HomeMy WebLinkAboutORD 135ORD 135ê79wV ×Pçö ORDINANCE NO. 135 AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED ANNEXATION NO. 9" TO THE CITY OF BALDWIN PARK. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BALDWIN PARK: WHEREAS, on the 2nd day of November, 1959, the City Council of the City of Baldwin Park did pass and adopt Reso- lution No. 59-114, giving notice of the proposal to annex certain uninhabited territory to the City of Baldwin Park, said territory being therein designated as Annexation No. 9," said Resolution describing the boundaries of the territory proposed to be annexed; and WHEREAS, said Resolution No. 59-114 did contain a notice of the day, hour and place when and where the Council of the City would hear protests made by any person owning real property within the territory proposed to be annexed; and WHEREAS, the owners of all of the territory to be annexed have petitioned for said annexation; and WHEREAS, the requirements of Section 35311 of the Annexation of Uninhabited Territory Act of 1939 were complied with prior to said hearing date; and WHEREAS, on the 7th day of December, 1959, at the hour of 8:00 P.M., in the Council Chambers in the City Hall of the City of Baldwin Park, County of Los Angeles, State of California, said time and place being the day, hour and place fixed in said Resolution No. 59-114 for hearing protests to the said annexation, the said City Council did hear and pass upon all protests made to the proposed annexation and did de- termine that protests had not been made by the owners of one- half of the value of the privately owned territory proposed to be annexed as shown by the last equalized assessment roll, nor by public owners of one-half of the value of the publicly owned territory proposed to be annexed as determined by said legislative body; and 1- ORD 135ê79wV ×Pçö WHEREAS, said territory is contiguous to the City of Baldwin Park and is uninhabited territory in the County of Los Angeles, NOW, THEREFORE, the said City Council of the City of Baldwin Park does hereby approve the annexation of the terri- tory hereinafter described to the City of Baldwin Park, and does hereby further ordain that the said territory be and is hereby annexed to the City of Baldwin Park. That said territory, the annexation of which to the City of Baldwin Park is herein approved, is all that territory situate in the County of Los Angeles, State of California, more particularly described as follows: That portion of Lot 48 of Tract 718, in the County of Los Angeles, State of California, as per map recorded in Book 17, Page 17 of Maps, in the office of the County Recorder of said county, described as follows: Beginning at a point in the northeasterly line of said lot distant thereon South 51°33'14" East, 57.42 feet from the most northerly corner of said lot; thence along said northeasterly line South 51° 33'14" East, 869.94 feet to the most easterly cor- ner of said lot; thence along the southeasterly line of said lot, South 38°29'34" West, 85.00 feet to a point which is distant along said southeasterly line North 38°29'34" East, 61.38 feet from the in- tersection of said southeasterly line with the northerly sideline of the land conveyed to the Los Angeles County Flood Control District in Parcel 116 in a final Order of Condemnation had in Superior Court Case No. 625315, a certified copy of which is recorded in Book 51842, Page 354, of Official Records in the office of said Recorder; thence at right anles from said southeasterly line, North 51°301 2611 West, 20.00 feet; thence parallel with said southeasterly line, South 38°29'34" West, 82.36 feet to said northerly sideline of the land con- veyed to the Los Angeles County Flood Control Dis- trict; thence continuing on said parallel line South 38°29'34" West, 50.72 feet to a line which is parallel with and distant southerly 35 feet, measured at right angles, from said northerly side- lines; thence along said last described parallel line South 82°07'39" West, 185.70 feet to a line which is at right angles to said northerly side- line and passes through a point in said northerly sideline distant thereon, South 82°07139" West, 251.49 feet from the intersection of said north- erly sideline with the southeasterly line of said lot; thence at right angles North 7°52'21" West, 35 feet to said northerly sideline; thence along said northerly sideline, South 82°07'39" West, 219.16 feet to an angle point in said northerly sideline; thence along the boundary of the land conveyed in said Parcel 116, North 7°52121" West, 2- ORD 135ê79wV ×Pçö 100.00 feet to the northerly line of the strip of land 500 feet wide as described in said Parcel 116; thence along said last mentioned northerly line, South 82°07139" West, 452.29 feet to its intersection with the Southeasterly line of Lots 59 and 19, Tract 14056, as per map recorded in Book 300, Page 24 of said Maps; thence along said lot lines North 38°29'34" East, 333.75 feet to the most easterly corner of said Lot 19; thence North 51°33114" West, 75 feet to the most southerly corner of Lot 18, said Tract 14056; thence North 38°29134`1 East, 230.00 feet to the most easterly corner of said Lot 18; thence North 51°33114" West 125 feet to the most southerly corner of Lot 48, Tract 13211, as per map recorded in Book 270, Page 14 of said Maps; thence North 38°29141", East, 200.00 feet to the most northerly corner of Lot 48, said Tract 718; thence South 51°33114" East, 57.42 feet to the point of beginning. EVA ELDER PUGH My CommOs-i~n Ch 6. 1963 ORD 135ê79wV ×Pçö ORDINANCE NO. 138-A AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE PROCEDURE FOR GRANTING EXCEPTIONS TO YARD AND BUILDING SETBACK REQUIREMENTS WITHOUT PUBLIC HEARING. The City Council of the City of Baldwin Park does ordain as follows: Section 1. That the Baldwin Park Municipal Code is amended by adding a new section designated Section 9100.535.1 to Part 2, Division V of Chapter 1, Article IX, known as the Interim Zoning Ordinance, to read as follows: Section 9100.535.1. YARD AND BUILDING SETBACK EXCEPTIONS. The Superintendent o e Building Depart- men with the approval of the Chief Administrative Officer, may grant exceptions from the yard and building setback requirements of this chapter without a public hearing where topographic features, subdivision plans, or other conditions create an unnecessary hardship, make the regulation unreasonable, or make it obviously imprac- tical to require compliance therewith, and because of special circumstances applicable to the property, including size, shape, topography, location or surround- ings, the strict application of the setback requirement is found to deprive the property of privileges enjoyed by other properties in the vicinity and under identical zone classification. For the purposes of this section, the Superintendent of the Building Department is hereby designated Zoning Administrator. Exceptions granted under this section shall be subjected to such conditions as will assure that they shall not constitute a. grant of special privilege inconsistent with the limitations on other properties in the vicinity and zone in which the subject property is located. The action of the Superin- tendent of the Building Department may be appealed to the City Council by filing a notice of appeal with the City Clerk within fifteen 15) days from the time the Superintendent has acted, The Superintendent shall notify the City Council in writing of all exceptions granted and reasons therefor. Section 2. That Section 9100.456 of said zoning ordinance is repealed. Section 3. That this ordinance is declared to be an emergency ordinance for the immediate presentation of the public peace, health, and safety. The facts constituting 1- ORD 135ê79wV ×Pçöthe emergency are as follows: The Interim Zoning Ordinance requires a 15-foot side yard building line setback when residences are constructed on residentially zoned property or A-1 property abutting A-1 property. The intent of the City Council was to require such setback only when certain agricultural uses existed on the abutting A-1 property. Pending an amendment to give effect to this-intent, several property owners have applied for an exception from the set- back requirement. At present, Section 9100.456 of the Interim Zoning Ordinance authorizes the City Council, City Engineer, and Planning Director to grant such exceptions. The purpose of this amendment is to place such authority solely in the Superintent of the Building Department and to clarify that such exceptions may be granted without pub- lic hearing. This ordinance does not amend the present set- back requirements. Section 4. The City Clerk shall certify to the adoption of this ordinance and shall cause the same to be published as required by law. This ordinance shall take effect immediately upon its adoption.
