HomeMy WebLinkAboutORD 107ORD 107ê79wV ×Pç[ ORDINANCE NO. 107 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE DOG LICENSING AND IMPOUNDING PROVISIONS OF THE BALDWIN PARK MUNICIPAL CODE. The City Council of the City of Baldwin Park does or- dain as follows: Section 1. A new section, numbered Section 4101, is added to Part I, Chapter I, Article IV, of the Baldwin Park Municipal Code, to read as follows: 4101. Whenever the County acts as Poundmaster for the City, the manner in which dogs are licensed, the fees required therefor, and the collection and disposition of such fees, shall be a.s provided in Sections 351, 352, 353, 354, 355, 356, 357, 408.5, 409, 409.5, and 410 of the County's Pound Ordinance," notwithstanding anything in this article to the contrary. These sections provide as follows: Sec. 351. Pursuant to Section 439.01 of the State Agricultural Code, the County Clerk shall issue serially numbered metallic dog license tags stamped with the name of the County of Los Angeles and year of issue and shall collect for each such tag the sum of Fifty Cents 50fiO Sec. 352. The County Clerk shall deposit all sums received for dog license tags in a. special fund hereby created in the County Treasury, to be known as the Live- stock Indemnity Fund. Sec. 353. Pursuant to Section 439.55 of the State Agricultural Code, all fines collected for violations of Chapter 9 of Division 3 of said Code also shall be deposited in the Livestock Indemnity Fund. Sec. 354. Pursuant to Section 439.55 of the State Agricultural Code, the Livestock Indemnity Fund shall be used to pay damages to owners of livestock killed by dogs. Sec. 355. Every person owning any livestock killed by dogs may file a claim with accompanying affi- davits as provided in Section 439.56 of the State Agricultural Code. Sec. 356. The Board of Supervisors shall refer every such claim to the County Poundmaster. The County Poundmaster shall investigate all such claims and shall in- form the Board of Supervisors whether or not, in his opinion, such claims are valid; and, if valid, for what amount. Sec. 357. At the close of each fiscal year, the County Treasurer shall reimburse the General Fund from any unused balance remaining unexpended in the Livestock In- demnity Fund for all expenses paid from the General Fund for the enforcement of those portions of this ordinance relating to dogs, to the extent that funds remain available in the Livestock Indemnity Fund. As used in this chapter, livestock includes domestic fowl and rabbits. 1- ORD 107ê79wV ×Pç[ Sec. 408.5. The County Clerk may accept the payment of the fee for a. license tag and a license for a dog who has not been vaccinated as required by this ordi- nance on condition that the owner of such dog, within five days thereafter, have such dog vaccinated and submit the required veterinarian's certificate to the County Clerk. Upon receipt of such certificate the County Clerk shall issue the license tag and license. Sec. 409. A license for an individual dog shall be in the form of a receipt for the fifty cents paid for the dog license tag and the additional amount, if any, paid for the license. Sec. 409.5. Every dog license tag issued prior to July l, 1954, for a dog of either sex which has been honorably discharged from the armed forces of the United States or for a dog of either sex owned by a blind person, if a certificate was filed with the County Tax Collector executed by some recognized dog training institution which certified that such dog has been successfully trained to lead the blind, shall continue to be valid as both dog license tag and license so long as the same dog is owned or harbored by the same person. Every person owning or having custody or control of a dog of either sex over the age of four 4) months which has been honorably discharged from the armed forces of the United States, or a dog of either sex owned by a blind person, if a certificate is filed with the County Clerk executed by some recognized dog training institution which certifies that such dog has been successfully trained to lead the blind, for which a dog license tag was not issued prior to July 1, 1954, shall procure a dog license tag and a license, which dog license tag and license shall be good while such dog is owned or harbored by the same person. No fee shall be charged for such license over and above the fifty cents 0 required for the dog license tag. Sec. 410. Every person owning or having cus- tody or control of any dog over the age of four 4) months in the incorporated territory of the City of Baldwin Park not covered by the provisions of Section 409.5 shall first obtain an annual license from the County Clerk for each of such dogs and at the same time obtain a. dog license tag and for such license or licenses, in addition to the fifty-cent 50¢) fee for the dog license tag, shall pay Two Dollars and Fifty Cents $2.50), a total of Three Dollars $3.00) in all." Section 2. Section 4120 of said Municipal Code is amended by adding the following words thereto: and dogs which are unvaccinated in violation of this chapter." Section 3. A new section, numbered Section 4125, is added to Part III, Chapter I, Article IV, of said Municipal Code, to read as follows: 4125. The Poundmaster shall pick up and dispose of all dead animals on public highways, and on public and private property within the City. Section 4. A new section, numbered Section 4135.5, is added to Part IV, Chapter I, Article IV, of said Municipal Code, to read as follows: 2- ORD 107ê79wV ×Pç[ 4135.5. The Poundmaster, any officer or employee thereof, and any peace officer shall have the right to enter upon any public or private property in the incor- porated territory of the City of Baldwin Park, except a building designed for or used for residential purposes, for the purpose of examining or capturing any dog thereon or therein. Every person who denies or prevents, obstructs, or attempts to deny, prevent, or obstruct, such access is guilty of a misdemeanor. Section 5, Section 4137 of said Municipal Code is amended by changing the opening sentence to read: The licensing provisions of this chapter do not apply to:" Section 6. Section 4138 of said Municipal Code is amended by deleting therefrom the words provided there is in addition thereon in some noticeable place the words City of Baldwin Parkr." Section 7, Sections 4140 and 4152 of said Municipal Code are repealed. Section 8, Paragraphs 1 and 2 of subsection c) of Section 4172 of said Municipal Code are amended to read as follows: 1) One Dollar $1.00) for a cow, bull, steer, horse, mule, burro, pony, Jack, jenny, or hinny. 2) Fifty Cents $.50) for any other animal, except a cat. Section 9. Said Section 4172 is further amended by adding the following subsection d) thereto: d) For taking up and impounding any cat, One Dollar $1.00), and for feeding and caring for such cat, twenty- five cents $.25) for each day or fraction thereof during which such cat is kept in such pound except the day on which it is impounded, shall be collected. Section 10. Section 4176 of said Municipal Code is amended by deleting the words and figures Two Dollars and Fifty Cents $2,50)" and substituting the following in place thereof: Six Dollars and Fifty Cents $6.50) if the dog has been vaccinated at County expense by the Livestock Inspector, otherwise Three Dollars and Fifty Cents $3.50)." Section 11. Subsection d) of Section 4176.1 of said Municipal Code is amended by changing the words and figures Five Dollars $5.00)" to read Three Dollars $3.00)." 3- ORD 107ê79wV ×Pç[ Section 12. Section 4184 of said municipal Code is amended to read as follows: 4184, For taking up and impounding any dog, Three Dollars and Fifty Cents $3.50); for feeding and caring for any such dog, twenty-five cents $.25) for each day or fraction thereof during which such dog is kept in such pound except the day on which it is impounded, shall be collected. Section 13. A new section, numbered Section 4196.4, is added to Part IX, Chapter I, Article IV, of said Municipal Code, to read as follows: 4196.4. If the Poundmaster finds that any dog im- pounded by him or in any pound of a corporation formed pursuant to Section 10400 of the Corporations Code, probably can be sold, or that in order to protect the public health such dog should be vaccinated, he may cause such dog to be vaccinated with chick embryo vac- cine or phenolized tissue vaccine. Section 14. This ordinance is declared to be an emergency ordinance for the immediate preservation of the public peace, health and safety. The facts constituting the urgency are as follows: The City has lost the services of the agency which has heretofore handled its pound or animal shelter services. The County of Los Angeles will undertake to render such service as soon as the City's Pound Ordinance" is amended to conform to the County's regulations on the subject. The amendments in this ordi- nance are designed to accomplish this purpose. It is, therefore, important to the public peace, health and safety that this ordinance become effective as soon as possible. Section 15. The City Clerk shall certify to the adoption of this ordinance and shall cause the same to be published or posted as required by law. This ordinance shall take effect immediately upon its adoption.
