AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK AMENDING THE
ZONING REGULATIONS OF SASD CITY RE-
LATING TO SERVICE STATION USES, AND
DECLARING THIS ORDINANCE TO BE AN
URGENCY ORDINANCE, AND STATING THE
FACTS WHICH CONSTITUTE THE URGENCY
HEREOF
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS:
SECTION I. That the City Council of the City of Baldwin Park does
hereby find determine and declare as follows:
a) That the present zoning regulations applicable to service
station uses within the City Code and General Plan and their
application, are not adequate to protect the integrity of the
existing zoning; and
b) That said regulations are insufficient to render such uses
compatible with uses surrounding and adjacent properties; and
cl That many applications for service station uses have been
received within the past several months; and
d) That the Planning Commission has heretofore been instructed
to promptly study this question to determine whether special
development standards can be prepared and inserted in the
existing zoning regulations to solve the problem raised by
the numerous properties proposed for such uses; and
e) That the public convenience, necessity and interest requires
that a moratorium be declared preventing construction of new
service station uses within this City, for a period ninety
90) days from and after the effective date of this ordinance,
pending the receipt by this Council, of the Planning Commis-
sion's recormiendat ions regarding the m&tter above referred to.
SECTION 2. That notwithstandihg any provision of the Baldwin Park
Municipal Code, to the contrary, a moratorium is hereby declared, for a
period of ninety 90) days from and after the effective dcjte of this
ordinance, preventing the filing end/or approval of any application for
any permit to allow the construction and operation of a gasoline service
station. This ordinance is hereby declared to be an urgency ordinance,
and shall take effect immediately upon its adoption. A statement of facts
constituting the urgency hereof is above set forth. This ordinance shall
expire and be of no further effect upon the ninetieth S90th) day after
the adoption hereof.
SECTION 5. That the City Clerk shell certify to the adoption hereof,
and cause the same to be published in the manner prescribed by law.
