HomeMy WebLinkAboutORD 113ORD 113ê79wV ×Pç€ ORDINANCE NO. 113 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMEND- ING THE TRAFFIC REGULATIONS. The City Council of the City of Baldwin Park does ordain as follows: Section 1. That Chapter 3, Article III, of the Baldwin Park Municipal Code, entitled TRAFFIC REGULATIONS" and consisting of Sections 300 to 3354, inclusive, is re- pealed. Section 2. That a new Chapter 3 is added to said Article III of said Municipal Code, to read as follows: CHAPTER 3 TRAFFIC REGULATIONS Part 1 DEFINITIONS 3300. Definitions in State Vehicle Code. Whenever any words or phrases use in is chap er are not defined herein, but are now defined in the State Vehicle Code, such definitions are incorporated herein and shall be deemed to apply to such words and phrases as though set forth herein in full. 3301. Other Definitions. The following words and phrases, when use n s chapter, shall have the mean- ings respectively ascribed to them in this section: a) Holidays. The first day of January, the twelfth ay o ebruary, the twenty-second day of February, the thirtieth day of May, the fourth day of July, the first Monday in September, the ninth day of September, the twelfth day of October, the eleventh day of Novembe the twenty-fifth day of December, and Thanksgiving Day. If the first day of January, twelfth day of February, twenty-second day of February, thirtieth day of May, fourth day of July, ninth day of September, twelfth day of October, eleventh day of November, or twenty-fifth day of December falls upon a Sunday, the Monday following is a holiday. b) Loading Zone. The space adjacent to a curb reserved or the exclusive use of vehicles during the loading or unloading of passengers or materials. c) Official Time Standard. Whenever certain hours are named herein trey shall mean standard time or daylight saving time, depending upon which is in use in this city. d) Park. To stand or leave standing any vehicle, whether occupied or not, otherwise than temporarily, for the purpose of, and while actually engaged in loading or unloading of passengers or materials. 1- ORD 113ê79wV ×Pç€ e) Parkway. That portion of a street other than a roadway or a sidewalk. f) Passenger Loading Zone. The space adjacent to a curb reserved or the exclusive use of vehicles during the loading or unloading of passengers. g) Pedestrian. Any person afoot. h) Police Officer. Every officer of the police department of this city, or any officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations. i) Stop. When required, means complete cessa- tion of movement. j) Stop or Stand. When prohibited, means any stopping or standof a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or official traffic control device. Part 2 TRAFFIC ADMINISTRATION 3302. Police Administration. There is hereby estab- lished in the police depar men of this city a traffic division to be under the control of an officer of police appointed by and directly responsible to the Chief of Police. 3303. Duty of Traffic Division. It shall be the duty of the traffic division, with such aid as may be rendered by other members of the police department, to enforce the street traffic regulations of this city and all of the state vehicle laws applicable to street traf- fic in this city, to make arrests for traffic violations, to investigate traffic accidents, and to cooperate with the City Engineer and other officers of the city in the administration of the traffic laws and in developing ways and means to improve traffic conditions, and to carry out those duties specially imposed upon said division by this chapter and other traffic regulations of this city. 3304. Traffic Accident Studies. Whenever the acci- dents at any particular oca ion become numerous, the traffic division shall cooperate with the City Engineer in conducting studies of such accidents and determining remedial measures. 3305. Traffic Accident Reports. The traffic division shall maintain a suitable system o filing traffic acci- dent reports. Accident reports or cards referring to them shall be filed alphabetically by location. Such reports shall be available for the use and information of the City Engineer. 3.306. Traffic Division to Submit Annual Traffic Safety Reports. The traffic ivision shall annual y prepare a ra Such a report shall contain information on traffic matters in this city as follows: 1. The number of traffic accidents, the number of persons killed, the number of persons in- jured, and other pertinent traffic accident data; 2- ORD 113ê79wV ×Pç€ 2. The number of traffic accidents investi- gated and other pertinent data on the safety activities of the police; 3. The plans and recommendations of the divi- sion for the future traffic safety activi- ties. 3307. Duties of City Engineer; Designation as City Traffic Engineer. t shall e the genera duty of the City Engineer to determine the installation and proper timing and maintenance of traffic control devices and signals, to conduct engineering analyses of traffic acci- dents and to devise remedial measures, to conduct engin- eering and traffic investigations of traffic conditions and to cooperate with other city officials in the develop- ment of ways and means to improve traffic conditions, and to carry out the additional powers and duties imposed by ordinances of this city. The City Engineer may use the title of City Traffic Engineer in performing such duties. 3308. Shrubber Obstructing Visibility of Intersec- tions. Whenever e City Traffic ng neer n s t a any hedge, shrubbery or tree growing in a parkway obstructs the view of any intersection, or any traffic upon the streets approaching such intersection, he shall cause the hedge, shrubbery or tree to be immediately removed or reduced in height. Part 3 ENFORCEMENT AND OBEDIENCE TO TRAFFIC REGULATIONS 3-309. Authority of Police and Fire Department Officials. a) It shall be the duty of the officers of the police department, or such officers as are assigned by the Chief of Police, to enforce all street traffic laws of this city and all of the state vehicle laws applicable to street traffic in this city. b) Officers of the police department, or such officers as are assigned by the Chief of Police, are hereby authorized to direct all traffic by voice, hand or other signal in conformance with traffic laws, provided that in the event of a fire or other emer- gency or to expedite traffic, or to safeguard pedes- trians, officers of the police department may direct traffic as conditions may require, notwithstanding the provisions of the traffic laws. c) Officers of the fire department, when at the scene of a fire or when in the course of their duties they are protecting the personnel or equipment of the fire department, may direct or assist the police in directing traffic. 3310. Required Obedience to Traffic Regulations. It is a misdemeanor for any person to do any act for den or fail to perform any act required. in this chapter. 3311. Obedience to Police and Fire Department Officials. No person shall wilfully fail or refuse to comply with any lawful order of a police officer or fire department offi- cial when directing traffic. 3- ORD 113ê79wV ×Pç€ 3312. Traffic Regulations Apply to Persons Riding Bic cles or Animals. Every person rid n a bicyc e or riding or r wing an animal upon a highway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle by this chapter, ex- cept those provisions which by their very nature can have no application. 3313. Persons Other Than Officials Shall Not Direct Traffic, No person o her an an o cer o e police department or a person deputized by the Chief of Police or person authorized by law shall direct or attempt to direct traffic by voice, hand or other signal, except that persons may operate when and as herein provided any mechanical pushbutton signal erected by order of the City Engineer. 331.4. Public Em to ees to Obey Traffic Regulations. The provisions o th s chapter shall apply o e river of any vehicle owned.by or used in the service of the United States Government, this state, any county or city, including the City of Baldwin Park, and it shall be un- lawful for any said driver to violate any of the provisions of this chapter except as otherwise permitted. herein or by the State Vehicle Code. 3315. Exemptions to Certain Vehicles. a) The provisions of this chapter regulating the operation, parking and standing of vehicles shall not apply to any vehicle of the police or fire department, any public ambulance, or any public utility vehicle or any private ambulance that has qualified as an authorized. emergency vehicle, when any such vehicle is operated in the manner specified in the State Vehicle Code in response to an emergency call. b) The foregoing exemptions shall not, however, protect the driver of any such vehicle from the con- sequences of his wilful disregard of the safety of others. c) The provisions of this chapter regulating the parking or standing of vehicles shall not apply to any vehicle of a city department or public utility while necessarily in use for construction or repair work, or any vehicle owned by the United States while in use for the collection, transportation or delivery of United States mail. 3316, Report of Damage to Certain Property, a) The driver of a vehicle or the person in charge of any animal involved in any accident result- ing in damage to any property publicly owned or owned. by a public utility, including but not limited to any fire hydrant, ornamental lighting post, telephone pole, electric light or power pole, or resulting in damage to any ornamental shade tree, traffic control device or other property of a like nature located in or along any street, shall within twenty-four 24) hours after such accident make a written report of such accident to the police department of this city. b) Every such report shall state the time when and. the place where the accident took place, the name 4- ORD 113ê79wV ×Pç€ and address of the person owning and of the person driving or in charge of such vehicle or animal, the license number of every such vehicle, and shall briefly describe the property damaged in such acci- dent. c) A driver involved in an accident shall not be subject to the requirements or penalties of this section if and during the time such driver is physi- cally incapable of making a report, but in such event said driver shall make a report as required in sub- section a) within 24 hours after regaining the ability to-make such report. Part 4 TRAFFIC CONTROL DEVICES 3317. Authority to Install Traffic Control Devices. a) The City Engineer, with the approval of the City Council, shall have the power and duty to place and maintain or cause to be placed, and maintained official traffic control devices when and as required under the traffic regulations of this city to make such regulations effective. b) Whenever the State Vehicle Code requires for the effectiveness of any provisions thereof that traffic control devices be installed to give notice to the public of the application of such law, the City Engineer is hereby authorized to install or cause to be installed the necessary devices subject to any limitations or restrictions set forth in the law applicable thereto. c) The City Engineer may also place and maintain or cause to be placed and maintained such additional traffic control devices as he may deem necessary to regulate traffic or to guide or warn traffic, but he shall make such determination only upon the basis of traffic engineering principles and traffic investiga- tions and in accordance with such standards, limita- tions and rules as may be set forth in the traffic regulations of this city or as may be determined by City Council. 3318. When Traffic Control Devices Re uired for Enforcement Purposes. o provision o e a e e icle Co e or o this chapter for which signs are required shall be enforced against an alleged violator unless appro- priate signs are in place and sufficiently legible to be seen by an ordinarily observant person, giving notice of such provisions of the traffic laws. 3319. Obedience to Traffic Control Devices. The driver of any vehicle shall obey the instructions of any official traffic control device applicable thereto placed in accordance with the traffic regulations of this city unless otherwise directed by a police officer subject to the exceptions granted the driver of an authorized emer- Zency vehicle when responding to emergency calls. 3320. Installation of Traffic Signals. a) The City Engineer, with the approval of the City Council, is hereby directed to install and main- 5- ORD 113ê79wV ×Pç€ tain official traffic signals at those intersections and other places where traffic conditions are such as to require that the flow of traffic be alternately interrupted and released in order to prevent or relieve traffic congestion or to protect life or property from exceptional hazard. b) The City Engineer shall ascertain and deter- mine the locations where such signals are required by resort to field observation, traffic counts and other traffic information as may be pertinent, and his de- terminations therefrom shall be made in accordance with those traffic engineering and safety standards and instructions set forth in the Planning Manual of Instructions, Part 8, Traffic", issued by the Division of Highways of the State Department of Public Works. w c) Whenever the City Engineer installs and main- tains an official traffic signal at any intersection as herein provided, he shall likewise erect and main- tain at such intersection street name signs visible to the principal flow of traffic unless such street name signs have previously been placed and are main- tained at such intersection. 3,321. Traffic Barriers. No person shall operate a vehicle contrary o the directions or provisions of any barrier or sign erected: a) Pursuant to the provisions of any ordinance of this City; or b) By any public utility; or c) By any department of this City; or d) By any other person pursuant to law or contract with the City, nor, shall any unauthorized person move or alter the position of any such barrier or sign. 3322. Lane Markin s. The City Engineer is hereby authorized to mark center lines and. lane lines upon the surface of the roadway to indicate the course to be traveled by vehicles and may place signs temporarily designating lanes to be used by traffic moving in a particu- lar direction, regardless of the center line of the highway. 3323. Distinctive Roadwa Markin s. The City Engineer is authorized to p ace and maintain distinctive roadway markings as described in the State Vehicle Code on those streets or parts of streets where the volume of traffic or the vertical or other curvature of the roadway renders it hazardous to drive on the left side of such marking or signs and markings. Such markings or signs and marking shall have the same effect as similar markings placed by the State Department of Public Works pursuant to provi- sions of the State Vehicle Code. 3324. Authority to Remove Relocate or Discontinue Traffic Control Devices. The City Engineer, upon approval of the City Council., s hereby authorized to remove, re- locate or discontinue the operation of any traffic control device not specifically required by state law or this chapter whenever he shall determine in any particular case that the conditions which warranted or required the instal- lation no longer exist or obtain. 6- ORD 113ê79wV ×Pç€ 3325. Traffic Control Devices Hours of Operation. The City Engineer shall determine he hours and days dur- ing which any traffic control device shall be in operation or be in effect, except in those cases where such hours or days are specified in this chapter. Part 5 TURNING MOVEMENTS 3326. Authority to Place and Obedience to Turning Markers. intersections. MulMple lanes. a) The City Engineer is authorized to place mar- kers, buttons, or signs within or adjacent to intersections indicating the course to be traveled by vehicles turning at such intersections, and the City Engineer is authorized to allocate and indicate more than one lane of traffic from which drivers of vehicles may make right or left hand turns, and the course to be traveled as so indicated may conform to or be other than as prescribed by law or ordi- nance. b) When authorized markers, buttons, or other indications are placed within an intersection indicating the course to be traveled by vehicles turning thereat, no driver of a vehicle shall disobey the directions of such indications. 33.27. Authority to Place Restricted Turn Signs. The City Engineer is hereby authorized to determine those intersections at which drivers of vehicles shall not make a right, left or U turn, and shall place proper signs at such intersections. The making of such turns may be prohibited between certain hours of any day and permitted at other hours, in which event the same shall be plainly indicated on the signs or they may be removed when such turns are permitted. 3328. Authority to Prohibit Right Turns Against Traffic Stop Signal, The City Engineer is hereby author- ized o determine those intersections within any business or residence district at which drivers of vehicles shall not make a right turn against a red or stop signal and shall erect proper signs Zriving notice of such prohibition. No driver of a vehicle shall disobey the directions of any such signs. Part 6 ONE-WAY STREETS AND ALLEYS 3329. The City Traffic Engineer to Sign One Wa Streets and Al e s. Whenever any ordinance or re so ution of this city esignates any one-way streets or allen the City Engineer shall place and maintain signs giving notice thereof, and no such regulations shall be effective unless such signs are in place. Signs indicating the direction of lawful traffic movement shall be placed at every inter- section where movement of traffic in the opposite direction is prohibited. Part 7 SPECIAL STOPS REQUIRED 3330. The City Engineer to Erect Stop Signs. When- ever any ordinance or resolution of this city designates 7- ORD 113ê79wV ×Pç€ and describes any street or portion thereof as a through street, or any intersection at which vehicles are required to stop at one or more entrances thereto, or any railroad grade crossings at which vehicles are required to stop, the City Engineer shall erect and maintain stop signs as follows: A stop sign shall be erected on each and every street intersecting such through street or portion thereof so designated and at those entrances of other intersections where a stop is required and at any railroad grade crossing so designated. Every such sign shall conform with and shall be placed as provided in Section 471.5 of the State Vehicle Code. 3331. Obedience to Stop Signs. When stop signs are erected at the entrance to any intersection as provided in Section 3130, every driver of a vehicle shall stop as required by the State Vehicle Code. 3332. Emer in from Alle Driveway or Build.in The driver o a vehicle emerging From an alley,-7'riveway or building shall stop such vehicle immediately prior to driving onto a sidewalk or into the sidewalk area extend- ing across any alley way. Part 8 MISCELLANEOUS DRIVING RULES 3.333. Driving Through Funeral Processions. No d.river of a vehicle shall drive between vehicles com- prising a funeral procession while they are in motion and when the vehicles in such processions are conspicu- ously so designated. 3334. Clin in to Moving Vehicles. Any person rid- ing upon any bicycle, motorcycle, coaster, roller skates or any toy vehicle shall not attach the same or himself to any moving vehicle upon any roadway. 3335. Vehicles shall Not be Driven on the Sidewalk. The driver o a vehicle shall no drive within any s e- walk area or any parkway except at a permanent or tem- porary driveway. 3.336. New Pavement. No person shall ride or drive any animal or any vehicle over or across any newly made pavement or freshly painted markings in any street when a barrier or sign is in place warning persons not to drive over or across such pavement or marking, or when a sign is in place stating that the street or any portion thereof is closed. 3-437. Restricted Access. No person shall drive a vehicle onto or from any limited access roadway except at such entrances and exits as are established by pub- lic authority. 3338. Restrictions on Use of Freeways. No person shall drive or operate any bicycle, mo or driven cycle, or any vehicle which is not drawn by a motor vehicle upon any street established as a freeway, as defined by state law, nor shall any pedestrian walk across or along any such street so designated and described except in space set aside for the use of pedestMans, provided official signs are in place giving notice of such re- strictions. 8- ORD 113ê79wV ×Pç€  3339• Intoxicated Persons in or About Vehicles. It shall be unlawful or any person who is under t e nfluence of intoxicating liquor or narcotic drugs to be in or about any vehicle to which he has right of access or control while such vehicle is in or upon any street or any other public place in the City unless the same is under the im- mediate control or operation. of a person not under the influence of intoxicating liquor or narcotic drugs. Part 9 PEDESTRIANS 3340. The City Engineer to Recommend Establishment of Cross-Wa s. a) The City Engineer shall recommend to the City walks and shall designate them by appropriate devices or painted signs upon the surface of the roadway after they are established. b) The City Engineer may place signs at or ad- jacent to an intersection in respect to any cross- walk directing that pedestrians shall not cross in the crosswalk so indicated. 3.341. When Pedestrians Must Use Crosswalks. No pedestrian shall cross a roadway other than y a cross- walk in an7 business district. 3342. Crossing, at Right Angles. No pedestrian shall cross a roadway at any pace other than by a route at right angles to the curb or by the shortest route to the opposite curb except in a marked crosswalk. 3343. Pedestrians Standing on Sidewalks. No pedes- trian shall stop or stand on a sidewalk except as near as is physically possible to the building line or the curb line at any place in any business district. 3344. Standing in Roadways. No person shall stand in any roadway other thhan In a crosswalk if such action interferes with the lawful movement of traffic. This section shall not apply to any public officer or employee, or employee of a public utility when necessarily upon a street in line of duty. Part 10 STOPPING, STANDING AND PARKING 3345. Application of Regulations. a) The provisions of this part prohibiting the stopping, standing or parking of a vehicle shall apply at all times or at those times herein specified, except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic control device. b) The provisions of this part imposing a time limit on standing or parking shall not relieve any person from the duty to observe other and more restric- tive provisions of the State Vehicle Code or the ordinances of this city, prohibiting or limiting; the standing or parking of vehicles in specified places or at specified times. 9- ORD 113ê79wV ×Pç€  3346. Authority to Establish Stoppin Standing and Parking Restrictions an Pro ibZtions. a) Whenever, with reference to any street or por- tion thereof, after study and recommendation by the City Engineer, the City Council determines that be- cause of proximity to a business district or center of employment, or because of unusual concentration of population, or because of any other factor or condi- tion, the unrestricted parking of vehicles has caused, or would necessarily cause, traffic congestion or hazard, or has deprived the public of the economical distribution of the use of available curb space, the City Council is authorized to establish by resolution such parking, or stopping, standing and parking re- strictions and prohibitions as may be necessary. b) The City Engineer shall install, at such street or portion thereof, appropriate signs or mark- ings giving effect to such parking, or stopping, standing and parking, restrictions or prohibitions. c) When appropriate signs or markings have been installed or placed as authorized in this section, no person shall stop, stand or park, any vehicle for a period of time in excess of the parking time limit indicated, by such sign. Successive acts of parking in the same block between intersections on any street shall on any calendar day be presumed to be a single act of parking within the meaning of this section when the vehicle is moved merely for the purpose of avoiding the parking limitations prescribed by this code. When the parking places covered by a single act of parking are subject to different time limita- tions, the legality of parking shall be determined by the longest time limitation. 3.347. Standing in Parkways Prohibited. No person shall stop, stand or park a vehic e wi hin any parkway. 3348. Use of Streets for Storage of Vehicle Prohibited. a) No person who owns or has possession, custody or control of any vehicle shall park such vehicle upon any street or alley for more than a consecutive period of 120 hours. b) In the event a vehicle is parked or left stand- ing upon a street in excess of a consecutive period of 120 hours, any member of the police department authorized by the Chief of Police may remove said vehicle from the street in the manner and subject to the requirements of the State Vehicle Code. 3349. Parking for Certain Purposes Prohibited. No person shal par a vehicle upon any roadway or the prin- cipal purpose of: 1. Displaying such vehicle for sale. 2. Washing, greasing, or repairing such vehicle except repairs necessitated by an emergency. 3.350. Curb Parking Right o- f Way. a) Definition Limited Curb Parking S ace. For the purpose of this section, a smite curb parking 10- ORD 113ê79wV ×Pç€ space" shall mean an area open for lawful parking alongside of and adjacent to a curb, which area is not of sufficient len'-th to permit two or more ve- hicles to freely move for parking therein at the same time. b) Parkin at Curb Right of Way. Any person seeking o par his vehicle n a limited curb park- ing space, whose vehicle arrives at said parking space prior to any other vehicle, and who proceeds beyond said space a distance not to exceed ten feet for the purpose of backing his vehicle therein, shall have the right of way over any person driving or attempting to drive any other vehicle directly into such limited curb parking space or who in any manner obstructs such limited curb parking space and the driver of such other vehicle shall yield the right of way to the driver who first arrived at said parking space. 3351• Parking Parallel With Curb. a) Subject to other and more restrictive lim- itations, a vehicle may be stopped or parked within 18 inches of the lefthand curb facing in the direc- tion of traffic movement upon any one-way street unless sins are in place prohibiting such stopping or standing. b) In the event s, highway includes two or more separate roadways and traffic is restricted to one direction upon any such roadway, no person shall stand or park a vehicle upon the lefthand side of such one-way roadway unless signs are in place per- mitting such standing or parking. c) The City Engineer shall recommend to the City Council when standing or parking shall be pro- hibited upon the lefthand side of any one-way street or when standing or parking may be permitted upon the lefthand side of any one-way roadway of a high- way having two or more separate roadways, and if such recommendation is adopted by the City Council, he shall erect signs giving notice thereof. d.) The requirement of parallel parking shall not apply in the event any commercial vehicle is actually engaged in the process of loading or un- loading freight or goods, in which case that vehicle may be backed up to the curb, provided that such vehicle does not extend beyond the center line of the street and does not block traffic thereby. 3352. Parking Adjacent to Schools. a) The City Engineer is hereby authorized., with the approval of the City Council, to erect signs in- dicating no parking upon that side of any street adjacent to any school property when such parking would, in his opinion, interfere with traffic or create a hazardous situation. b) When official signs or markings prohibiting parking are erected upon narrow streets as author- ized herein, no person shall park a vehicle upon any such street in violation of any such sign or marking. 11- ORD 113ê79wV ×Pç€ ORD 113ê79wV ×Pç€  d) Whenever any permit is granted under the pro- visions of this section and a particular location to park or stand is specified therein, no person shall park or stand any vehicle, wagon, or pushcart on any location other than as designated in such permit. In the event that the holder of any such permit is con- victed in any court of competent jurisdiction for violating any of the provisions of this section, such permit shall be forthwith revoked by the City Council and no permit shall thereafter be issued to such per- son until six 6) months have elapsed from the date of such revocation. 3356. Emergency Parking; Signs. a) Whenever the City Engineer shall determine that an emergency traffic congestion is likely to result from the holdiniL of public or private assemblages, gatherings, or functions, or for other reasons, he shall have power and authority to order temporary signs to be erected or posted indicating that the operation, parking or standing of vehicles is prohibited on such streets and alleys as he shall direct during the time such temporary signs are in place. Such signs shall remain. in place only during the existence of such emer- ency and the City Engineer shall cause such signs to be removed promptly thereafter. b) When suns authorized by the provisions of this section are in place giving notice thereof, no persons shall operate, park or stand any vehicle contrary to the directions and provisions of such signs. 3357. Display of Warning Devices When Commercial Vehicle Disabled.. Every motor truck having an unTaden weight o 000 pounds or more and every truck tractor, irrespective of weight when operated upon any street or highway during the term specified in Section 618 of the State Vehicle Code, shall be equipped with and. carry at least two flares or two red lanterns, or two warning lights or reflectors, which reflectors shall be of a type approved by the Department of California Highway Patrol. When any vehicle above mentioned or any trailer or semi- trailer is disabled upon streets or highways outside of any business or residence district within this city and upon which street or highway there is insufficient street light- ing to reveal a vehicle at a distance of 200 feet during any time mentioned in Section 618 of the State Vehicle Code, a warning signal of the character indicated above shall be immediately placed at a distance of approximately 100 feet in advance of, and 100 feet to the rear of, such disabled vehicle by the driver thereof. The continuous flashing of at least four approved type class A Type I turn signal lamps, at least two toward the front and at least two toward the rear of the vehicle, shall be con- sidered to meet the requirements of this section until the devices mentioned. above can be placed in the required locations. The warning signals herein mentioned shall be displayed continuously during the times mentioned in said Section 618 while such vehicle remains disabled upon such street or highway. 3358. Parkin Time Limited in Business Districts. When authorized signs are n place giving not 3e hereof, no person shall stop, stand or park any vehicle within a business district between the hours of 7:00 a.m. and 6:00 p.m. of any day except Sunda s and holidays for a period of time longer than two 2~ hours. 13- ORD 113ê79wV ×Pç€ 3359. All Night Parkin Prohibited. No person shall stop, stand or par a vehicle on any street for a period of time longer than thirty 30) minutes between the hours of 2:00 a.m. and 4:00 a.m. of any day. 3360. Parking Certain Vehicles in Residential Districts. No person shall park any vehicle exceeding two tons unladen capacity more than five hours in any residential district except a) while loading or unload- ing property and time in addition to such five-hour period is necessary to complete such work, or b) when such ve- hicle parked in connection with, and in aid of, the per- formance of a service to or on a property in the block in which such vehicle is parked and time in addition to such five-hour period is reasonably necessary to complete such service. 3361. Parking on Private Propert Prohibited. No person shall park a vehicle in a private driveway or on private property without the direct or implied consent of the owner or person in lawful possession of such driveway or property. 3362. Parking on City Pro2erty. a) Whenever the Chief Administrative Officer shall determine that the orderly, efficient conduct of the City's business requires that parking or standing of vehicles on city property be prohibited, limited or re- stricted, he shall have the power and authority to order signs to be erected or posted indicating that the parking of vehicles is thus prohibited, limited or restricted. b) When signs authorized by the provisions of this section are in place, giving notice thereof, no per- son shall park or stand any vehicle contrary to the direc- tions or provisions of such signs. 3353. No Parking Zones to Prevent Floodin In order to prevent flooding o adjacent property, the City Engin- eer shall designate established no parking zones by plac- ing and maintaining appropriate signs indicating the hours and days when parking is prohibited. During the hours and on the days designated on the signs, it shall be unlawful for the operator of any vehicle to park said vehicle on any of the streets or parts of streets established by resolution of the City Council as such no parking zones. 3364 Bicycle Parking Zones. When the City Engineer shall determine that the estshment of a bicycle park- ing zone is reasonably necessary or desirable for the regulation of traffic or to provide facilities for the temporary parking of bicycles being operated upon the public streets, or to safeguard life or property, he is hereby authorized to set aside a space on the street not more than thirty-six 36) feet in length for the parking of bicycles during such hours of such days as are found by him to be best suited for the accomplishment of the pur- poses set forth in this section. When a bicycle parking zone is so established, the City Engineer shall cause appropriate signs to be posted thereat during such hours, giving notice that parking of other vehicles is prohibited. No person shall stop, stand or park any other vehicle in front of such zone while such signs are in place. 3365. Funeral Zones. It shall be unlawful for the operator of any vehicle to stop, stand or park said ve- 14- ORD 113ê79wV ×Pç€ hicle for any period of time longer than is necessary for the loadin or unloading of passengers and not to exceed three 3) minutes at any place between limit markers or si=ns placed within the protected real property boundaries of arn.y undertakin- establishment, private residence, or any public or private place at any time during or within forty 40) minutes prior to the becinninff of any funeral or funeral service, unless the operator of said vehicle is directed by or has received permission from the direc- tor or other person in charge of such funeral or funeral service to park such vehicle in such place, provided that such director or person in charge shall have placed and maintained prior to and during the time limit herein specified two 2) approved portable signs, one at each extremity of such place, upon the sidewalk or pavement area and within ty,wo 2) feet of the curb. 3366. Taxicab Stands. a) The City Council shall, by resolution, estab- lish taxicab stands and determine the locations thereof. b) The curb surface within each taxicab stand shall.be painted white and marked TAXICAB STAND" in red lettering, or shall be designated by signs of a type and size approved by the City Engineer. c) It shall be unlawful for the operator of any vehicle, other than a taxicab or automobile for hire, to park said vehicle in such taxicab stand. 3367. Parkin Space Markings. The City Engineer is authorized o instal and.ma n win parking space markings to indicate parking spaces adjacent to curbings where authorized parking is permitted. When such parking space markings are placed in the highway, subject to other and more restrictive limita- tions, no vehicle shall be stopped, left standing or parked other than within a single space unless the size or shape of such vehicle makes compliance impossible. Part 1-1- STOPPING FOR LOADING OR UNLOADING ONLY 3368. Authority to Establish Loading Zones. a) The City Engineer shall recommend and the City Council may approve the marking of loading zones and passenger loading zones as follows: 1. Any place in any business district. 2. Elsewhere in front of the entrance to any place of business or in front of any hall or place used for the purpose of public assembly. b) In no event shall more than one-half of the total.curb length in any block be reserved for loading zone purposes. c) Loading zones shall be indicated by a yellow paint line stencilled with black letters, LOADING ONLY" upon the top of all curbs within such zones. 15- ORD 113ê79wV ×Pç€ d) Passenger loading zones shall be indicated by a white line stencilled with black letters, PASSENGER LOADING ONLY" upon the top of all curbs in said zones. 3369. Curb Markings to Indicate No Stopping and Park- ing Regulations. a) The City Engineer is hereby authorized, subject to the provisions and limitations of this chapter, to place, and when required herein shall place, the fol- lowing curb markings to indicate parking or standing regulations, and said curb markings shall have the meanings as herein set forth; 1. Red" shall mean no stopping, standing or parking at any time except as permitted by the State Vehicle Code, and except that a bus may stop in a red zone, marked or signed as a bus zone. 2. Yellow" shall mean no stopping, standing or parking at any time between 7:00 a.m. and 6:00 p.m. of any day except Sundays and holidays for any purpose other than the loading or unloading of pas- sengers or materials, provided that the loading or unloading of passengers shall not consume more than three 3l minutes nor the loading or unloading of materials more than twenty 20) minutes. 3. White" shall mean no stopping, standing or parking for any purpose other than loading or unloading of passengers, or for the purpose of depositing mail in an adjacent mail box, which shall not exceed three 3) minutes and such re- strictions shall apply between 7:00 a.m. and 6:00 p.m. of any day except Sundays and holidays and except as follows: i) When such zone is in front of a hotel or in front of a mail box, the restrictions shall apply at all times. ii) When such zone is in front of a theater, the restrictions shall apply at all times except when such theater is closed. 4. Green" shall mean no standing or parking for longer than twenty 20) minutes at any time between 7:00 a.m. and 6:00 p.m. of any day except Sundays and holidays. b) When the City Engineer, as authorized under this chapter, has caused curb markings to be placed, no person shall stop, stand or park a vehicle adjacent to any such legible curb markings in violation of any of the provisions of this section. 3370. Effect of Permission to Load or Unload. a) Permission herein granted to stop or stand a vehicle for purposes of loading or unloading of mater- ials shall apply only to commercial vehicles and shall not extend beyond the time necessary therefor, and in no event for more than twenty 20) minutes. b) The loading or unloading of materials shall apply only to commercial deliveries, also the delivery or pickup of express and parcel post packages and United States mail. 16- ORD 113ê79wV ×Pç€ c) Permission herein granted to stop or park for purposes of loading or unloading passengers shall in- clude the loading or unloading of personal baggage but shall not extend beyond the time necessary there- for and in no event for more than three 3) minutes. d) Within the total time limits above specified, the provisions of this section shall be enforced so as to accommodate necessary and reasonable loading or unloading but without permitting abuse of the privileges hereby granted. 3371. Standing for Loading or Unloading Only. No person shall stop, stand or par a ve c e n an loading zone for any purpose other than loading oryunload- ing passengers or material for such time as is permitted in Section 3370. 3372. Standing in Passenger Loading Zone. No person shall stop, stand or par a vehicle n any passenger load- ing zone for any purpose other than the loading or unloading of passengers for such time as is specified in Section 3370. 3373. Standing in Any Alley. No person shall stop, stand or par a vehicle or any purpose other than the loading or unloading of persons or materials in any alley. 3374. Bus Zones to be Established. a) The City Engineer shall recommend and the City Council may approve the establishment of bus zones opposite curb space for the loading and un- loading of buses or common carriers of passengers and to determine the location thereof subject to the directives and limitations set forth herein. b) The word bus" as used in this section shall mean any motor bus, motor coach, trackless trolley coach, or passenger stage used as a common carrier of passengers. c) Bus zones shall normally be established on the far side of an intersection. d) The City Engineer shall paint a red line stencil with white letters NO STANDING", together with the words BUS ZONE11 upon the top or side of all curbs and places specified as a bus zone. e) No person shall stop, stand or park any vehicle except a bus in a bus zone. Part 12 RESTRICTED USE OF CERTAIN STREETS 3375. Advertising Vehicles. No person shall oper- ate or drive any vehicle use or advertising purposes or any advertising vehicle equipped with a sound-ampli- fying or loud-speaking device upon any street or alley within any business district, except as provided under Section 4249 of this Code. 3376. Truck Routes. a) Whenever any ordinance of this City desig- nates and describes any street or portion thereof 17- ORD 113ê79wV ×Pç€ as a street, the use of which is permitted by any vehicle exceeding a maximum gross weight limit of five 5) tons, the City Engineer is hereby authorized to designate such street or streets by appropriate signs as Truck Traffic Routes" for the movement of vehicles exceeding a. maximum gross weight limit of five 5) tons. b) When any such truck traffic route or routes are established and designated by appropriate signs, the operator of any vehicle exceeding a maximum gross weight limit of five 5) tons shall drive on such route or routes and none other, except that nothing in this section shall prohibit the operator of any vehicle exceeding a maximum gross weight of five 5) tons coming from a Truck Traffic Route" having ingress and egress by direct route to and from restricted streets when necessary for the pur- pose of making pick-ups or deliveries of goods, wares and merchandise from or to any building or structure located on such restricted streets or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodel- ing or construction of any building or structure upon such restricted streets for which a building permit has previously been obtained therefor. c) The provisions of this section shall not apply to: 1) Passenger buses under the jurisdic- tion of the California Public Utilities Commis- sion; or to 2) Any vehicle owned by a public utility while necessarily in use in the construction, installation or repair of any public utility. d) When signs are erected giving notice thereof, the following streets or portions of streets are hereby declared to be truck traffic routes for the movement of vehicles exceeding a maximum gross weight of five 5) tons: 3377. Commercial Vehicles Prohibited from Using Certain Streets. a) Whenever any ordinance of this City desig- nates and describes any street or portion thereof as a street the use of which is prohibited by any commercial vehicle, the City Engineer shall erect and maintain appropriate signs on those streets affected by such ordinance. The provisions of this section shall not apply to passenger buses under the jurisdiction of the California Public Utilities Commission. b) Commercial Vehicles Prohibited. The fol- lowing streets an parts o streets are hereby declared to be streets the use of which is prohibited by any commercial vehicle: 18- ORD 113ê79wV ×Pç€ Part 13 TRAINS 3378. Railway Gates. No person shall drive any vehicle through, arou- nT, 6_r under any crossing gate or barrier at a railroad grade crossing while such gate or barrier is closed or is being opened or closed. 3379. Trains Not to Block Crossings, It shall be unlawful for any person to cause or permit any railway train or railway cars or similar vehicle on rails to operate or to be operated in such a manner as to prevent the use of any street for the purpose of travel for a period of time longer than ten 10) minutes, except that this provision shall not apply to railway trains, cars or similar vehicles on rails while blocking or obstruct- ing a crossing because of an accident which requires the operator of the train, car or similar vehicle on rails to stop at or near the scene of the accident. Part 14 SPECIAL SPEED ONES 3380. Increasing State Seed Limit in Certain Zones. It is hereby determined upon the basis o an engineering and traffic investigation that speed permitted by state law upon the following streets is less than is necessary for safe operation of vehicles thereon by reason of the designation and sign-posting of said streets as through highways and or) by reason of widely spaced intersec- tions, and it_is hereby declared that the prima facie speed limit shall be as hereinafter set forth on those streets or parts of streets herein designated when signs are arected giving notice thereof: Name of Street or Declared Prima Portion Affected Facia Speed Limit 3381. Decrease of State Law Maximum Speed. It is hereby determined upon the basis of an engineering and traffic investigation that the speed permitted by state law outside of business and residence districts as applic- able upon the following streets is greater than is reason- able or safe under the conditions found to exist ucon smch streets, and it, is hereby declared that the prima facie speed limit shall be as herein set forth on those streets or parts of streets herein designated when signs are erected giving notice thereof: Name of Street or Declared Prima Portion Affected Facie Speed Limit ORD 113ê79wV ×Pç€ 3882. Section 3. That Chapter 8, Article I of said Municipal Code, entitled TRAFFIC AND SAFETY COMMISSION" and consisting of Sections 2800 to 2808, inclusive, is repealed. Section 4-. The City Clerk shall certify to the adoption of this ordinance and cause the same to be pub- lished or posted in the manner required by law.
