HomeMy WebLinkAboutORD 183ORD 183ê79wV ×PèÓ ORDINANCE NO 183 AN ORDINANCE TO AMEND SECTIONS 7100.1, 7103.1, 7203.6, 7303, 7401.1, 7402, 7402.5, 7502, 7502.1 AND TO DELETE SECTIONS 7103.3, 740.1, 7402.2, 7402.3, 7402.4; TO RENUMBER SECTIONS 7103.4, 7103.5, 7103.6, 7402.5 AND 7402.6 OF THE MUNICIPAL CODE OF THE CITY OF BALDWIN PARK RELATING TO ISSUANCE AND ENGINEERING FEES; DECLARING THE URGENCY THEREOF, TO TAKE EFFECT IMMEDIATELY. The City Council of the City of Baldwin Park does ordain as follows: Section 1. Section 7100.1 of the Baldwin Park Municipal Code is amended to read: 7100.1 Title. City Engineer. City Engineer" shall mean the person appointed by the City of Baldwin Park to perform the duties of Engineer for the City as prescribed by this article and in- cludes the Superintendent of Streets. Section 2. Section 7103.1 of the Baldwin Park Municipal Code is amended to read: 7103.1 Same. Exception. If this state or any political subdivision thereof files with the City Engineer a written guarantee of payment of all costs for which it might become liable to the City, then neither any issuance fee nor deposit shall be required. Section 3. Section 7203.6 of the Baldwin Park Municipal Code is amended to read: 7203.6 Same. Deductions and Refunds. The City shall deduct from the deposit made or maintained by each permittee: a) The cost of services and transportation of any inspector appointed pursuant to Section 7209. b) The cost of any repairs made necessary because of the moving of the building or structure; and 7f~ ORD 183ê79wV ×PèÓ c) The total cost of all tree trimming done by the City Engineer or under his supervision made necessary in order to move the building or structure as specified in the permit, in- cluding all such trimming after the moving of the building or structure in order to correct any damage or trimming done when the structure was moved. Section 4. Section 7303 of the Baldwin Park Municipal Code is amended to read; 7303. Fees. Except in the case of con- struction under contract with the City where a faith- ful performance bond is posted which guarantees to the City the repair of any street, including construction financed in whole or in part by special assessments, each applicant applying for a permit in addition to pay- ment of the issuance fee prescribed by law, shall de- posit with the City Engineer a sum of money, in no event to be less than $10.00, which is twice the estimated cost to the nearest $5.00 of repairing the surface of the street which may be damaged or destroyed by the proposed excavation or obstruction. The cost shall be estimated by multiplying the number of square feet of surface area which may be damaged, as shown by the application and plat, times the number of inches of thicknesses, plus one inch,times such unit sum as the City Engineer de- termines to most adequately represent the actual cost. Such determination of actual unit cost shall in no event specify a unit sum greater than $.25. The City Council may by ordinance or resolution change or revise such max- imum unit sum from time to time. In the absence of any determination of unit cost it shall be $.15. Section 5. Section 7401.1 of the Baldwin Park Municipal Code is amended to read; 2- ORD 183ê79wV ×PèÓ 701.1 Same. If, in the opinion of the City Engineer, the work proposed to be done requires the making of plans, the setting of stakes, the establishment of grades, or any of them, the City Engineer may require the application to be accompanied by the necessary plans, which plans shall be prepared by a licensed engineer. The City Engineer may authorize personnel of his depart- ment to prepare plans, set stakes, or establish grades, or any of them, at the request of the applicant, how- ever, if any grades are established by City personnel, including the setting of stakes, in addition to any fees or deposit required by this article, the applicant shall pay an additional fee in accordance with the schedule adopted by the City Council and shall pay the City a fee equal to the actual cost for the preparation of plans. Section 6. Section 7402 of the Baldwin Park Municipal Code is amended to read: 7402. Fees. An applicant for a permit to con- struct any work shall pay an issuance fee at the time of filing the application in accordance with the issuance fee schedule as adopted by the City Council. Section 7. Section 7402.5 of the Baldwin Park Municipal Code is amended to read: 7402.5 Same. When a permit has been revoked by the City Engineer, the permittee may obtain a refund of any unused deposit made by him. No part of any is- suance fee may be refunded. Section 8. Section 7502 of the Baldwin Park Municipal Code is amended to read: 7502. Fees. An applicant for a permit to erect or maintain an overhead structure shall pay an issuance fee in accordance with the schedule adopted by the City Council and in addition shall deposit with the City Engineer an amount estimated by the City Engineer to be equal to twice the actual cost of all necessary 3- ORD 183ê79wV ×PèÓ engineering and inspection, and repair of any sidewalk or street surface which may be injured by such con- struction. Section 9. Section 7502.1 of the Baldwin Park Municipal Code is amended to read: 7502.1 Same. The City Engineer shall deduct from the deposit the amount of the actual cost to the City of the required engineering and inspection and of repairing any sidewalk or street surface damaged by such construction. If such cost is less than the deposit, the City Engineer shall refund the difference to the person making the deposit, in the same manner as provided by law for the repayment of trust monies. If the cost exceeds the deposit, the permittee shall pay to the City any such excess within fifteen days after receiving a statement of such excess from the City Engineer. Section 10. Sections 7103.3, 7402.1, 7402.2, 7402.3 and 7402.4 of the Baldwin Park Municipal Code are repealed. Section 11. Sections 7103.4, 7103.5, 7103.6, 7402.5 and 7402.6 are renumbered as follows: 7103.4 to 7103.3; 7103.5 to 7103.4; 7103.6 to 7103.5; 7402.5 to 7402.1; 7402.6 to 7402.2 Section 12. This ordinance is passed as an emergency measure, and the Council does, by the vote by which this ordinance is passed hereby declare than an emergency exists which makes it imperative that this ordinance should become effective forthwith in order that the public health, welfare, and safety might most ef- fectively be provided for.
