Parts 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 13, 14, 15, 16, 17, 18 and 19 of Chapter 1 of Article 3 of the Baldwin Park Municipal Code are being repealed. SECTION 2: Adding Sections to Municipal Code. Part 1 is being added to Chapter 1 of Article 3 of the Baldwin Park Municipal Code, the Sections of which shall read as follows: PART 1. FIRE PREVENTION CODE SECTION 3100: This Part shall be known as the Fire Pre- vention Code of the City of Baldwin Park and may be cited as such. SECTION 00,2,1: There is hereby adopted as the Fire Prevention Code of th e City of Baldwin Park, except as it is hereinafter noted, this Part 1 of Chapter 1 of Article 3 of the Baldwin Park Municipal Code, which adopts by reference Ordinance No. 7274 of the County of Los Angeles entitled An ordinance amending Ordinance No. 2947, the Fire Prevention Code, and adopting by reference, as a part thereof pursuant to Sec- tion 50022.2 of the Fovernment Code, the foliowing primary codes: The following Specifications of the American Petroleum Institute: API Standard No. 12A, September, 1951, Specification for Oil Storage Tanks with Riveted Shells. Wherever in said Ordinance No. 7274 of the County of Los Angeles reference is made to the County of Los Angeles it shall mean and be deemed to be the said City of Bald- win Park and wherever in said Ordinance No. 7274 reference is made to the Board of Supervisors of the County of Los Angeles it shall be deemed amended by referring to the City Council of the City of Baldwin Park. Wherever in said Ordinance No. 7274 refer- ence is made to a County Official of the County of Los Angeles said Ordinance sha,.l be deemed amended by stating the annlicabie City Official of the City of Baldwin Park. SECTION 3100 4: Notwithstanding any other provisions of said Ordinance No. 274 of the County of Los Angeles Article 12 of said Ordinance entitled Fireworks" is eliminated from said Ordinance No. 7274 and said Article 12 is not adopted by the City of Baldwin Park. The provisions of Part 12 of Chapter 1 of Article 3 of this Code which has been heretofore adopted shall constitute the regulations governing fireworks in the City of Baldwin Park. SECTION 100.5: That any person, firm, association cr corporation violating any of the provisions of this Ordinance or of b he Fire Prevention Code of the City of Baldwin Park hereby adopted; or of the 1)orti ons of said Ordinance 1do. 7274 of the County of Los Angeles, California, adopted hereby; or of any amendment or amendments w]~~ich may herea ter be adopted to said Fire Prevention Code of the City of Baldwin Park or of this Ordinance by the City Council of said City, shall be guilty of a misdemeanor and upon conviction of any such viola- tion such person firm association or corporation shall be punishable by a dine o~' not more than 0x500.00 or by imprison- ment in the City Jail of the City of Baldwin Park, California, or in the County Jail of Los Angeles County, California, as the committing ma7istrate may direct, for a period of not more than six 6) months, or by both such fine and imprisonment in the discretion of the Court. Any such person, firm, association or corporation shall be deemed guilty of a separate offense for each and every day during which, or during any portion of which, such violation continues and shall be punishable therefor as herein provided. ORD 086ê79wV ×Pæ¼ This Ordinance, if adopted will adopt by reference, the Fire Prevention Code of the County of Los Angeles. The Ordinance, if adopted, will regulate the extinguish- ment of fires, and will pertain to the preventing, eliminating or minimizing the fire hazard for the safety of life and proper- ty within the City of Baldwin Park. The purpose of the Fire Prevention Code and the primary codes adopted by reference therein is to prescribe regulations consistent with nationally recognized good practice for the safeguarding to a reasonable degree of life and property from the hazards of fire and explosion arising from the storage, handling, and use of hazardous substances, materials, and de- vices and from conditions hazardous to life or property in the use or occupancy of buildings or premises. Three copies of each of the primary codes described in this notice are in the office of the City Clerk of the City of Baldwin Park, and may be inspected in said office by any person at any time between the hours of 8:3o A.M., and P.M., on any day except Saturdays, Sundays a olidays.
