AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK DECLARING
A MORATORIUM UPON THE ISSUANCE OF
MOVING AND RELOCATION PERMITS FOR
BUILDINGS AND STRUCTURES PROPOSED TO
BE LOCATED WITHIN THE BOUNDARIES OF
SAID CITY, AND DECLARING THIS
ORDINANCE TO BE AN URGENCY ORDINANCE
TO TAKE EFFECT IMMEDIATELY
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN
AS FOLLOWS:
SECTION I. That the City Council of the City of Baldwin
Park does hereby find, determine and declare as follows:
a) That due to increased construction of freeways,
and other public developments, within the immediate
vicinity of the City of Baldwin Park, many applications
have been received, and will be received hereinafter,
for the relocation of buildings and structures from such
areas, to the City of Baldwin Park; and
b) That certain provisions of the Baldwin Park
Municipal Code relating to such permits appear to have
ambiguities, inconsistencies and generally do not appear
to be adequate to properly regulate the relocation of
such buildings and structures; and
c) That the Chief Administrative Officer, City
Attorney and Planning Commission are currently conducting
studies with reference to new regulations regarding such
buildings and structures; and
dl That in order to fully review the problems
inherent in this situation, the public Interest, convenience
and necessity requires that this Council impose a moratorium
upon the issuance of such permits so that proper regulations
may be drafted by the staff and Planning Commission and
submitted to the Council for Its consideration.
SECTION 2. That notwithstanding any provision of the Baldwin
Park Municipal Code to the contrary, a moratorium Is hereby declared and
Imposed upon any and all applications, prohibiting the issuance of a
permit allowing the relocation of any building or structure to any place
within this City, from and after the effective date of this ordinance,
up to and including the \ 6th jay of February___, 19 66. This
Ordinance shall be of no further force and effect on and after the l8th
day of February 19 66, unless sooner repealed. The moratorium
imposed hereby shall not apply to or effect any application now filed
and pending.
SECTION 5. That this Ordinance Is declared to be an
urgency ordinance and shall take effect immediately. A statement of
facts giving rise to such ordinance Is as hereinabove set forth.
SECTION 4. That the City Clerk shall certify to the
adoption of this ordinance and cause the same to be published in
the manner prescribed by law.
