HomeMy WebLinkAboutORD 099ORD 099ê79wV ×Pç7 P R r 4' v fire ii r, ORDINANCE NO. 99 AN ORDINANCE OF THE CITY COUNCIL of THE CITY of BALDWIN PARK AMENDING THE ZONING ORDINANCE TO PROVIDE FOR ELIMINATING FILLING STATIONS AS A PERMITTED USE IN C-1 ZONES, DEFINING AUTOMOBILE SERVICE STATIONS AND AUTHORIZING THEIR LOCATION IN C-2 ZONES, AUTHORIZING DAY NURSERIES, CHILD CARE AND FOSTER HOMES IN RESIDENTIAL AND AGRICUL- TURAL ZONES UNDER CERTAIN CONDITIONS, REQUIRING ENCLOSED GARAGES, IN ZONES R-1, R-2 AND A-1, AMEND- ING PARKING REQUIREMENTS FOR COMMERCIAL AND INDUS- TRIAL USES AND PLACES OF ASSEMBLY, AND PROVIDING FOR SIDE AND REAR SETBACKS IN RESIDENTIAL ZONES, DISTANCE BETWEEN RESIDENCES, AND COMPLIANCE WITH THE BUILDING CODE. The City Council of the City of Baldwin Park does ordain as follows:. Section 1. Paragraph 14 of subsection c) of Section 9100.251 of the Baldwin Park Municipal Code is repealed. Section 2. A new subparagraph, designated av is added to paragraph 2 of Section 9100.257 of said Municipal Code to read as follows: av. Automobile Service Stations. Section 3. A new section is added to said Municipal Code, designated Section 9100.1245, to read as follows: Section 9100.1245. Automobile Service Station. Auto- mobile service station" means a use wherein motor vehicles are serviced with gasoline and oil, tires are sold, repaired and serviced but not 1- ORD 099ê79wV ×Pç7recapped, radiators are cleaned and flushed, motor vehicles are washed and polished by hand provided steam cleaning equipment is not used and the area used for such washing and polishing does not exceed 500 square feet, greasing and lubricating operations are conducted provided the work is done indoors and the racks or pits used therefor do not exceed three 3) in number, carburetors, fuel pumps, fuel lines, spark plugs and batteries are given minor servicing or replaced, emergency wiring repairs are made, brakes on passenger cars and panel and pick- up trucks are relined and adjusted, water hoses, fan belts, brake fluid, light bulbs, floor mats, seat covers, windshield wipers, and other minor automobile accessories are replaced, and utility trailers bodies of which do not exceed 8 feet in length and excluding house trailers) are rented. Section 4. Subsection b of Section 9100.207 of said Munici- pal Code is amended by adding a new paragraph thereto, numbered 5, to read as follows:. 5. Day nurseries, child care homes and foster homes, provided the occupant of the premises is licensed to operate such nursery or home by the County Welfare Commission, has complied with all of the requirements for operating such nursery or home, has registered his name, location of residence, and number of children cared for with the Planning Department, and limits the number of children kept on the premises to five, includ- ing his own. Section 5. Subsection b of Section 9100.212 of said Municipal Code is amended by adding a new paragraph thereto, numbered 5, to read as follows: 5. Day nurseries, child care homes and foster homes, provided the occupant of the premises is licensed to operate such nursery or home by the County Welfare Commission, has complied with all of the requirements for operating such nursery or home, has registered his name, location of residence, and number of children cared for with the Planning Department, and limits the number of children kept on the premises to five, including his own. 2- ORD 099ê79wV ×Pç7 Section 6. Section 9100.231 of said Municipal Code is amended by adding a new paragraph 14 to the Uses Permitted," to read as follows: 14. Day nurseries, child care homes and foster homes, provided the occupant of the premises is licenses to operate such nursery or home by the County Welfare Commission, has complied with all of the requirements for operating such nursery or home, has registered his name, location of residence, and number of children cared for with the Planning Department, and limits the number of children kept on the premises to five, including his own. Section 7. Section 9100.211 of said Municipal Code is amended to read as follows: Section 9100.211. Zone R-1 Regulations Vehicle Storage. Every building or structure in Zone R-1 designed for or intended to be used as a dwelling shall be provided with a completely enclosed garage of sufficient capacity to accomodate not less than one passenger car for each family which such dwelling is designed to house. The garage shall be situated on the same lot or parcel of land as the d#elling and shall not be located where prohibited by law. Section 8. Section 9100.215 of said Municipal Code is amended to read as follows: Section 9100.215. Zone R-2 Regulations Vehicle Storage. Every building or structure in Zone R-2 designed for or intended to be used as a dwelling shall be provided with a completely enclosed garage of sufficient capacity to accomodate not less than one passenger car for each family which such dwelling is designed to house. The garage shall be situated on the same lot or parcel of land as the dwelling and shall not be located where prohibited by law. Section 9. Subsection a of Section 9100.219 of said Municipal Code is amended to read as follows: a. Every dwelling, apartment house or other structure in Zone R-3 designed for or intended to be used as a dwelling or apartment house shall be provided with a 3- ORD 099ê79wV ×Pç7 a completely enclosed garage of sufficient capacity to accomodate not less than one passenger automobile for each family which such dwelling or apartment house is designed to house. Where a community garage housing 3 or more vehicles is provided, the doors may be omitted leaving one side of the garage open. The garage shall be situated on the same lot or parcel of land as the dwelling or apartment house and shall not be located where prohibited by law. Section 10. Said Municipal Code is amended by adding a two new sections thereto, designated Sections 9100.261 and 9100.262, to read as follows: Section 9100.261. Parking Requirements for Certain Commercial Uses. Parking space shall be provided for the following commercial uses as follows: a) Trailer Parks. 1-k parking spaces for each trailer space. b) Hospitals and Sanitariums. 1k parking spaces for each patient bed. c) Bowling Alleys not including restaurants and other auxiliary uses). 3 spaces for each alley. d) Mortuaries, Skating Rinks, Gymnasiums, and Dance Halls. 1 parking space for each five 5) seats, permanent or movable, or 1 space for each thirty-five 35) square feet of assembly area, whichever is the larger, in those portions of the building used simultaneously for assembly. In addition, 1 space shall be provided for each two hundred and fifty 250) square feet of the balance of the floor area. feet in size. Parking spaces shall be ten 10) feet by twenty 20) Where more than twenty 20) such parking spaces exist on a lot or parcel of land, a minimum of two per cent of the gross area shall be devoted to interior landscaping based on a plot plan approved 4- ORD 099ê79wV ×Pç7 by the Planning Commission. Where parking areas herein required are adjacent to property zoned for residential or agricultural use, a six 6) foot masonry wall shall be erected along the property line between the parking area and the residential or agricultural property. Section 9100.262. Parking Requirements for Commercial Uses Outside Commercial Zones. Parking requirements for commercial uses shall be complied with regardless of the zone in which the use is located. Section 11. Section 9100.2.78 of said Municipal Code is amended by adding the following words to the first sentence thereof: or one 1) space for each five hundred 500) square feet of building floor area, whichever is the larger, and by adding the following new paragraphs thereto: Parking spaces shall be ten 10) feet by twenty 20) feet in size. Where more than twenty 20) such parking spaces exist on a lot or parcel of land, a minimum of two per cent of the gross area shall be devoted to interior landscaping based on a plot plan approved by the Planning Commission. Section 12. Section 9100.741 of said Municipal Code is amended to read as follows: Section 9100.741. Parking Requirements for Places of Assembly. a) All buildings used in whole or in part for the gathering together of twenty 20) or more persons for such purposes as deliberation, worship, enter- tainment or amusement, including every sports arena or club, but excepting a public school auditorium, shall have a minimum of one 1) parking space for each five 5) seats, permanent or movable, or one 1) space for each thirty-five 35) square feet of assembly area, whichever is the larger, in those 5- ORD 099ê79wV ×Pç7 portions of all buildings used simultaneously for assembly. b) A parking space shall be ten 10) feet by twenty 20) feet in size. c) In addition to the parking space, sufficient paved area to provide adequate ingress and egress to the parking spaces must be provided, d) Such parking area shall be permanently maintained and paved according to City specifications. e) Where the parking area is adjacent to residential or agricultural property, a six 6) foot masonry wall shall be erected along the property line between the parking area and the residential or agricultural property, f) The front yard setback area shall not be used for parking. Section 13. Said Municipal Code is amended by adding three new sections thereto, designated Sections 9100.542, 9100,7202 and 9100.7203, to read as follows: Section 9100.542, C2mollance with Building Code. Any exceptions granted to modify the yard area requirements shall comply with the requirements of the Building Code regarding fire resistant walls, drainage, and the like. Section 9100.7202. Side and Rear Setbacks in Residential Zones, Notwithstanding any provision in this Code to the contrary, the side and rear setbacks in all residential zones shall be a minimum of five 5) feet from the property line, Section 9100.7203, SeRaration of Residential Buildings, Buildings used for residential purposes in residential and agricultural zones shall be at least ten 10) feet from one another, 6 ORD 099ê79wV ×Pç7 Section 14. The City Clerk shall certify to the adoption of this ordinance and cause the same to be published or posted as required by law. This ordinance shall take effect thirty days after its adoption.
