AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK AMENDING SECTION
9120.41, TO THE BALDWIN PARK MUNICIPAL
CODE, RELATING TO THE EXPIRATION PERIOD
FOR CONDITIONAL USE PERMITS AND ZONE
VARIANCE CITY INITIATED; CASE AZC-5).
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN
AS FOLLOWS:
SECTION 1. That Section 9120.41 of the Baldwin Park
Municipal Code is amended to read as follows:
Section 9120.41 EXPIRATION. Any Zone Variance or
Conditional Use Permit shall U e null and void if the use
permitted thereunder, is not exercised within the time
specified in the resolution approving such Zone Variance
or Conditional Use Permit, or, if no time is specified,
if the same is not exercised within six 6) months from
the date said Variance of Conditional Use Permit is
granted. The Planning Commission or City Council, upon
good cause shown by the applicant, may extend the time
limitations imposed by this section for a period not to
exceed six 6) months, provided the request for the
extension of the period is submitted to the Planning
Department prior to expiration for the said Variance
or Conditional Use Permit."
SECTION 2. That the City Clerk shall certify to the
adoption of this Ordinance and cause the same to be published
or posted in the manner prescribed by law.
