ORDINANCE NO. 96 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTION 3203 OF THE BALDWIN PARK MUNICIPAL CODE TO REQUIRE PERSONS CONVICTED OF FELONIES TO REGISTER ALTHOUGH ON PAROLE OR PROBATION. The City Council of the City of Baldwin Park does ordain as follows: Section 1. Section 3203 of the Baldwin Park Municipal Code is amended to read as follows: 3203. Persons Exempted, The provisions of this Code relating to the registering of felons shall not apply to any person who has received a full pardon for each crime whereof he shall have been convicted. Section 2. The City Clerk shall certify to the adoption of this ordinance and cause the same to be published or posted in the manner required by law. ORDINANCE NO. 97 1 AN ORDINANCE OF THE CITY OF BALDWIN PARK AMENDING THE LICENSE FEES IN THE BALDWIN ne PARK MUNICIPAL CODE. THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: Section, 1. Section 61.00 of the Baldwin Park Municipal Code is amended to reza as follows: 6100. DEFINITIONS. a) Business. As used in this chapter, business", includes professions, trades, and occupations and all and every kind of calling whether or not carried on for profit. b) En. 1p oyee' As used in this chapter, employee" shall mean all persons engaaeed in the operation or conduct of any business, whether as owner, any menber of the owner's family, partner, agent, manager, solicitor and any and all other persons employed or working in said busi- ness. c) Tax Collector. As used in this Chapter, tax collector" shall mean the officer appointed by the City Council from time to time by ordinance or resolution to carry out the duties and to have the authority of the tax collector as set forth in this chapter. d) Wheeled Vehicle. As used in this chapter„ wheeled vehicle" shall mean and include automobile, truck, tank truck, trailer, wagon, cart and any and all other contrivances used or capable of being used as a means of transportation of persons or property that move or roll on one or more wheels. Section 2. Section 6104 of said Municipal Code is amended by changing the th rd paragraph thereof to read as follows: Persons not required to obtain a license prior to doing business within the city because of conflict with applicable statutes of The United States or of the State of California shall not be liable for pay- ment of the tax imposed by this Chapter. Section 3. Sections 6105, 6108, 6109, 6118, 6128, 6130, 6131, 6132, 6135`,_6177_,Z138, 6139, 6140, 6141, 6142, 6143, 6144, 6145, 6146, 6147, 6150, 6151, 6152, 6154, 6155, 6156, 6157, 6158, 6159, 6161, 6162, 6163, 6164, 6165, 6166, 6167, 6168, 6169, 6170, 6172, 6173, 6174, 6175, 6176, 6177, 6178, 6179, 6180, 6161, 6182, 6183, 61811, 6186 and 6187 of said Municipal Code are amended to read as follows: 6105. BRANCH ESTABLISHMENTS. A separate license must be obtained for each branch establishment, provided that warehouses and distributing plants used in connection with and incidental to a business licensed under the provisions of this Chapter shall not be deemed to be a branch establishment. 6108. APPLICATION FOR FIRST LICENSE. Upon a person making appli- cation for the first license to be issued hereunder or for a newly establish- ed business, such person shall furnish to the Tax Collector for his guidance in ascertaining the amount of license tax to be paid by the applicant, a written statement, upon a form provided by the Tax Collector, setting forth such information as may be therein required and as may be necessary y ORD 096ê79wV ×Pç! to determine the amount of the license tax to be paid by the applicant. The tax collector shall not issue to any such person another license for the same or any other business, until such a person shall have furnished to him the written statement and paid the license tax as herein required. 6109. APPLICATION FOR RENEWAL OF LICENSE. In all cases, the applicant for the renewal o a license shall submit to the Tax Collector for his guidance in ascertaining the amount of the license tax to be paid by the applicant, a written statement, upon a form to be provided by the Tax Collector, setting forth such information concerning the applicant's business during the preceding year as may be required by the said Tax Collector to enable him to ascertain the amount of the license tax to be paid by said applicant pursuant to the provisions of this Chapter.. 6118. LICENSE TAX HOW AND WHEN PAYABLE. Unless otherwise specifically provide, a annual icense taxes, under the provisions of this Chapter, shall be due and payable in advance on the first day of January o£ each year; provided that license taxes covering new opera- tions, commenced after the first day of January, may be prorated for the balance of the license period, except that licenses of $1.00 per year shall not be prorated and all other licenses shall be prorated on a quarterly basis as follows: When the license is applied for during the first quarter of the calendar year a license fee for the entire yearly amount shall be due; when the license is applied for in the second quarter of the calendar year a license fee equal to three-fourths of the annual fee shall be due; when the license is applied for in the third quarter of the calendar year a license fee equal to one-half of the annual fee shall be due; and when the license is applied for during the fourth quarter then an amount equal to one-fourth of the annual fee shall be due. All licenses shall be payable in.advance in lawful money of the United States at the Office of the Tax Collector of the City of Baldwin Park. Except as of herwise herein provided, license taxes, other than annual, required hereunder shall be du e and payable as follows: a) Semi-annual license taxes,on the first day of January and the first day of July each year; b) Quarterly license taxes, on the first day of January, April, July and October, of each year; c) Monthly license taxes, on the first day of each and every month; d) Weekly flat-rate license taxes, on Monday of each week in advance; 4 e) Daily flat-rate license taxes, each day in advance. 6128. ADVERTISING. Every person maintaining a billboard or bulletioard or conducting or managing the business of advertising by means of billboards, shall pay a license for the privilege of so doing as follows: $48.00 per annum. 6130. ADVERTISING SOLICITORS. For every person engaged in soliciting advertising w ere no regu arly established place of business is maintained in Baldwin Park, the sum of $50.00 per annum, and for every such person who has a regularly established place of business in the City of Baldwin Park, the sum of $3.00 per quarter. 2 ORD 096ê79wV ×Pç! 6131. AMUSEMENTS AND AMUSEMENT DEVICES. a) Carnival. For every carnival the sum of $50.00 per day. b) Circus. For each exhibition the sum of $50.00 and an additional fee o.f~-00 for every side show; provided, however, that the maximum license for such side shows shall be $100.00 per day. c) Games and Vending Machines. For every person carrying on the business of renting, leasing; or maintaining any juke box game machine, weighing machine or vending machine, or any other similar machine or device, whereby a sum is charged by means of a coin, slot, or otherwise, except as provided herein, the sum of $24.00 per annum or fraction thereof. A person owning and operating his own business at a fixed place of business within the City of Baldwin Park, who is also the bona fide owner of the weighing or vending machine,.shall not be required to secure a vending machine operator's license. Provided, however, that each owner of a vending machine or weighing machine shall secure a license for each machine, as follows: 1. Juke Boxes. Coin operated devices used for the disbursement of music, the sumo 2.00 per machine per annum, whether the same is owned by the owner of the place of business whereat the device is located, or is independently owned by a vending machine operator. 2. Game Machines. Any game machine or device not prohibited by law, where any sum is charged by means of a coin, slot or otherwise, and the licensing for which is not herein otherwise provided for, the sum of $48.00 per annum for each such machine. 3. Games Miscellaneous). Every person conducting, operating or managing an amusement game, tes of skill, strength physical endurance or capacity of any kind whatever, not otherwise herein provided for, and for participation in which a fee is charged or which is conducted for profit, the license fee shall be $48.00 per annum. Provided,whenever, any such amusement game, test or skill, strength, physical endurance or capacity of any kind whatsoever is conducted with or at the same time as any other carnival attraction or show is conducted, the license fee shall be in that event the sum of $10.00 per day for each amusement, game, or test of skill, strength, physical endurance or capacity of any kind. 4. Weighing Machines. Coin operated devices used for the pur- pose of weighing, the sumo 00 per machine per annum whether the same is owned by the owner of the place of business whereat the device is located or is independently owned by a vending machine operator. 5. Vending Machines Vending machines requiring $.11 or less to activate the mechanism, and soft drink vending machines,the sum of $1.00 per machine per annum whether the same is owned by the owner of the place of business whereat the device is located or is independently owned. 6. For every kind of coin vending machine not specified in this Code, the sum of $6.00 per annum, whether the same is owned by the owner of a place of business or is independently owned. All games and vending machines licensed under the above provisions shall have affixed thereto a numbered decal which is to be furnished by the Tax Collector. 3- ORD 096ê79wV ×Pç! 6132. ART AND CURIO STORES AND GIFT SHOPS. For every art and curio store and gift sop, 0per annum. 6135. AUCTIONEERS. For every person who conducts one or more auction sales at a fixed place of business or elsewhere, the sum of $100.00 per annum, and this license shall not be prorated. 6137. AUTOMOBILE ACCESSORIES. For every person engaged in the business of selling automoH le accessories or automobile parts from a fixed place of business, the sum of $24.00 per annum. For every person engaged in the business of selling or delivering automobile accessories or automobile parts where no regular established place of business is maintained in Baldwin Park, the sum of $48.00 per annum. 6138. AUTO PAINTING. For every person conducting or'carrying on the business of painting automobiles or trucks, $24.00 per annum. 6139. AUTO REPAIR SHOP. For every automobile garage or repair shop or tire vulcanizing shop or attery shop, $24.00 per annum. 6140. AWNINGS AND TENTS. For every tent and awning shop or store, $24.00 per annum. 6141 BAKERIES. For every bakery or bake shop, $24.00 per annum. For every person not having a fixed place of business in the City of Baldwin Park selling bread, bakery goods or other bake stuffs at retail in said City from a wagon or vehicle, $48.00 per year for each wagon or other vehicle. 6142. BARBER SHOPS. For every barber shop, the sum of $18.00 per annum, and $3.0 per employee over three. 6143. BEAUTY PARLORS. For every beauty parlor the sum of $18.00 per annum, and $3.00 per employee over three. 6144. BILLIARDS AND POOL HALLS. For every person carrying on the business of a pool a or i lard paII"lor, the sum of $24.00 per annum for the first pool or billiard table, plus $10.00 per annum for each additional pool or billiard table, and such license shall include the right to sell tobacco, confections, soft drinks and lunches. 6145. BROKER, REAL ESTATE For each office engaged in a real estate broker business, the sumo 24.00 per annum. If any office contains more than one real estate broker who are not in the same firm, partnership or association, but who are working independently of each other, then each real estate broker shall pay a fee of $24.00 per annum; otherwise, the office shall be required to obtain only one license. 6146. BUSINESS AND PROFESSIONS ENUMERATED. Conducting, managing, carrying on or engaging in any business, profession or occupation hereinafter enumerated, the annual license tax shall be based upon the average number of professional members and the average number of employees, computed as follows: for the first member of the firm practicing his profession, other than as a salaried employee, $24.00 per annum, plus the sum of $5.00 per annum for each additional practicing member of the firm, plus $4.00 per annum for each of the first four employees in excess of one, plus $2.00 per annum for each employee in excess of five: 4- ORD 096ê79wV ×Pç!Accountant Landscape Gardener or Architect Appraiser Lapidary Architect Lithographer Artist Masseuse Assayer Midwife Attorney at Law Mercantile Agency Auditor Money Lender or Broker Bacteriologist Mortician Blue Printer N aturopath Book Agent Occulist Broker or Commission Agent Optician Chemist Optometrist Certified Public Accountant Osteopath Chiropodist Photographer Chiropractor Physician Civil, Electrical, Mining, Chemical Physiotherapist Structural, Consulting or Piano Tuner Hydraulic Engineer Public Stenographer Collection Agency Roentgenologist Credit Reporting Bureau Sign Painter Dentist Surgeon Designer, Illustrator or Decorator Surveyor Detective Agency Taxidermist Draftsman Termite Inspector Drugless Practitioner Upholsterer Electrologist Veterinarian Engraver Entomologist Feed, Grain and Fruit Broker Geologist Illustrator or show card writer Insurance or Claims Adjuster Interpreter And every person carrying on or engaged in the business of treating, curing administering to or giving treatments to the sick, wounded or infirm for the purpose of bringing about their recovery, by any method or pursuant to any belief, doctrine or system other than those hereinabove specifically named, and charging a fee or compensation therefor. 6147. CABINET SHOP. For every cabinet or carpentry shop, $24.00 per annum. 6150. CLEANERS CARPETS AND RUGS. For every person conducting, managing or carrying on the business o cleaning carpets and rugs, the sum of $24.00 per annum. 6151. CLEANING AND DYE WORKS. For every cleaning and dye works where electricity, seam or water is used for the operation of machinery in connection therewith, the sum of $24.00 per annum, and $6.00 additional per wagon per quarter in excess of one wagon. 6152. COBBLERS. For every cobbler shop the sum of $12.00 per annum. 6154. COMMERCIAL BUSINESS. For every person conducting a commercial business, no, o erwise erein specifically provided for, the sum of $24.00 per annum, plus the sum of $3.00 for each employee in ex- cess of three in number. The number of employees shall mean the average monthly number of persons employed by said business during the preceding calendar year, and 5- ORD 096ê79wV ×Pç! shall be determined by the following formula: one-twelfth of the total number of employees during the preceding year earning wages during any pay periods ending nearest the 15th day of each calendar month. When a business has existed less than twelve months of the prior year, the actual number of months of existence shall be the computing fraction. If an employer has not previously engaged in business, he may estimate the average number of employees who will be employed by him during the remainder of the calendar year. Provided, however, that where the stock in trade of the person conducting said commercial business shall be less than $500.00 and the license fee shall be $24.00 per annum. 6155. CONTRACTORS,GENERAL AND GENERAL ENGINEERING CONTRACTORS. a) For every General. Engineering Contractor or General Contractor, the sum of $48.00 per annum. A general engineering contractor is a contractor whose principal contracting business is in connection with fixed works for any or all of the following provisions or subjects: Irrigation, draining, water, power, water supply, flood control, inland waterways, harbors, railroads, highways, tunnels, airports, airways, sewerage and bridges. A general.building contractor is a contractor whose principal contracting business7in connection with any structure or building being built or to be built for the support, shelter and enclosure of persons, animals, chattels, or movable property of any kind, requiring the use of more than two unrelated building trades or crafts, or to do or superin- tend the whole or any part thereof. b) Specialty Contractors. For every specialty contractor, the sum of $24.00 per annum. 6156. DAIRY AND DAIRY PRODUCTS. For every person conducting a wholesale or retail dairy products business from a fixed place of business within the City of Baldwin Park, the following sums: a) For a produce-distributor, the sum of $34.00 for the first vehicle per annum and $6.00 for each additional vehicle per annum. b) For a person who is a producer only no retail operation, the sum of $12.00 per annum. c) For a person who is distributor only, the sum of $24.00 for the first vehicle per annum or fraction thereof, and $12.00 for each additional vehicle per annum. For every person conducting a wholesale or retail dairy products business which shall have no fixed place of business within the City of Baldwin Park, the following sums: a) For a producer-distributor, the sum of $36.00 for the first vehicle per annum or fraction thereof, and $12.00 for each additional vehicle per annum. b) For a person who is a distributor only, the sum of $36.00 for the first vehicle per annum or fraction thereof, and $12.00 for each additional vehicle per annum. 6157. DANCE HALLS. Every person conducting, operating or managing a public or private dance hall, the sum of $75.00 per annum; excluded from such licensing shall be dance halls which are conducted by non-profit corporations or fraternal organizations as incidental to a social gathering and which dances are not held at regular intervals. 6- ORD 096ê79wV ×Pç!  Now 6158. DOG KENNELS. The sum of $36.00 per annum. 6159. ELECTRICAL FIXTURES AND SUPPLIES. For every person engaged in the business o selling electrical fixtures and supplies, the sum of $24.00 per annum. 6161. FILLING STATIONS, SEE COMMERCIAL BUSINESS. 6162. FISH AND POULTRY MARKET. For every fish and poultry market, $24.00 per annum. 6163. FRUIT PACKING HOUSE. For every fruit packing house, whether packing fruit belonging en ire y to the owners thereof or for the account of other persons, $24.00 per annum. 6164. FRUIT AND VEGETABLE WAGON. For every person conducting or carrying on theBus ess o selling fruit, berries,melons7 or vegetables on the public streets or from wagons or other vehicles, the sum of $200.00 per annum. 6165. FRUIT AND VEGETABLE STORE. For every fruit and vegetable store $24.00 per annum, which shall include fruit and vegetable stands or stores conducted solely as a department of a market or store by some person other than the owner or proprietor of such other business. 6166. GARBAGE 4ND RUBBISH COLLECTORS. See Section 6701.3 of Municipal Code. 6167. GASOLINE DELIVERY TANKS. For every person conducting, managing or carrying on he usiness o delivering or selling benzine, dis- tillate, kerosene, gasoline or any or all other petroleum products by means of tank wagons, tank trucks or other vehicles in the City of Baldwin Park, for each tank wagon, truck or other vehicle, the sum of $24.00 per annum. 6168. HEALTH RESORT. For every person conducting a health resort or private sanitarium of no~ more than 24 rooms in the City of Baldwin Park, the sum of $48.00 per annum or fraction thereof; and for each additional room or cottage more than the first 24, the sum of $1.00 per annum. 6169. HOUSE MOVER. For every person engaged in the business of house moving, the sumo x..00 per annum; in addition thereto, he shall comply with all the provisions of the Code of the City of Baldwin Park. 6170. ICE MANUFACTURING AND DISTRIBUTING. For every manufacturer of ice, $24.00 per annum. or every distributor or vendor of ice $12.00 per annum, plus $8.00 additional per wagon per annum for every wagon over one. 6172. INVESTMENTS AND LOANS. For every investment company, loan company or similar business no exempt from City License by any national or state law, $24.00 per annum, plus an additional sum of $3.00 per annum for each employee in excess of three 3) in number. 6173. JOB PRINTING. SEE COMMERCIAL BUSINESS. 6174. JUNK DEALER. SEE COMMERCIAL BUSINESS. 6175. MARKETS SEE COMMERCIAL BUSINESS. 7- ORD 096ê79wV ×Pç!  6176. MOTELS. For the business of conducting a Motel rentals wherein the majority f occupants are transient in nature) and wherein rooms are rented by the day, week or month, the sum of $24.00 per annum wnere the said motel has six units or less; for each additional unit of more than six units, the sum of $2.00 per unit per annum. 6177, NEWSPAPERS. a) For every daily newspaper published in the City of Baldwin Park, $40.00 per year. b) For every weekly newspaper published in the City of Baldwin Park, $24.00 per annum. 6178. RESTAURANTS. For every person engaged in the restaurant business for profit-including that of a cafe, ice cream parlor and place of business selling food or beverages at retail for human consump- tion upon the premises where such food is sold, shall pay a license fee based upon the following schedule: a) For those restaurants having a seating capacity and/or accommodation for 24 persons or less, the sum of $24.00 per annum. b) For those restaurants having.a seating capacity and/or accom- modation for more than 24 persons and less than 100 persons, the sum of $24.00 per annum, plus $.60 for each such seating capacity and/or accom- modation over 24. c) For those restaurants having a seating capacity and/or accommodation of more than 100, the sum of $62.00 per annum, plus $.25 for each such seating capacity and/or accommodation over 100. 6175. SIGNS. For every person engaged in the business of install- ing display signs, the sum of $24.00 per annum, plus an employee tax as computed under Commercial Business. 6180. SOLICITORS. For every solicitor or employee not having a fixed place of business in the City, who travels from place to place, or house to house, and makes demonstrations of, or solicits, takes orders or canvasses for the sale of, or who sells- any goods wares, merchandise, subscriptions to periodicals or magazines, or things or articles of value of any nature, kind or description, shall pay $48.00 per annum or $5.00 per day; provided, however, persons residing/ the City of Baldwin Park shall pay $24.00 per annum. Every person or employee who is to solicit in the City of Baldwin Park shall be required to furnish his fingerprints and thumb prints, and shall file an affidavit with the Tax Collector; such affidavit shall contain the following information: l. Name, address and telephone number of the applicant. 2. Name and address of the person by whom employed, if any. 3. Length of service of such applicant with such employer. 4. Place of residence, and nature of employment of the applicant during the period of at least the year just preceding. 5. Nature of the goods and service to be offered by the applicant. 6. Drivers License number and License number of applicant's automobile. 7. Citizenship status of applicant. 8. Personal description of the applicant, and a statement that he has not been convicted of a felony. After the affidavit has been filed, the Tax Collector shall 8- ORD 096ê79wV ×Pç!  refer the same to the Police Department for investigation, the Police Department shall investigate the applicant and the statements in said affidavit. If, upon such investigation, it is found that the statements set forth in said affidavit are true, license may be issued, and if, on the other hand, they are found to be untrue in any material manner, application for license may be denied. In the event the Tax Collector shall refuse to issue a license to applicant, such applicant may appeal from the decision of the Tax Collector to the City Council of the City of Baldwin Park by filin written notice of said appeal in the office of the City Clerk Wdays after notification by the Tax Collector that his application for license has been denied. 6181. TRAILER COURTS. Every person engaged in the business of maintaining and operating or profit a Court for house trailers or mobile homes shall pay the sum of $24.00 per annum where the trailer court has six units or less; for each additional unit of more than six units the sum of $2.00 per unit per annum. Such license fee of $2.00 per annum for each additional trailer space, shall be payable concurrently with pay- ment of the principal fee of $24..00, and shall be paid regardless of use or occupancy of said space. 6182. TRANSFER. For every person engaged in the transfer business, operating one ruck, wagon or vehicle, the sum of $24.00 per annum, and for each additional truck, wagon or vehicle more than one within the City at any one time during the year, the additional sum of $6.00 per annum for each such additional truck, wagon or vehicle. 6183. UNLISTED. For every person carrying on any business, trade, profession or occupation not herein specifically provided for, the sum of $24.00 per annum, and for each employee employed in said business in excess of three in number, the sum of $3.00 per annum. USED CAR DEALERS. Every used car dealer shall pay a license fee of $50.00 per annum. 6186. WHOLESALE. For every person engaged in the business of selling merchandise at who esale from a fixed place of business in the City of Baldwin Park, the sum of $24.00 per annum, and $6.00 for each addition- al employee or partner in excess of one. 6187. WHOLESALE DELIVERY TRUCKS. For every person conducting, managing or carrying on the business o de ivering wholesale orders of goods, wares or merchandise in the City of Baldwin Park, the sum of $24.00 for the first vehicle per annum, and $6.00 for each additional vehicle per annum. License non-transferable from one vehicle to another, except upon sale or disposal in which event license may be transferred upon issuance of an amended license for the stun of $2.00. 9 ORD 096ê79wV ×Pç! Designate the fourth and fifth paragraphs of subsection a) as subsections d)'and e) respectively. 3. Amend subsection b) to read as follows: b) Charitable and Non-profit Organizations. The provisions of this Chapter shall no e deeme or construed to require the payment of a license tax to conduct, manage or carry on any business, occupation, or activity from any local, institution or organization which is conducted, managed or carried on wholly for. the benefit of charitable purposes or from which profit is not derived, either directly or indirectly by any individual; nor shall any license tax be required for conducting of any entertainment, concert, exhibition, or lecture on scientific, historical, literary, religious, or moral subjects within the City whenever the receipts of any such entertainment, concert, exhibition, or lecture are to be appropriated to any church or school or to any religious or benevolent and/or charitable purpose in the City of Baldwin Park; nor shall any license tax be required for the conducting of any entertainment, dance, concert, exhibition, or lecture by any religious, charitable, fraternal, educational, military, state, county, or municipal organization or association whenever the receipts of any such entertainment, dance, concert, exhibition, or lecture are to be: appropriated to any church, school or to any religious or benevolent and/or charitable purpose within the City of Baldwin Park; provided, however, that nothing in this Section shall be deemed to exempt any such organization or association from complying with any provisions of this Code requiring a permit from the City Council or any commission or officer to conduct:, manage or carry on any profession, trade, calling or occupation. Any person desiring an exempt license as provided in this section shall make application for an Exempt Business License" through the Tax Collector. Such applications shall be written upon a form provided by the Tax Collector and a copy of the application as completed by the applicant shall be posted at the Chamber of Commerce Building. The application shall contain the name of the person or organization or a brief description of the class of persons for whose benefit the activity or solicitation is being made, together with the address and telephone number of such person or organization and, if an organization, the names and addresses of its officers); the name of the person or persons who are to solicit; the total amount to be realized; the estimated total amount to be expended as compensation therefor, and the total amount in- tended to be raised or realized in the activity, drive or campaign and the purpose for which the money or property derived from such activity is to be used, which statement shall be signed by either the person apply- ing therefor, the chief officer of the organization, for whom the activity is conducted, or if the activity is to be for an unorganized class of persons, verification shall be made by the person in charge of such activity. This provision may be waived by the City Council upon good cause therefor being shown. Before issuing an"Exempt Business License", the Tax Collector may make inquiry of the applicant, or any other person, concerning the plan of conducting the activity, the disposition of the proceeds thereof, and the matters set forth in the application herein required, and, if upon such inquiry and/or from said application, he has reason to believe 11 ORD 096ê79wV ×Pç! that the method of conducting such activity and/or the disposition of the proceeds does not qualify them as a local charitable or non-profit organiz- ation as required under this section, he shall refuse to issue an exempt license. Any"Exempt Business License" may be revoked or suspended by the City Council for any fraud or misrepresentation committed by the licensee or his agents in and about the activity and, i£ in the judg- ment of the Council, any act committed or practice pursued in the activity or the disposition of the proceeds is unjust, unfair or in- equitable. Any charitable or non-profit organization which does not qualify for an exempt license may purchase a special permit for the sum of $24.00 for each separate activity or charity solicitation. In the event the Tax Collector does not grant an exempt license to any person or organization, they shall have a right to appeal the de- cision to the City Council. The decision of the City Council shall be final. Either a special permit or an exempt business license shall be required only of the person in charge of the organization applying therefor, but it shall be unlawful for any person to carry on any activity or solicit as an agent, servant or representative of an unlicensed person or organization required to have a license or special permit as hereinabove provided. 4. Amend subsection c) to read as follows: c). Disabled Veterans. Every peddler, solicitor, or other person claiming to be en i ed to exemption from the payment of any license provided for in this ordinance upon the ground that he is an honorably discharged or released soldier, sailor or marine of the United States or Confederate States who is physically unable to obtain a livelihood by manual labor and who shall be a qualified elector of the State of California, as provided by Uct'Fon 16001 of Business and Professions Code or other law of this State, shall,in addition to any other information required by this Ordinance also file with the License Collector a certificate of a regularly licensed and practicing physician dated within one year of said application, to the effect that said applicant is physically unable to obtain a livelihood by manual labor, and stating the nature of said incapacitation; provided no exempt license shall be issued except in cases where the veteran applying therefor is actively engaged in the management and conduct of the business for which said exemption is re- quested. Section 6. Section 6117 of said Municipal Code is amended by adding a new su sec ion thereto to read as follows: c) Any licensee to whom a license has been issued for the operation of a wheeled vehicle shall be issued by the Tax Collector, in addition to the license certificate, a paper or metal license certificate for each wheeled vehicle, and said certificate shall at all times during the effective date thereof be affixed to the windshield, in the case of a sticker, and on the rear of said vehicle in a conspicuous place, in the case of a metal license plate. 12 ORD 096ê79wV ×Pç! Section 7. The first paragraph of Section 6171 of said Municipal Code is amended to read as follows: For every person conducting a manufacturing or fabricating industry not otherwise herein specifically provided for, the sum of $24.00 per annum, plus the additional sum of $2.00 per annum for each employee in excess of three. Section B. Sections 6127, 6133, 6134, 6136, 6148, 6149, 6153 and 6185 of said Municipal Code are repealed. Section 9. The City Clerk shall certify to the adoption of this ordinance and cause the same to be published or posted in the manner required by law. This ordinance shall take effect on the 1st day of January, 1959.
