HomeMy WebLinkAboutORD 467ORD 467x ôÎÀèORDINANCE NO. 467 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE REGULATIONS APPLICABLE TO THE R-3 ZONES WITHIN SAID CITY. CASE NO. AZC 22) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 9574 of the Baldwin Park Municipal Code is hereby repealed and rescinded. SECTION 2. That Section 9570 of the Baldwin Park Municipal Code is hereby amended by adding thereto as Paragraph 4), the following: ti 4) Single Family Residential Units. Notwithstanding the provisions of this Division, any single family residential unit which was lawfully erected and constructed upon any lot which is, presently, or is in the future, zoned R-3, shall not be deemed to be a non-conforming use provided that the same complies with all of the following conditions: a) That such single family resi- dential structure, together with all accessory uses, was constructed in conformity with the zoning regulations in effect at the time of such construction; and b) That no other uses exist upon the property other than those permitted in the R-l Zone, as set forth in Division I hereof, This Subparagraph shall not be construed to permit the new construction of a single family residential unit upon any unimproved property which is located in Zone R-3. The new construction of any structure accessory to an R-l use, or reconstruc- tion of any existing building or structure which meets the requirements of Subparagraph a) and b) hereof, shall be accomplished in accordance with the provisions of Division I hereof." SECTION 3. That Subparagraphs b) and c) of Sub- paragraph 1 of Section 9571 of the Baldwin Park Municipal Code are hereby amended to read, respectively, as follows n b) Width. All lots created after the effective date of this regulation shall be maintained in compliance with the following minimum widths, measured along the rear line of the required front yard area: 1) Interior lots shall have and maintain a lot width of not less than sixty 60) feet. 2) Corner lots shall have and maintain a width of not less than seventy 70) feet. Ai I lots in the R-5 Zone, created a+ the effective date of this regulation, shall have a sufficient depth to provide not less than the required minimum lot area; and to provide the minimum required rear and side yard areas as specified herein." SECTION 4. Subparagraphs d), g) and h) of Subsection 2 of said Section 9571 of the Baldwin Park Municipal Code are hereby amended to read, respectively, as to I tows: d) Minimum Floor Area for Dwelling Units: 1) Bachelor and efficiency units shall contain not less than 575 sq. ft. 2) One-bedroom units shall contain not less than 675 sq. ft. 3) Two-bedroom units shall contain not less than 850 sq. ft. 4) Three-bedroom units shall contain not less than 1050 sq. ft. 5) For each additional bedroom, in units having more than three bedrooms, said units shalI contain not less than 150 sq. ft. of additional ffoor area. 6) Required floor area shall not include porches, garages, entries, terraces, patios or basements. 9^ Garages: That no garage may be erected in front of any main building, nor shall any garage, which is part of another building or structure, face or open upon a front yard area, unless the same is located on the rear half of the lot. h) Off Street Parking: Each lot or parcel of land in the R-5 Zone shaI 1have, on the same lot or parcel of land, except as provided in this Code, two 2) covered off- street parking spaces for each dwelling unit located thereon and one i) additional open space for each four 4) dwelling units as and for guest parking. The spaces requi red for each dwelI ing shal t be located In a garage. Such parking faciI ities shalI be conveniently accessible and located only on such portions of the lot or parcel of land upon which structures may be erected." SECTION 5. That Subparagraph 5 a) I) of Section 9571 of the Baldwin Park Municipal Code is hereby amended to read as follows: a) Front Yards: 1) Each lot in the R-5 Zone shall have and maintain a front yard of not less than 15 feet in depth; provided that new construction on R-5 Zone lots for which a building permit is issued after the effective date of this regulation, shall observe and maintain a front yard area not less than 20 Feet in depth." SECTION 6. That Subsection 5 d) and 5 e) of Section 9571 of the Baldwin Park Municipal Code are hereby amended to read, respectively, as follows: BIB] 37949-U01 ORD-U02 467-U02 LI2-U03 FO31549-U03 FO31683-U03 DO31713-U03 C5-U03 ORDINANCES-U03 11/24/2003-U04 ROBIN-U04 ORD 467x ôÎÀèOrdinance No. 467 Page 5- d) Yards for Accessory Buildings: On every lot in the R-5 Zone accessory buildings shall comply with the same yard requirements as main buildings, except as follows: 1) On Interior lots accessory buildings not primarily used for human habitation may be located to the rear and side tot lines. If the lot rears upon an alley, such accessory buildings shall maintain a distance of not less than 5 feet from the rear lot line. 2) On corner lots accessory buildings not primarily used for human habitation may build to the rear lot line and to the interior side lot line; except that if the lot rears upon an alley, such accessory buildings shall maintain a distance of not less than 5 feet from the rear line of said lot. 5) On reverse corner lots accessory buildings not primarily used for human habitation may build to the interior side lot line when located to the rear of the required side yard; except that if the fot rears upon an alley, such building shall maintain a distance of not less than 5 feet from the rear property line; such buildings shall observe the same side yard requirements as main buildings on the side street I ine, 4) Accessory Buildings, Proximity to Lot Lines. No accessory building shall be located i n such close proximity to a lot line so as to cause roof drainage therefrom to fall upon a lot other than that on which the same is located. e) Distance Between Buildings on the Same Lot. The minimum distance for structures or buildings in the R-5 Zone shall be not less than: 1) DwelI ing and dwelIi ng. There shall be a minimum distance of 10 feet between buildings used for dwelI ing purposes. 2) Dwelling and Accessory Buildings. There shall be a minimum distance of10 feet between a bu iId i ng used for dwelling purpose and accessory building. For the purpose of this Section, accessory buildings and those buildings used for dwelling purposes may be considered to be connected when the roof is extended from one building to the other for not less than 50% of the length of the opposite wall of the smaller of such buildings. But in such cases, the re- quired yard areas for the main buildings shall then apply to the entire structure," SECTION 7. That Subsection 4 a) and 4 e) of Section 9571 are hereby amended to read, respectively, as follows: a) Usable Open Space. At least 100 sq. feet of usable open space shall be provided for each dwelling unit. No portion of any off-s+reet parking space, driveways, sun- decks, swimming pools, accessory buildings, required front, rear, or side yards, or covered pedestrian walk-ways between but Idlngs, shai I constitute usable open space." e) Fences, Wails, and/or Screens Surrounding Outdoor Activity Areas: A solid wall or view obscuring fence, a minimum height of six feet, shaiI surround any recreational area, swimming pool area, patio, play area, clothes drying area, utility area, open parking area, outdoor living area, or similar specialized activity area, except that this requirement shall not apply to such uses as swimming pools, patios, living areas or similar recreational type activity areas when located within courts as defined in this Chapter." SECTION 8. That subsection d) of subparagraph 5) is hereby added to Section 9571 of the Baldwin Park Municipal Code to read as follows: d) Waf Is: A solid masonry wall, not less than six feet in height, shall be constructed and maintained on any property line of an R-5 Zoned lot, except lot iines adjacent to required front yard areas which is a common lot fine with any lot which is Zoned R-l or R-2." SECTION 9. That Section 9572 of the Baldwin Park Municipal Code is hereby amended, by adding thereto, as Subparagraphs 5) and 6), the following: 5) Visitor Parking Signs. Visitor parking signs with letter- ing notless than 2Tnches in height, shaiI be placed conspicuously at the entrance to every required driveway, and each such space shall be clearly marked for the same." 6) UtiI ities. All public utility services shall be installed below grade from pole to buildings and/or structures." SECTION 10. That the City Clerk shall certify to the adoption hereof and cause the same to be published in the manner prescribed by law. PASSED AND APPROVED this 1st_______day of February_____, 1967.
