HomeMy WebLinkAboutORD 278ORD 278ê79wV ×Pï$ ORDINANCE NO. 278 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTIONS 6700.3, 6700.4, 6700.5 AND 6700.8 OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO CHARITABLE AND RELIGIOUS SOLICITATION PERMITS The City Council of the City of Baldwin Park does ordain as follows: SECTION 1. That Sections 6700.3, 6700.4, 6700.5 and 6700.8 are hereby amended to read, respectively, as follows: 6700.3. Same. Investigation. Upon receipt of such an application, the City Clerk shall refer the same to the Police Department for investigation. After the investigation has been completed, the Chief of Police or his authorized Deputy, shall transmit copies of his report to the Chief Administrative Officer through the City Clerk. 6700.4. Same. Processing. Upon receipt of the applica- tion and the investigation report, the Chief Administra- tive Officer shall consider the sane, together with any other information he may deem relevant to the application, and thereafter he shall either grant or deny such permit in accordance with the provisions of this Section: a) issuance. If the Chief Administrative Officer finds that the application is truthful, that the applicant is acting in good faith, and that, in all probability, a fraud would not be perpetrated upon the public, he shall issue to the applicant a permit for such period of time not to exceed three months from the date of issuance of such permit. If the circumstances of the particular application so require, the Chief Administrative Officer may require the applicant to post a bond with the City Clerk, in a sum not to exceed $1,000.00 in a form to be approved by the City Attorney, conditioned so that if applicant should fail to devote, pay or use the entire proceeds or percentage thereof, as specified in the application, derived from the activity, to the person for or on whose behalf, such activity was carried on as indicated in the application, that the surety on such bond shall pay to such person the amount thereof. b) Denial. The Chief Administrative Officer shall re- fuse the issuance of such a permit if he finds that the applicant has not stated true facts in his application, or that if a permit were to be issued to the applicant, a fraud, in all probability, would be perpetrated upon the public. c) Appeal. If the Chief Administrative Officer refuses to issue a permit, for any reason, he shall notify the applicant of the fact of such denial, together with the reason therefor, in writing, by depositing in the United States Mail, postage prepaid, a letter directed to the applicant at his last known address. In a case of such denial, the applicant shall have the right to appeal the decision to the City Council within ten days from the mailing of the notice of denial by the Chief Administra- tive Officer, the applicant may file a letter of appeal with the City Clerk. Upon receipt of such letter of appeal, the City Clerk shall place the matter on the Council's agenda for hearing as soon as is possible, and shall give to applicant five days' written notice of the time and place of such hearing. At the time of such hearing, the Council shall examine the applica- tion, the investigation report and such other evidence as may be deemed relevant and shall give the applicant an opportunity to present evidence relating to the application itself." 6700.5. Same. Exception. Separate permits shall not be required for any of the acts described in Sections 6700 and 6700.1 hereof, by the members of any religious or charitable organization which has been in existence in, or which regularly has maintained a headquarters or place of worship within the City, for a period of at least five years next preceding the date on which such activity is proposed to be commenced; provided that the organization has been issued a permit authorizing such acts. Permits issued to such organizations shall be valid until suspended or revoked. Issuance of such per- mit shall not be a waiver of any other provision of this code." 6700.8. Same. Hours of Solicitation. No person shall conduct any of the activities described in Sections 6700 and 6700.1 hereof, prior to the hour of 9:00 A.M. or after the hour of 9:00 P.M. on any day of the week. SECTION 2. The City Clerk shall certify to the adoption of this ordinance and cause the same to be published or posted in the manner pre- scribed by law. PASSED and APPROVED this 5 day of Jure 1963. Hub H.
