AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK ESTABLISHING
A SEWER IMPROVEMENT AND EXTENSION FUND;
PROVIDING FOR THE DEPOSIT THEREIN OF
SEWER CONNECTION CHARGES AND ESTABLISH-
ING A REDUCTION OF SUCH CHARGES WHERE A
FUTURE STREET IS INVOLVED, ADDING SECTIONS
2504, 2505 and 2506 TO THE BALDWIN PARK
MUNICIPAL CODE.
The City Council of the City of Baldwin Park does
ordain as follows:
Section 1. Sections 2504, 2505, and 2506 are hereby
added to the Baldwin Park Municipal Code to read as follows:
2504. Special Sewer Improvement & Extension Fund.
There is hereby created in the City Treasury a special fund to
be known as Sewer Improvement and Extension Fund."
2505. Same Deposits & Expenditures."
All monies received by the City for sewer connection charges
shall be paid into said fund and all monies in said fund shall
be expended exclusively for the improvement and extension of
sewers within the City limits of the City of Baldwin Park.
2506. Refunds and Credits on Future Streets.
If the General Plan or any Precise Plan delineates a portion
of the property upon which the sewer connection charge is
levied as a future street at the time of such levy, the sewer
connection charge may be reduced by an amount determined by
multiplying the ratio of the future street area to the total
property area times the total connection charge. The reduction
may be refunded in--cash to the person paying the sewer con-
nection charge or may be credited to such person or his assigns,
the method of said reduction being at the election of the
Chief Administrative Officer of the City.
Section 2. The City Clerk shall certify to the
adoption of this ordinance and cause the same to be published or
posted in the manner required by law. This ordinance shall take
effect thirty days after the date of its adoption.
