R^3:NG..../.^.;:/(L:.(r,7 ORDINANCE NO. 50_ i»ii».-OM- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTION 9456 OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO CERTIFICATES OF OCCUPANCY THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 9456 o-f the Baldwin Park Municipal Code is hereby amended +o read as follows: 9456. Certificates of Occupancy. a) Certificate Required. In order to insure compliance with the provisions of the zoning regulations, as well as other provisions of this Code, no person shall use, or permit to be used, any building, structure or land within the City, which is zoned C or M", unless he first obtains a certificate of occupancy in the manner hereinafter des- cri bed. b) Issuance. Denial. Such certificate shalI be issued by the Building Department, upon application therefor upon a form to be provided by said Department, and such certificate shall not be issued unless and until the same has been approved by the Planning and Finance Departments of the City. Such certificates shall only be issued if the proposed usage complies with all of the provisions of this Code, including, but not limited to, the building and zoning regulations contained herein. c) Appeal. Where the Building Department declines to issue a certificate of occupancy, notice of such refusal shall be given to the applicant by the United States mail, postage prepaid, addressed to the applicant at his last known address. The decision of the Department shall be final and conclusive in the absence of an appeal filed in the manner here- inafter described. Within thirty 50) days from the date of mailing of the notice of denial, the applicant or other interested person, may file a written appeal with the Secretary of the Board of Zoning Adjustments. Upon receipt of such an appeal, the Secretary of the Board of Zoning Adjust- ments shall place the same on the next most convenient Board agenda for consideration by that body, and give the appealing party at least five 5) days' written notice of the time and place of such hearing. d) Board of Zoning Adjustments Action. At the time of the hearing, the Board shall consider all applicable staff reports and other relevant information, and shall give the appealing party a reasonable opportunity to be heard in connection therewith. The Board shall determine whether the proposed usage complies with all applicable provisions of this Code. If the Board finds that usage will be consistent with the provisions of said Code, it shall direct that such certificate be issued; if the Board finds that such usage will not comply with the Code, it shall deny the appeal. Notice of the Board's decision shall be given in the same manner as herein- above set forth with reference to the Building Department. The decision of the Board shall be final and conclusive in the absence of an appeal per- fected in the manner hereinafter set forth. e) CounciI Action. Any party aggrieved by the decision of the Board, with reference to a certificate of occupancy, shall have the right of appeal to the City Council. Such an appeal shall be perfected by filing with the City Clerk, within thirty 50) days after the mailing of notice of the Board's decision, a written appeal appealing the Board's decision to the City Council. Upon receipt of such an appeal, the Clerk shall set the matter on the next most convenient Council agenda and shall give the appealing party at least five 5) days' written notice of the time and place thereof. The Council shall act upon such appeal in the same manner as the Board" as set forth herein. The Council's decision shall be final and conclusive."
