HomeMy WebLinkAboutORD 475ORD 475x ôÎÁ ORDINANCE NO k75 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING AND ADDING TO SECTION h2^2 OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO LOITERING BY PERSONS UNDER THE AGE OF EIGHTEEN YEARS. THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION I, That Section l42h2 of the Baldwin Park Municipal Code is hereby amended by amending said section, and adding to said Section Subparagraphs a), b), c), d), and e), to read, respectively, as follows? Curfew. Every person under the age of eighteen years who loiters about the public streets, avenues, alleys, parks, or other public places between the hour of lOsOO o'clock P.M. and the time of sunrise of the following day when not accompanied by his parent or legal guardian having legal custody and control of such person, or by the spouse over twenty-one years of age of such person, is guilty of a misdemeanor. a) Every parent, guardian, or other person having the legal care, custody, or control of any person under the age of eighteen years who knowingly aids, abets, or encourages such person described In this section to violate any provisions of this section to violate any provision of this ordinance is guilty of a misdemeanor. b) Definition. For the purpose of this section the use of the word loiter" is defined to mean to idle, to loaf, to stand idly by, or to walk, drive or ride about aimlessly without lawful purpose. c) Nothing In this section shall be construed as in any way limiting the power or right of law enforcement officers to make such investigations, detentions, or arrests as such law enforcement officers would be permitted to make had this ordinance not been enacted. d) A violation of this section or of any provision thereof is punishable by a fine not exceeding Five Hundred Dollars or by imprisonment not exceeding six months or by both such fine and imprisonment. e) If any provision or clause of this section or the application thereof to any person or circumstance is held Invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable," SECTION 2.
