise have accrued; and shall have the further power, with the consent of the Council, to compromise any claim as to amount of license tax due. 6- ORD 071ê79wS ×Píè SECTION 6114. NC LICENSE TRANSFERABLE. AMENDED LICENSE FCR CHANGED LOCATION. No license issued pursuant to this Chapter shall be transferable; provided, that where a license is issued authorizing a person to transact and carry on a business at a particular place, such licensee may upon applica- tion therefor and paying a fee of $2.00 have the license amended to authorize the transacting and carrying on of such business under said license at some other location to which the business is or is to be moved. Alk SECTION 6115. UNEXPIRED LICENSES HERETOFORE ISSUED. Where a license for revenue purposes has been issued to any business by the City of Baldwin Park and the tax paid therefor under the provisions of any ordinance here- tofore enacted and the term of such license has not ex- pired, then the license: tax prescribed for said business by this Chapter shall not be payable until the expiration of the term of such unexpired license. SECTION 6116. DUPLICATE LICENSE. A duplicate license may be issued by the Tax Collector to replace any license previously issued here- under which has been lost or destroyed upon the licensee filing statement of such fact, and at the time of filing such statement paying to the Tax Collector a duplicate license fee of $2.00. SECTION 6117. POSTING A14D KEEPING LICENSES. All licenses must. be kept and posted in the following manner: 21(a) Any licensee transacting and carrying on business at a fixed place of business in the City of Baldwin Park shall keep the license posted in a consficu- ous place upon the premises where such business is carried on. b) Any licensee transacting and carrying on business but not operating at a fixed place of business in the City of Baldwin Park shall keep the license upon his person at all time.s while transacting and carrying on such business. SECTION 6118. LICENSE TAX HOW AND WHEN PAYABLE. Unless otherwise specifically provided, all annual license taxes, under the provisions of this Chapter, shall be due and payable in advance on the first day of January of each year; provided that license taxes covering new operations, commenced after the first day of January, may be prorated for the balance of the license period. 7- ORD 071ê79wS ×Píè Except as otherwise herein provided, license taxes, other than annual, required hereunder shall be due and payable as follows: a) Semi-annual license taxes, on the first day of January and the first day of July of each year; t(b) Quarterly license taxes, on the first day of January, April, July and October, of each year; c) Pv:onthly license taxes, on the first day of each and every mono:; 1(d) Jdeelcly flat-rate license taxes, on Ivionday of each week in advance; e) Daily flat-rate license taxes, each day in advance. 1 P17AIALTIF-S FOR FAILURE TO PAY TAX SECTIOi 6119. WHEN DUE. tFor failure to pay a license tax when due, the Tax Collector shall add a penalty of 10o of said license tax on the last day of each month after the due date thereof, providing that the amount of such penalty to be adued shall in no event exceed 50" of the amount of the license tax due. SECTION 6120. ADMINISTRATIVE RULES. The City Council of the City of Baldwin Park is hereby authorized to pass and adopt such resolutions as it may determine from time to time which enact administra- tive rules and regulations to effectuate the purposes of this Chapter. SECTION 6121. ENFORCEMENT. It shall be the duty of the Tax Collector, and he is hereby directed to enforce each and all of the provi- sions of this ordinance, and the Chief of Police shall render such assistance in the enforcement hereof as may from time to time be required by the Tax Collector or the City Council. The Tax Collector in the exercise of the duties imposed upon him hereunder, and acting through his deputies or duly authorized assistants, shall examine or cause to be examined all places of business in the City of Baldwin Park to ascertain whether the provisions of this ordinance have: been complied with. The Tax Collector and each and all of his assistants and any police officer shall have the power and authority to enter, free of charge, and at any reasonable time, any place of business required to be licensed herein, and n ORD 071ê79wS ×Píè demand an exhibition of its license certificate. Any person having such license certificate theretofore issued, in his possession or under his control, who wilfully fails to exhibit the same on demand, shall be guilty of a misdemeanor and subject to the penalties provided for by the provisions of this ordinance. It shall be the duty of the Tax Collector and each of his assistants to cause a complaint to be filed against any and all persons found to be violating any of said provisions. SECTION 6122. LICENSE TAI: A DEBT. The amount of any license tax and penalty imposed by the provisions of tizis ordinance shall be deemed a debt to the City of Baldwin Park. An action may be commenced in the name of said City in any court of competent jurisdiction, for the amount of any delin- quent license tax and penalties. SECTION 6123. REMEDIES CUTy.ULATIVE. All remedies prescribed hereunder shall be curpulative and the use of one or more remedies by the City of Baldwin Park shall not bar the use of any other remedy for the purpose of enforcing the provisions hereof. SECTION 612y_. PENALTY FOR VIOLATIOT4. Any person violating any of the provisions of this ordinance or knowingly or intentionally misrepresenting to any officer or employee of the City any material fact in procuring the license or permit herein provided for shall be deemed guilty of a misdemeanor, and upon con- viction thereof shall be punishable by a fine of not more than Five Hundred Dollars N500.00) or by imprison- ment in the City Jail for a period of not more than six months, or by both such fine and imprisonment. SECTION 6125. SEVE?,ADILITY. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. SECTION 613ATTORNEYS. For every attorney or person who conducts a law practice within the City of Baldwin Park, 124.00 per annum or fraction thereof. SECTION 6137. AUCTIONEERS. For every person who conducts auction sales at a fixed place of business or elsewhere, the sum of X100.00 per annual or fraction thereof. SECTION 6136. AUDITORS. For every auditor the sum of X24.00 per annum or fraction thereof. SECTIOIJ 61.3(. AU'rOIyiODIu ACCESSORIES. 1For every person engaged in the business of selling automobile accessories or automobile parts from a fixed place of business, the sum of $24.00 per annum or fraction thereof. For every person engaged in the business of selling or delivering automobile accessories or automo- bile parts where no regular established place of business is maintained in Baldwin Park, the sum of $4.8.00 per annum or fraction thereof. SECTION 6138. AUTO PAINTIi'1G. For every person conducting or carrying on the business of painting automobiles or trucks, $24.00 per annum or fraction thereof. SECTION 6139. AUTO REPAIR SHOP. For every automobile garage or repair shop or tire vulcanizing shop or battery shop, w24.00 per annum or fraction thereof. SECTION 6140. AddN I NGS AND TENTS. For every tent ant, awning shop or store, $24.00 per annum or fraction thereof. SECTION 6141. BAKERY. For every bakery or bake shop, 24_.00 per annum or fraction thereof. For every person conducting, managing or carrying on the business of cleaning carpets and rugs, the sum of N24.00 per annum or fraction thereof. S CTIOI4 6151. CL ANING AI~D DYE WORKS. For every cleaninc; and dye works where electricity, steam or water is used for the operation of machinery in connection therewith, the sum of 2i;_.00 per annum or fraction thereof; and $6.00 additional per wagon per quarter in excess of one wagon. SECTION 6152. COBELERS. For every cobbler shop, the sum of $12.00 per annum or fraction thereof. SECTIOi1 6153. COLLECTION AGENCY. For every collection agency, 24.00 per annum or fraction thereof. SECTION 615h_. COILZRCIAL BUSINESS. For every person conducting a commercial business, not otherwise herein specifically provided for, the sum of P2Li.00 per annum or fraction thereof, plus the surz of x:3.00 for each employee in excess of three in number. The number of employees shall mean the average monthly number of persons employed by said business during i,he preceding calendar year, anti shall be deter- mined by the following formula: one-twelfth of the total number of employees during the preceding year earning wages during any pay periods en-!ling nearest the 15th day of each calendar month. UThen a business has existed less than twelve months of ch~E, prior year, the actual number of months of existence shall be the com- puting fraction. If an employer has not previously engaged in business, he may estimate tine average number of employees who will be employed by him during the re- mainder of the calendar year. Provided, however, that where the stock in trade of the person conducting said commercial business shall be less than $500.00 and the license fee shall be $2;..00 per annum or fraction thereof. SECTIOivT 6155. CONTRACTORS, GENERAL, AND GENERAL E:TIGINEERING CONTRACTORS. tr(a) For every General Engineering Contractor or General Contractor, the sum of 48.00 per annum or frac- tion thereof. 13- ORD 071ê79wS ×Píè A general engineering contractor is a contractor whose principal contracting business is in connection with fixed works for any or all of the following pro- visions or subjects: irrigation, draining, water, power, water supply, flood control, inland waterways, harbors, railroads, higzway:;, tunnels, airports, air- ways, sewerage and bridges. A general buildinj contractor is a contractor whose principal contracting business is in connection with any structure or building being built or to be built for the support, shelter and enclosure of persons, animals, chattels, or movable property of any kind, requiring the use of more than two unrelated building Trades or crafts, or to do or superintend the whole or any part thereof. b) Specialty Contractors. For every specialty 1 contractor, the sum of 24.00 per annum or fraction hereof. SECTIa1'g 6156. DAIRY AM DAIRY PRODUCTS. For every person conducting a wholesale or retail dairy products business from a fixed place of business within the City of Daldwin Park, the following sums: 11(a) For a producer-distributor, tine sum of x;6.00 for the first vehicle par annum or fraction thereof, and 6.00 for each additional vehicle per annum or fraction thereof. b) For a person who is a producer only no retail operation), the sum of 12.00 per annum or fraction thereof. c) For a person who is a distributor only, the sum of 24.00 for the first vehicle per annum or frac- tion thereof, and 12.00 for each additional vehicle per annum or fraction thereof. For every person conducting a wholesale or retail dairy products business which shall have no fixed place of business within the City of Baldwin Park, the follow- inc sums: 11(a) For a producer-distributor, the sum of 36.00 for the first vehicle per annum or fraction thereof, and 12.00 for each additional vehicle per annum or fraction thereof. b) For a person who is a distributor only, the sur.,i of 36.00 for the first vehicle per annum or frac- tion thereof, and 12.00 for each additional vehicle per annuri or fraction thhereof. SECTIDiq 6157. DANCE HALLS. Every person conducting, operating or managing a public or private dance hall, tile sum of 75.00 per 14- ORD 071ê79wS ×Píèannum or fraction thereof; excluded from such licensing shall be dance halls which are conducted by non-profit corporations or fraternal organizations as incidental to a social gathering and which dances are not held at regular intervals. SECTION 6156. DOCTORS. SECTION 6167 GASOLINE DELIVERY TANKS. For every person conducting, managing or carrying on the business of delivering or selling benzine, dis- tillate, kerosene, gasoline or any or all other petroleum products by means of tank wagons, tank trucks or other vehicles in the City of' Baldwin Park, for each tank, wagon, truck or other vehicle, the sum of $24.00 per annum or fraction thereof. For every person conducting a health resort or private sanitarium of not more than 24 rooms in the City of Baldwin Park, the sum of I48.00 per annum or fraction thereof; and for each additional room or cottage more than the first 24, the sum of $1.00 per annum or frac- tion: trzereof.
