ORDINANCE NO. 373
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK ADDING SECTION 4265
TO THE BALDWIN PARK MUNICIPAL CODE, PRO-
HIBITING FORTUNE TELLING WITHIN THE CITY;
AND CONTAINING A STATEMENT OF FACTS AND
A DECLARATION OF THE URGENCY OF THIS
ORDINANCE.
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS
FOLLOWS:
SECTION 1. That Section 4265 is hereby added to the Baldwin
Park Municipal Code, to read as follows:
4265. Fortune Telling. No person shall carry on, practice
or profess to practice the business or art of astrology,
phrenology, life reading, fortune telling, clairvoyance,
clairaudience, crystal gazing, hypnotism, mediumship,
mesmerism, oriental mysteries, palmistry, spirit photography,
spirit writing, spirit voices, spirit materialization,
etherealization, numerology, physiognomy, psychometry
seership, prophecy, augury, divination, magic, or other
similar art or business, who demands or receives directly
or indirectly a fee or reward, or who accepts any donation
for the exercise or exhibition of his art therein, or who
gives an exhibition thereof at any place where an admission
40 fee, donation, or reward is charged or received, directly
or indirectly, or who teaches or gives instruction in any
such art or business and demands or receives, directly or
indirectly, a fee or reward, or who accepts any donation
for such teaching or instruction.
SECTION 2. That this ordinance is hereby declared to be an
urgency ordinance, and shall take effect immediately. A statement
of facts, constituting the basis for its said urgency is as follows:
a) That the acts prohibited by Section 4265, as above set
forth, if permitted within the City, would permit the perpet-
ration of frauds upon members of the general public; and
b) That said acts, as hereinabove described, constitute a
continual police problem, and the participation therein, would
require constant police supervision to prevent the perpetration
of confidence games and similar schemes involving the defraud-
ing of innocent members of the general public; and
c) That if this ordinance is not adopted immediately, a
number of persons will commence and engage in the activities
as proposed to be prohibited by the said section of the Baldwin
Park Municipal Code as set forth above; and
d) That this ordinance is immediately required for the preser-
vation of the public peace, health, safety and general welfare.
SECTION 3. That the City Clerk shall certify to the adoption of
this ordinance and cause the same to be published in the manner prescribed
by law.
