AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF BALDWIN PARK ADDING SECTION 5101 TO THE
BALDWIN PARK MUNICIPAL CODE RELATING TO THE
FIRE CODE URGENCY ORDINANCE)
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN
AS FOLLOWS:
SECTION 1. That Section 5101 is hereby added to the
Baldwin Park Municipal Code, relating to the Fire Code, which shall
read as to Ilows:
5101* Appeal from Decisions of Fire Chief. The decisions
of the Fire Chief, pursuant to the provisions of the Fire Code as
adopted by Section 5100 hereof, shall be final and conclusive In
the absence of an appeal, filed In the manner hereinafter set
forth. Any person aggrieved by a decision of the Fire Chief, with
reference to the provisions of the Fire Code, shall have the right
of appeal to the City Council. Such appeals shall be processed
as to Ilows»
a) Within not to exceed thirty 50) days after the
rendering of such decision, any person aggrieved thereby
may file a written letter of appeal with the City Clerk,
which letter shall state the nature of the decision, all
relevant factual material, and the applicable sections of
the Code; and
b) Upon receipt of a timely appeal, the Clerk shall
place the matter upon the next most convenient Council
agenda, and shall give the appellant or his agent, the
Fire Chief, and any other person requesting the same, at
least five 5) days written notice of the time and place of
such hearing; and
c) At the time of such hearing, the applicant shall
show cause, to the reasonable satisfaction of the Council,
how, or In what manner the Chief^ decision was arbitrary,
unreasonable, or not In conformity with the purpose and
intent of the provisions of said Fire Code; and
d) The applicant shall be given a reasonable oppor-
tunity to be heard In connection with such an appeal; the
Council may also consider any other relevant evidence,
Including but not limited to, staff reports,
e) The Council shall approve. In whole or in part,
conditionally approve, or reverse the Fire Chiefs decision,
based upon the evidence presented. Its Interpretation of the
provisions of the said Fire Code^ and the preservation of
the public health and welfare; and
f) The determination of the Counci I, which may be by
motion, shell be final and conclusive; notice thereof shall
be given to the applicant, and all persons requesting the
same; and
g) All notices required hereunder shall be by United
States Mall, postage prepaid, addressed to the party at his
last known address."
SECTION 2» That this Ordinance shall take effect Immediately,
and is so required in the public Interest, and in order to provide for
Immediate CouncII revision of administrative determinations made pursuant
to the Fire Code of the City of Baldwin Park.
SECTION 5. That the City Clerk shall certify to the adoption
of this Ordinance and cause the same to be published In the manner
prescribed by law,
