HomeMy WebLinkAboutORD 092ORD 092ê79wV ×PæÙ a+ ORDINANCE NO. 92 Y~~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWI N PARK AMEND- ING SECTIONS 4196 AND 4196.3 OF W THE BALDWIN PARK MUNICIPAL CODE AND ADDING SECTIONS 4124, 4140.1, 4140.2, 4176.1, 4176.2 and 4176.3 THERETO TO STRENGTHEN THE CITY#S RABIES REGULATIONS The City Council of the City of Baldwin Park does ordain as follows: Section 1. That the Baldwin Park Municipal Code is amended by adding six new sections thereto, numbered 4124,'4140.1, 4140.2, 4176.1, 4176.2 and 4176.3, to read as follows: 4124. It shall be the duty of the Poundmaster, or any police officer of the City, to immediately notify the County Health Officer concerning the location and description of any dog or other animal infected, or believed to be infected, with rabies, or which is known to such officer, or believed by him, to have been exposed thereto. Upon receipt of such information, said Health Officer, if he finds said animal to be infected with rabies, or exposed thereto, shall cause such dog or animal to be isolated, quarantined for examination or observation for such period of time as he may deem necessary, and then to be destroyed or disposed of as deemed advisable by him. 4140.1 Every person applying for a dog license under this chapter shall exhibit a certificate Issued by a person duly licensed by the State of California or other state or nation to practice veterinary medicine, which certificate shall show that the dog for which the license is to be issued either 11 has been vaccinated with rabies vaccine in accordance with the provisions of this chapter, or 21 should not be vaccinated with rabies vaccine by reason of infirmity. If it is claimed that the dog is exempt by reason of infirmity, the certificate shall show to the satisfaction of the person issuing the license that the infirmity still exists. Certificates of exemption shall not exceed a period of ninety 90) days from the date of issuance. No license shall be issued without the receipt of a certificate as herein required, except that kennel licenses may be issued without such certificate. However, no dog may be sold or removed from a kennel without I F ORD 092ê79wV ×PæÙa certificate of rabies vaccination or exemption from rabies vaccination being furnished to the Poundmaster unless the dog was received from and is returned to a non-resident or is forthwith removed from the City. 4140.2 At the time the dog license is issued, the date of the rabies vaccination and the type of vaccine used shall be written thereon. 4176.1 No dog impounded under the provisions of this chapter shall be released to any person except where there has been a performance of the following conditions: a) There has been presented to the Poundmaster a current license for such dog issued by the City, or if the person keeping, harboring or having such dog is not a resident of the City, such non-resident person has presented to said Poundmaster a current license or registration for such dog issued by any other municipality in the County or by the County; b) Where the person keeping, harboring, or having such dog is a resident of the City, there has been paid to the City the fee for a City dog license as provided by law; c) There has been paid to the Poundmaster the im- pounding, collection and other fees due against such dog; d) There has been paid to the Poundmaster a reasonable fee, not to exceed Five Dollars $5.00), for the rabies vaccination of such dog, or in lieu thereof there has been presented to him a certificate of rabies vaccination or exemption from rabies vaccination showing to his satisfaction that such dog has been vaccinated with rabies vaccine within the time periods and according to the other require- ments of Section 4196 of this chapter, or is exempt from complying therewith according to the provisions thereof; and 2 ORD 092ê79wV ×PæÙ e) The Poundmaster has determined that such dog does not have and is not reasonably suspected of having rabies. 4176.2 Within seventy-two 72) hours after receiving a fee for rabies vaccination as provided in Section 4176.1 d), or as soon thereafter as possible, the Poundmaster shall cause the dog for whom the fee has been paid to be vaccinated with rabies vaccine by a person duly licensed by the State to practice veterinary medicine. 4176.3 If the Poundmaster suspects that any impounded dog has rabies, he shall hold such dog for inspection by the County Health Officer and shall proceed as provided in Section 4124 of this chapter. If he has received a fee for the rabies vaccination of such dog, he shall withhold inoculation until the dog has been inspected and found to be free from rabies. If the dog is found to have rabies and is destroyed or disposed of, the fee shall be refunded to the person paying the same. Section 2. That Section 4196 of said Municipal Code is amended as follows: a) By amending the opening paragraph thereof to read as follows: Every person keeping, harboring or having a dog over the age of four 4) months shall cause such dog to be vaccintated with rabies vaccine by a person licensed to practice veterinary medicine by the State of California, or any other state or nation, on or before the latest of the following dates: b) By adding the following closing paragraph thereto: Providing, however, that this section shall not apply to any dog exempt from licensing under the provisions of this chapter or for which an unexpired certificate issued by a person licensed by the State, or other state or nation, to practice veterinary medicine, stating that such dog should not be vaccinated with rabies vaccine by reason of infirmity, is presented to the Poundmaster as provided in this Chapter. Section 3. That Section 4196.3 of said Municipal Code is amended by adding subsection e) thereto, to read as follows: e) Such other information as the Poundmaster may require. 3 ORD 092ê79wV ×PæÙ Section 4. That Section 4140 of said Municipal Code is repealed. Section 5. The City Clerk shall certify to the adoption of this ordinance and cause the same to be published or posted in the manner required by law. This ordinance shall take effect thirty days after its adoption. PASSED AND ADOPTED this 1st day of December_, 1958.
