HomeMy WebLinkAboutORD 100ORD 100ê79wV ×Pç@ ORDINANCE NO. 100 f t g1, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTIONS 8901, 8902, 8904, 8905 and 8906 OF THE %BALDWIN PARK MUNICIPAL CODE AND REPEAL- ING SECTION 8902.1 THEREOF, RELATING TO TRAILER COACHES. The City Council of the City of Baldwin Park does ordain as follows: Section 1. That Sections 8901, 8902, 8904, 8905 and 8906 of the Baldwin Park Municipal Code are amended to read as follows: 8901. Definition. A trailer coach, as defined in this chapter, is a vehicle with or without motive power, constructed to travel on a public thoroughfare at the maximum allowable speed in accordance with the provisions of the State Vehicle Code, and custom- airly used for the support, shelter or enclosure of persons. 8902. Where Permitted. No person shall use, keep, or maintain any trailer coach or similar vehicle after June 30, 1956, on any land within the City, except as follows: a) Storage when not used for living or sleeping purposes b) Use in a licensed trailer park. c) Use in a camp or park, regulated by a governmental agency, for residential purposes. d) Storage for display or sales purposes when not otherwise used or occupied. e) Temporary use on a construction project, or labor camp when regulated by a governmental agency. 8904. Permit Required. Before using a trailer coach as provided in Section 8902 e), a person shall first obtain a permit to do so from the County Engineer. To obtain such permit, an applica- tion in writing shall be filed with the County Engineer, which shall: a) Describe the property on which the trailer coach is or will be during the period of such use. b) Give a legal description of such property. c) Give the date on which such use will begin. d) State that 1) any sanitary facilities of the trailer coach will be sealed so that they cannot be used on the property or 2) 1- ORD 100ê79wV ×Pç@ the sanitary facilities and sewage disposal system for the trailer coach will comply with the Plumbing Code of the City of Baldwin Park, and other pertinent local and State regulations governing plumbing for trailers. e) Include the current State license number. f) Give such other information as the County Engineer may require. 8905. Application and Permit Fee. At the time the application is filed, it shall be accompanied by a filing fee of $5.00 which shall be the permit fee if a permit can legally be issued and r which shall otherwise be retained by the Department to cover the cost of investigation and inspection. 8906. Expiration of Permits. Permits issued under Section 8904 shall expire within six months after the date of issuance unless a shorter time is specified on the permit, or if no work has been done on the site under this permit within ninety days of the date of issuance. Section 2. That Section 8902.1 of said Municipal Code is repealed. Section 3. This ordinance is declared to be an emergency ordinance for the immediate preservation of the public peace, health, and safety. The facts constituting the urgency are as follows: On December 1, 1958, the City Council adopted Ordinance No. 95 on the recommendation of the Los Angeles County Building Department. This ordinance, which will become effective on December 31, 1958, contains provisions which would permit trailer coaches to be used for living purposes in residential zones. This is contrary to the intent of the City Council. It is, therefore, necessary to amend these provisions before they become effective. This can be accomplished only by the adoption of this ordinance as an emergency measure. Section 4. The City Clerk shall certify to the adoption of this ordinance and shall cause the same to be published or posted in the manner required by law. This ordinance shall take effect immediately upon its adoption. PASSED AND ADOPTED this 15th day of December, 1958.
