AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTION 3377.1 OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO TRUCK ROUTES. T CITY COUNCIL OF' THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS. SECT N 1. That Section 3377.1 of the Ba~ldwin Park Municipal Cod is hereby amended to read as follows: 3377.x,. Truck Route Permits. a) Pe its. Notwith- standing;,t e provisions o ection 7 this Code, the Chie of Police, in the exercise of his sound discretio shall issue truck route hermits to any resident o the City, who, prior to~the adoption of that Sectio maintained a vehicle,'on his property exceeding 60 0 pounds of gross weight, when he finds the followin facts to exist: x) That the applica- tion of said ction imposes an-extreme hardship upon such an i ividual; and that the issuance of such permit l l not cause,'any damage to any streets or highw s proposed,to be used, and will have no detriment 1 effect typon surrounding proper- ties which may be affected thereby. b) Application. Pgrmitg shall be issued only upon a written application,thOYrefor, containing the infor- mation deemed necessa~-by the Chief of Police. A filing and processing e of $ shall be paid prior to the issVaice of a permit. c) Routes. Vehic s. ach such permit shall designate a direct oute, o be established by the Chief of Police, from the c osest truck route, as set forth in Section 33'77 hereof to the applicant's place of business or residence; wh issued, the permit holder may use the streets.dee,ribed in said permit notwithstanding the provisions'aof Section 3377. A separate permit shall be requirl d for each vehicle, and shall be maintained in such vehicle. Permits shall be valid for a period of si months, and may be renewed for a like period of tie. d) Appeo1. Whenever the Chief decd ines to issue a permit heteunder, oz- imposes a route not satisfactory to the applicant, such individual may;,, within thirty days after receiving written notice fr6m the Chief, of such action by him, appeal such action to the City Council, by filing a letter of appeal with the City ClerV. Thereafter, the Clerk shall set tl~e matter on the Council agenda for consideration. the Clerk shall give the appellant at least five days written notice of the time and place of such hearing,,. e) Hearing. At the time set for hearing of',such appea tt~e Council shall give the appellant, and f, any other interested person, a reasonable opportunity to be heard with regard to such matter.
