Home My WebLink AboutORD 114ORD 114ê79wV ×Pç— 7~0 ORDINANCE NO. 114 T 1' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTIONS 1'y 8101.5, 8102, 8107, 8112.3, 8201, 8904, r 8962, AND 8963 OF THE BALDWIN PARK MUNICIPAL CODE TO IMPLEMENT THE TRANSFER OF BUILDING AND PLUMBING INSPECTION FUNC- TIONS FROM THE COUNTY TO THE CITY. The City Council of the City of Baldwin Park does ordain as follows: Section 1. That Sections 8101.5, 8102, 8107, and 8112.3 of the Baldwin Park Municipal Code are amended to read as follows: 8101.5. Amending Section- 201, Section 201 of said Uniform BuiMding Code is hereby amended to read: Section 201. There is hereby established in the City of Baldwin Park a Building Department under the direction of a Superintendent of such department appointed by the Chief Administrative Officer with the approval of the City Council." 8102. Definitions, Whenever any of the follow- ing names or terms are used in said Uniform Building Code or in this Municipal Code, each such name or term shall be deemed and construed to have the meaning ascribed to it in this section, as follows: Building Official" shall mean the official in charge of the City's Building Department. Building Department or Division" shall mean the Building Department of the City of Baldwin Park. Fire Department" shall mean the Fire Preven- tion Bureau of Los Angeles County, 8107. Section 204 of said Uniform Building Code is amended to read: Section 204, Board of Appeals, In order to determine the suitability offal ernaz e materials and types of construction and to provide for reason- able interpretations of the provisions of this Code, there shall be and is hereby created a Board of Appeals, consisting of five members who are quali- fied by experience and training to pass upon matters pertaining to building construction. The Building Official shall be an ex-officio member and shall act as Secretary to the Board. The Board of Appeals shall be appointed by the City Council and shall hold office at its pleasure. The Board shall adopt reasonable rules and regulations for conducting its investigations and shall render all decisions and findings in writing to the Building Official with a duplicate copy to the appellant and may recommend to the City Council such new legislation as is con- sistent therewith. 1- ORD 114ê79wV ×Pç— 8112.3. Section 405 of said Uniform Building Code is amended by adding the following definition thereto: DIVISION where consistent with the context means the Building Department of the City of Baldwin Park. Section 2. That Section 8201 of said Municipal Code is amended by amending Section 4, subsection b) of Section 57, and subsection b) of Section 72 of the Uniform` Plumbing Code shown therein, to read as follows: Sec. 4. USE OF TERMS. Whenever the term Chief Plumbing Inspector," Plumbing Inspector" or Administrative Authority" is used in this Code, such term shall be construed to mean the Superintendent of the Building Depart- ment of the City of Baldwin Park or his authorized representative. Sec. 57. ISSUANCE OF PERMITS. b) A permit may be issued to the owner of the legal,or equitable title to any property on which he resides or intends to reside and which is used primarily for single or two-family residence purposes, together with accessory buildings which are occupied or designed to be occupied by said owner, to install, alter or repair any plumbing on, in or in connection with said property, provided the bald installation, alteration or repair is done by himself, a member of his immediate family, or by the possessor of a valid City of Baldwin Park Certificate of Registration covering the acts performed. Sec. 2. DEFINITIONS. b) CERTIFICATE OF REGISTRATION. A certifi- cate issued by the Chief Plumbing Inspector to quali- fied persons not otherwise regulated by the Business and Professions Code of the State of California states that the holder thereof is entitled to act and serve in the City of Baldwin Park as a Plumbing, Gas Fitting, or Sewerage Contractor, or as a Journeyman Plumber or Gas Fitter, as the case may be. Section 3. That the opening paragraph of Section 8904 of said Municipal Code is amended to read as follows: Before using a trailer coach as provided in Section 8902 e), a person shall first obtain a per- mit to do so from the Superintendent of the City's Building Department. To obtain such permit, an application in writing shall be filed with said Superintendent, which shall: Section 4. That Sections 8962 and 8963 of said. Municipal Code are amended by changing the references there- in to County Building and. Safety Division" to read City's Building Department." 2- ORD 114ê79wV ×Pç— Section 5. That this ordinance is declared to be an emergency ordinance for the immediate preservation of the public peace, health, and safety. The facts constituting the urgency are as follows: The City is taking over the inspection and enforcement of its building and plumbing regulations on July 1, 1959. This ordinance provides for the transfer of these functions from the County to the City. The only way this ordinance can become effective in sufficient time for the transfer is by an emergency ordinance. Section 6. The City Clerk shall certify to the adoption of this ordinance and, shall cause the same to be published or posted as required by law. This ordinance shall take effect immediately upon its adoption.
