HomeMy WebLinkAboutORD 073ORD 073ê79wU ×Pî ORDINANCE NO. 73 AN ORDINANCE OF THE CITY OF BALDWIN PARK REQUIRING THE CONSTRUCTION OF CURBS,, GUTTERS AND S IDEVALKS IN CON- JUNCTION.WITH BUILDING CONSTRUCTION, AND ADDING SECTIONS TO THE MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLaVS SECTION 1: ADDING SECTIONS TO MUNICIPAL CODE. Part 1.9.1 is hereby added to Chapter I of Article VIII of the Baldwin Park Municipal Code, the sections of which shall read as follows: Part 1.9.1 Curb, Gutter and Sidewalk Regulations SECTION 8195. FINDINGS. The lack of sidewalks in the City of Baldwin Park in marry instances forces pedestrians, particularly school children, to walk in the street and be subject to the hazards of vehicular traffic, and the lack of said walks during rainy weather has been the indirect cause of sickness resulting from walking through mud or water along streets or dirt sidewalks. SECTION 819.1. SAME. The lack of curbs and gutters in the City of Baldwin Park makes for poor drainage, puddles of water, difficult street sweeping, and the accumulation of filth; and the lack of said curbs results in no proper place for garbage and rubbish receptacles, and subjects such containers to the hazards of vehicular traffic and unnecessary spillage of garbage and destruction of containers, and the lack of said curbs subjects children or pedestrians in the normal sidewalk area to accidental injury by vehicular traffic. SECTION 8195.2. PUBLIC INTEREST. The existence of dirt sidewalks and dirt curbs or gutters adjoining dwelling and buildings within the City of Baldwin Park, or conversely, the lack of adequate curbs, gutters and sidewalks, is hereby found and de- clared to be against the best interests of the public health and safety of the inhabitants of said City. SECTION 8195.3. CONSTRUCTION OF CURBS GUTTERS Any owner, lessee or agent constructing or arranging for the construction of a building or dwelling shall also construct or cause to be constructed cement curbs, gutters \, 1- ORD 073ê79wU ×Pîand sidewalks in accordance with City specifications, unless concrete curbs, gutters and sidewalks already exist along all street frontages adjoining the lot or lots on which the building or dwelling is to be con- structed; provided, however, that, in areas not sub- divided or parceled into one-half acre or smaller lots, curbs and sidewalks need not be installed for a greater distance than the minimum lot width required by the Zoning Regulations of this Code for the zone in which said areasis located. For corner parcels in such un- subdivided areas, the side frontage shall be determined by the minimum area requirements. 1SECTioN 8195.4. DENIAL OF CERTIFICATE OF OCCUPANCY. The Building Inspector of the City shall deny final public utility connections to any building or dwelling and the certificate of occupancy until said concrete curbs, gutters and sidewalks exist or are constructed or their construction is guaranteed to the satisfaction of the City Council. SECTION 8195.5. VARIANCE. Upon written application made to the City Council, the City Council may waive by resolution or minute action the effect of this Chapter upon the applicant, when the City Council finds that any of the following conditions exist. The decision of the Council to approve, condi- tionally.approve or deny the application shall be final. The said conditions are as follows; a) The City Council determines that, because of the location of the property, the terrain or condition of the property, or other similar reasons, the construction of the curbs, gutters and sidewalks would be impractical or unnecessary. b) The City Council determines that, because of lack of adequate data in regard to grades, plans or surveys, the construction of the curbs, gutters and sidewalks should be waived. c) The City Council determines that the construction of curbs, gutters and side- walks is included in a budgeted Cit~ project or an approved Assessment District. 2- ORD 073ê79wU ×Pî oRD.
