SECTION lo That the City Council of the City of Baldwin Park does hereby findo determine and declare as followss a) That the Planning Commission heretofore initiated a proceeding to consider certain amendments to the Off-street Parking Requirements of the Zoning Code of the City; and b) That as a result of a public hearing held thereon, the Commission determined that the public interest, convenience and necessity requires amendments to said regulations as herein- after set forth; and c) That the City Council conducted a duly noticed public hearing upon the Commission's recommendation and determined that the public interest, convenience and necessity required such changeso SECTION 2, That Sections 9500 through 9510fl inclusive, of the Baldwin Park Municipal Code, are hereby repealed and rescindedo SECTION 3o That Sections 9500 through 951Q, inclusive, are hereby added to the Baldwin Park Municipal Code to read, respectively, as followss 9500, SAMEo OFF-STREET PARKING FACILITIES, The uses permitted in each zone, as established by this Chapter, shall be deemed to include off-street parking facilities for motor vehicles, accessory or incidental to any principle permitted use in such zones a Every use permitted in any zone by this Chapter, shall be provided with permanently maintained off-street parking and loading facilities in the manner prescribed in this Par to" 9501o SAMEo PARKING SPACES REQUIRED, The off-street parking loading and/or storage spaces required for each use permitted by this Chapter, shall be not less than the following? Bowling Alleys 4 for each alley., Day nurseries, child care centers 1 space for each employee, plus 1 additional space for service vehicles and 1 addi- tional parking space for each 4 parking spaces, to be utilized as for visitor parking Furniture and appliance stores, hardware stores, household equipment, service shops, clothing or shoe repair or personal service shopso 1 for each 400 sq. ft. of gross floor area. Hospitals Hotels 2 for each bed. 1 parking space for each 2 guest rooms. Libraries and Museums 1 parking space for each 500 sq. ft. of gross floor area. All parking facilities shall be located in a garage or carport. Offices: A. General & professional offices B. Medical, dental and clinical offices 1 parking space for each 400 sq. ft. of gross floor area in the building. 1 parking space for each 200 sq. ft. of gross floor area in the building. Professional, business, special or trade school and/or colleges 1 parking space for each 2 students that the school is designed to accommodate. Public utility facilities, including, but not limited to, electric, gas, water, telephone and telegraph facilities not having business offices on the premises. A. 1 parking space for each 2 employees on the largest shift, and 1 parking space for each vehicle operated or kept in connection with the use. B. In no event shall less than 2 parking spaces be provided for each use regardless of the number of employees or vehicles operated. Residential Uses: A« Dwelling, one.and two-family B. Dwelling, multipL three families or more 2 parking spaces per dwelling unit to be located in a garage. 2 parking spaces per dwelling unit to be located in a garage, plus 1 additional open parking space fpr each 4 units, for guest parking. Restaurants, cafes, drive-ins cocktail lounges, beer bars, and other similar places dispensing food or refresh- ments. 1 parking space for each 3 fixed seats, or if no fixed seating, 1 space for every 35 sq* ft, of gross floor area, plus 1 additional parking space fpr each 2 employees on the maximum work shift, provided further that in no event shall there be provided less than 5 off- street parking spaces regardless of the number of fixed seats, gross floor area or number of employees. Having not more than 5,000 sq. ft. of gross floor area B. Having more than 5,000 sq. ft., but not more than 20,000 sq« ft* of gross floor area. C. Having more than 20,000 sq. ft. of gross floor area* 1 parking space for each 400 sq. ft. 13 parking spaces, plus 1 additional parking space for every 150 sq. ft. of gross floor area in excess of 5,000 sq. ft. 113 parking spaces, plus 1 parking space for each 100 sq. ft. of gross floor area in excess of 20,000 sq. ft. Rooming houses, lodging houses, clubs, fraternity and sorority houses, and similar structures having guest or sleeping rooms. 1 parking space for each sleeping room. In dormi- tories, each 100 sq. ft. of gross floor area shall be considered equivalent to a guest or sleeping room. SAME, PARKING REQUIREMENTS FOR USES NOT SPECIFIED. Where the parking requirement^ for any use are not specifically set forth herein, such parking requirements shall be determined by the Planning Commission as a clarification of ambiguity, which shall be based upon the requirements for the most comparable use specified herein so as to preserve the purpose and intent of this Chapter." 9503. SAME, COMPUTATION OF REQUIRED OFF-STREET PARKING SPACES. 1. Fractional remainders. Where the application of this Chapter, results in the requirement of a fractional parking space, any fraction up to one-half 1/2) shall be disregarded, and any fraction equalling one-half 1/2) or iKpre shall be construed as requiring one 1) additional parking space« 2. Parking within Buildings and/or Structures. Where the required parking computations are based on the floor area, floor space devoted to parking within a building, or necessary interior driveways and ramps thereto, shall be excluded; such portions of a building, devoted exclusively to parking, shall have no off-street parking space requirements. 3o Mixed Uses« Where more than one use exists in a building or on a lot, for the purpose of computing the total number of parking spaces required hereunder, each such use shall be computed separately. Off-street parking facilities for one use shall not be considered as pro- viding required parking facilities for any other use except as hereinafter specified for joint use." 9504. SAME. GENERAL REQUIREMENTS. JOINT USE. The Com- mission may, upon application by the owner or lessees of any property authorize the joint use of parking facilities by the following uses or activities or under the conditions specified herein: 1. Up to fifty percent of the parking facilities required by this Part for a use considered to be primarily a daytime use may be provided by the parking facilities of a use considered to be primarily a nighttime and/or Sunday use; up to fifty percent of the parking facilities required by this Part for a use considered to be primarily a nighttime and/or Sunday use may be provided by the parking facilities of a use considered to be primarily a daytime use, provided such reciprocal parking area shall be subject to conditions set forth in paragraph 4 below 2c Up to one hundred percent of the parking facilities required by this Part for a church or for an auditorium incidental to a public or parochial aphool may be supplied by parking facilities of a use considered to be primarily a daytime use, provided such reciprocal parking area shall be subject to conditions set forth' in paragraph 4 belowo BIB] 37949-U01 ORD-U02 496-U02 LI2-U03 FO31549-U03 FO31550-U03 DO31741-U03 C5-U03 ORDINANCES-U03 11/24/2003-U04 ROBIN-U04 ORD 496x ôοöORDINANCE NO. 496 Page 6 3. The following uses shall be deemed to be daytime uses; banks, business offices, retail stores, personal service shops, clothfng or shoe repair or service shops, manufac- turing or wholesale buildings and similar uses. The following uses shall be deemed to be nighttime and/or Sunday usess auditoriums incidental to a public or parochial school, churches, dance halls, theatres and bars. 4. Conditions required for joint use: a) The building or use for which application is being made for authority to utilize the existing off-street parking facilities provided by another building or use, shall be located within one hundred fifty feet of such parking facility. b) The applicant shall show that there is no substantial conflict in the principal operating hours of the buildings or uses for which the joint use of off- street parking facilities is proposed, c) Parties concerned in the joint use of off-street parking facilities shall evidence agreement for such joint use by a proper legal instrument approved by the City Attorney as to form and content. Such in- strument, when approved, shall be recorded in the Office of the County Recorder and copies thereof filed with the Building and Planning Departments." 9505o SAME, PLANS, Site Plans, pursuant to Section 9460 et seq of this Code, shall be required for all proposed parking areas having over five 5) spaces, which shall be submitted to the Planning Department at the time of the application for a Building Permit for the building to which the parking area is accessory, or prior to the issuance of a certificate of occupancy where no construction is involved. The Site Plan shall clearly indicate the proposed development of the property, including location, size, shape, design, curb cuts, lighting, landscaping and other features and appurtenances of the proposed parking area and/or Ipt." 9506. SAME. GENERAL REQUIREMENTS FOR THE IMPROVEMENT AND MAINTENANCE OF PARKING AREAS. lo a) Size and Aisles. The minimum size of each required off-street parking space shall be not less than ten 10) feet in width by twenty 20) feet in length, exclusive of driveway areas, and shall contain not less than an area of two hundred 200) square feet, exclusive of driveways and/or aisles, whether or not enclosed in a building, garage or carport a b) Maneuvering Areas. Maneuvering areas adjacent to parking spaces shall be arranged in accordance with the standard chart and diagrams referred to in Section 9510 hereofo BIB] 37949-U01 ORD-U02 496-U02 LI2-U03 FO31549-U03 FO31550-U03 DO31741-U03 C5-U03 ORDINANCES-U03 11/24/2003-U04 ROBIN-U04 ORD 496x ôοöORDINANCE NO. 496 Page 7 2, Access Driveways, Turning Radii and Reverse Travelo a) All driveways serving parking areas shall be a minimum of twelve 12) feet in width. Where both ingress and egress are provided on a single drive- way, the minimum width shall be sixteen 16) feet» b) Parking areas for thirty 30) or more vehicles shall be provided with separate driveways for in- gress and egress,, each of which shall be not less than twelve 12) feet in width. c) Joint use of driveways used in conjunction with abutting properties shall be allowed when proper easements or agreements, approved as to form by the City Attorney, have been executed and filed with the City and recorded with the County Recorders Office of Los Angeles, provided that no such drive- way shall exceed a total distance of 500 feet from the public street to the parking area served, said distance to be measured along the driveway, d) Parking areas and spaces having five 5) or more vehicular off-street parking spaces, shall be pro- vided with unobstructed, adequate, maneuvering aisles or turn-around areas, in order that all vehicles may enter streets or alleys in a forward direction., a Surfacing^ All off-street parking areas, maneuvering areas, turn-around areas and driveways used for access thereto, shall be surfaced, and thereafter maintained, with; a) Concrete surfacing to a minimum thickness of 3-5/8 inches and shall include expansion joints as necessary; or b) Asphaltic type surfacing compacted to a minimum thickness of 1-1/2 inches, laid over a base of crushed rock, gravel or similar material, compacted to a minimum thickness of 3 inches; or c) Asphaltic type surfacing, compacted to a minimum thickness of 3 inches, laid over a base of 4 inches of crushed rock for driveways and service areas if said areas are utilized for trucks, tractors, trailers, heavy equipment, or other similar type vehicles, except that concrete surfacing to a minimum of 3-5/8 inches shall be provided around all pump islands for servicing of trucks, tractors, trailers, heavy equip- ment, or other similar type vehicles, d) Crushed rock, gravel, or other similar material treated to deter dust or mud for those parking areas utilized for trucks, tractors, trailers, heavy equipment or other similar type vehicles, Locationo Off-street parking spaces and/or facilities shall be located as follows: BIB] 37949-U01 ORD-U02 496-U02 LI2-U03 FO31549-U03 FO31550-U03 DO31741-U03 C5-U03 ORDINANCES-U03 11/24/2003-U04 ROBIN-U04 ORD 496x ôοöa) For single family or multiple family dwellingss all parking facilities shall be located on the same lot as the buildings they are required to serve; and b) For nursing and convalescent homes, hospitals and rest homes or guest homes, rooming houses, lodging houses, clubs, fraternity or sorority houses, said parking areas shall be located not more than 150 feet from the building served; and c) Truck parking and/or storage areas or other similar type vehicles shall be located not closer than fifteen 15) feet from the street property lineo Provided further that if said parking and/or storage area is located abutting an A or R Zone, the parking area shall be located not closer than fifteen 15) feet from the side property line abutting the A or R Zoned property and shall observe a thirty-five 35) foot front yard setbacks d) For uses other than those specified above, all parking spaces shall not be located greater than 300 feet from the building they serve, except as provided in Section 9504, 5o Setbacks a All parking areas shall be subject to the same setback restrictions governing accessory buildings as defined in the zone in which said parking area is located, 6. Bumper Guards or Wheel Stopso Evety parking area that is not separated by a fence from any street, alley or property lines, upon which it abuts, except for vehicular access areas, shall be provided with suitable concrete or timber barriers, utilized as bumper guards or wheel stops, except for those off-street parking spaces established in a garage. No motor vehicles shall over- hang a public right-of-wayo Provided that each such bumper guard or wheel stop shall be not less than six 6) inches in height; each bumper guard or wheel stop shall be securely installed and maintained, 7. Wallso a) Front yards and corner lot side yards. Each lot in the C and M Zones a where parking spaces, driveways, maneuvering aisles and turn-around areas are adjacent to a side yard or front yard abutting a street, a solid masonry wall, not less than thirty 30) inches in\ height, shall be established parallel to and not nearer than five 5) feet to the side and front lot lines*, If such area is utilized for turck, trailer or other heavy equipments parking facilities, which is located within fifty 50) feet of a lot line of an R or A Zoned property, there shall be provided a solid masonry wall, not less than six 6) feet in height, except that such wall shall not exceed thirty 30) inches in height when the same is located along a lot line that abuts a front yard area of an R or A Zoned propertyo The area between the walls and the street or lot line shall be landscaped and permanently maintained and irrigated., BIB] 37949-U01 ORD-U02 496-U02 LI2-U03 FO31549-U03 FO31550-U03 DO31741-U03 C5-U03 ORDINANCES-U03 11/24/2003-U04 ROBIN-U04 ORD 496x ôοö ORDINANCE NO, 496 Page 9 b) In all C and M and R-3 Zones, where parking spaces, driveways, maneuvering aisles and turn-around areas are located with abutting property zoned for residential or agricultural purposes such parking facilities shall, except as otherwise provided herein, have a solid maspnry wall, not less than six 6) feet in height, measured from the surface of the finished grade of the abutting property, except that; 1) The wall height shall be reduce<} to thirty 30) inches if the wall is located within fifteen 15) feet of any street or alley; and 2) Such walls may exceed six 6) feet in height, provided that for each foot of height in excess of- six 6) feet, the wall shall be set back from the common property line a distance of one 1) footo * Lightingo Suitable lighting shall be provided so as to properly illuminate all parking areas, used car, trailer or similar types of sales areas; such lighting shall be arranged so as not to reflect the light upon abutting and adjacent properties, 9, Entrances and Exits The location and design of all parking area entrances and exits shall be subject to the approval of the Director, provided that no entrance or exit, other than to an alley, shall be closer than five 5) feet to any lot line of a lot zoned for residential or agricultural purposes, 10» Strip ing a All parking spaces shall be striped in a manner clearly showing the layout of the intended parking stallso Such striping shall be maintained in a clear, visible and orderly manner a 11. Signso Where required for public safety in the discretion of the Director, appropriate exit, entrance and directional signs shall be posted and maintained for vehicular access to parking lots from public streets or alleys, 12. Maintenance and Irrigationo All parking areas shall be kept clean and free of dust, mud or trasho Parking areas shall be used only for the purpose of parking motor vehicles, except as provided herein. Where landscaping is required or provided within or along parking areas, an adequate irrigation system shall be provided; all such landscaped areas shall be permanently maintained with suitable nursery stock," 9507, SAME. INTERIOR LANDSCAPING FOR PARKING AREAS. Where more than twenty 20) automobile parking spaces exist on a lot or parcel of land, not less than two 2) percent of the gross area devoted to such parking shall be utilized and maintained with landscaping." LOADING FACILITIES. The following provisions shall apply to all loading facilities in all C and M Zoness 1» The minimum required size of each loading space shall not be less than ten 10) feet in width and twenty-five 25) feet in length and shall have an unobstructed height of not less than fourteen 14) feeto 2o The minimum area required for each loading space shall not be less than 250 square feet, where the gross floor area of all buildings on the lot or parcel of land is less than, but not more than, 20,000 square feete 3o The minimum number of required loading spaces shall be not less than two 2) where the gross floor area of all buildings on the lot is more than 20,000 square feet, but not more than 50,000 square feet; one 1) additional space shall be provided for each additional 10,000 square feet of gross floor area.," 9510. SAMEo APPENDIX A.
