HomeMy WebLinkAboutORD 390ORD 390ê79wS ×Pë¿ ORDINANCE NO. 390 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTION 9212 OF THE BALDWIN PARK MUNICIPAL CODE, RELATING TO THE APPROVAL OF TENTATIVE TRACT MAPS. THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 9212 of the Baldwin Park Municipal Code is hereby amended to read as follows: 9212. APPROVAL OF TENTATIVE MAPS. Tentative tract maps shall be submitted to the Planning Commission for its consideration. The said Commission, upon receiving such a tentative tract map, shall recommend to the City Council, the approval, conditional approval or the denial of any such map. In the case of a recommendation for conditional approval, the Commission shall include in such recommendation, the suggested conditions of approval. Thereafter, each such map shall be submitted to the Council for final action, together with the Planning Commission's records and files. The Council shall approve, conditional approve, or deny such tentative tract map. The action of the City Council shall be final and conclusive. At the time of submission of a tentative tract map to the Planning Department, the sub- divider, developer or owner, shall submit an accurate list of the names and addresses of all property owners residing, or owning property, within 300 feet of the exterior boundaries of such tentative tract map. Upon receipt of such a list, the Planning Department shall forward to all such persons whose names appear on the list, notification by United States Mail, postage prepaid, addressed as indicated on the said list, advising such persons of the time and place when the Planning Commission will consider the said tentative tract map. Prior to the consideration of such a map by the City Council, the City Clerk shall give the same type of notice as above described, of the time and place of the consideration of such map by the City Council. w FIRST SECv"0 REA,D'NG----}-- ORD 390ê79wS ×Pë¿ At the time of the consideration of the map by the Planning Commission and the City Council, any interested person shall be given a reasonable opportunity to be heard with regard to the action to be taken on the said tentative tract map. Such matters need not be formal public hearings, as in the case of zoning matters, but such interested persons shall be given an opportunity to be heard, and the subdivider shall also be given an opportunity to rebut any evidence presented by such individuals concerning the said tentative tract maps." SECTION 2. That the City Clerk shall certify to the adoption of this ordinance and cause the same to be published in the manner prescribed by law.
