HomeMy WebLinkAboutORD 210ORD 210ê79wV ×Pêt ORDINANCE NO 210 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTIONS 2903 AND 2904 AND ADDING SECTION 2908 TO THE BALDWIN PARK MUNI- CIPAL CODE PERTAINING TO THE POWERS AND DUTIES OF' THE CHIEF ADMINISTRATIVE OFFICER, AND ADDING SECTION 2105 TO THE BALDWIN PARK MUNICIPAL CODE RELATING TO THE RIGHT OF EMPLOYEES TO APPEAL FROM AN ORDER OF SUSPENSION OR REMOVAL The City Council of the City of Baldwin Park does hereby ORDAIN as follows: Section l. Sections 2903 and 2904 of the Baldwin Park Municipal Code are hereby amended to read as follows: 2903. Removal of Chief Administrative Officer. The City Council may remove the Chief Administrative Officer at any time by a majority vote of its members. 2904. Powers and Duties of Chief Administrative Officer. The Chief Administrative Officer shall be the Chief Administrative Officer of the City. He may head one or more departments and shall be responsible to the City Council for the proper administration of all affairs of the City. To that end, he shall have power and shall be required to: a) With the approval of the City Council ap- point and, when necessary for the good of the City, suspend or remove department heads and assistant department heads, including the Chief of Police, Planning Director, Finance Officer, City Engineer, Director of Civil Defense and such other specifically named department heads and assistant department heads as the City Council may from time to time determine by minute action. Appoint, and when necessary for the good of the City, suspend or remove all other officers and employees of the City, except the City Clerk, City Treasurer, City Attorney, and officers or employees whose appointment is otherwise provided...by law. ORD 210ê79wV ×Pêt may delegate to any department head or officer ap- pointed by him the authority to appoint, suspend, or remove subordinates serving under such depart- ment head or officer. b) Prepare the budget annually and submit it to the Council together with a message describing the important features and be responsible for its administration after adoption. I c) Prepare and submit to the Council as of the end of the fiscal year, a complete report on the finances and administrative activities of the City for the preceding year. d) Prepare and distribute to the City Council a quarterly report and monthly summary of the fi- nancial condition of the City, advise the City Council of the future needs of the City and make such recom- mendations as he may deem desirable. e) Recommend to the governing body a standard schedule of pay for each appointive office and po- sition in the city service, including minimum, in- termediate and maximum rates. f) Recommend to the governing body from time to time) adoption of such measures as he may deem necessary or expedient for the health, safety, or welfare of the community or for the improvement of administrative services. g) Consolidate or combine offices, positions, departments, or units under his jurisdiction, with the approval of the City Council. The Chief Adminis- trative Officer may be the head of one or more de- partments. h) Attend all meetings of the City Council un- less excused therefrom and take part in the discussion of all matters coming before the Council when re- quested by the Council. He shall be entitled to notice of all regular and special meetings of the 2- ORD 210ê79wV ×PêtCouncil. i) Supervise the purchase of all materials, supplies, and equipment for which funds are pro- vided in the budget; let contracts necessary for operation or maintenance of city services for amounts up to and including $300.00; receive bids for purchases or contracts in excess of $300.00 and present them to the Council for approval, and advise the Council, on the advantages or disad- vantages of contract and bid proposals. No purchase shall be made, contract let or obligation incurred for any item or service which exceeds the current budget appropriation without a supplemental ap- propriation by the Council. No contract in excess of $300.00 and no contract for new construction shall be let except by the City Council. the Chief Administrative officer may issue such rules govern- ing purchasing procedures within the administrative organization as the Council shall approve. j) See that all laws and ordinances are duly enforced. k) Investigate the affairs of the City or any department or division thereof. Investigate all complaints in relation to matters concerning the administration of the government of the City, and in regard to service maintained by the public utili- ties in the City, and see that all franchises, per- mits, and privileges granted by the City are faith- fully observed. 1) Devote his entire time to the discharge of his official duties. m) Keep the members of the City Council informed at least once a week of the administrative affairs and happenings of the City. n) Perform such other duties as may be required 3- ORD 210ê79wV ×Pêt by the Council, riot inconsistent with the State law or the Baldwin Park Municipal Code. Section 2. Sections 2908 and 2105 are hereby added to the Baldwin Park Municipal Code to read as follows: 2908. The City Council may adopt or amend by ordi- nance or resolution a system of personnel rules and regu- lations. Chapter 1A 2105. Officers and employees appeals from suspension or removal. Any officer, department head or employee of the City who has been suspended or removed may appeal such order of suspension or removal to the City Council by filing with the City Clerk a notice of appeal in writing. Such notice of appeal must be filed within five 5) days from the date of the order of suspension or removal, and said notice shall contain the name of the appellant, name of department head, date of suspension or removal, person ordering suspension or removal, the position held by the appellant, the stated reasons for suspension or removal, the grounds upon which the appeal is made and such other pertinent information as may be required by the City Council.
