HomeMy WebLinkAboutORD 503ORD 503̤<žjh£Ÿj¾o¼IORDINANCE NO. 505 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING CERTAIN OF THE ZONING REGULATIONS OF SAID CITY CASE NO. AZC-33). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Subparagraph 26) of Section 9610 of the Baldwin Park Municipal Code is hereby repealed and rescinded. SECTION 2. That Section 9424 of the Baldwin Park Municipal Code is hereby amended by adding Subparagraph 11 thereto, to read as follows: 11. Day Nursery shall mean the same as Day Camp." SECTION 3. That Section 9538 of the Baldwin Park Municipal Code is hereby amended to read as follows: 9538. Wall, Fence or Hedge May be Maintained. In any *R'zone a wall, fence or hedge thirty-six inches in height may be located and maintained on any part of a lot. On an interior lot a wall, fence or hedge not more than six feet in height may be located anywhere on the lot except in those areas comprising the required front yard or the required side yards on the side street side of such lots. In any R1 zone, a wall, fence or a hedge not exceeding six feet in height may be located and maintained within the required side yard area on corner and reverse corner lots. The provisions of this Section shall not apply to fences required by State law to surround and enclose public utility installations, nor to retaining walls. Where a retaining wall protects a cut below the natural grade, and is located on the line separating lots, such retaining wall may be topped by a fence, wall or hedge of the same height that would otherwise be permitted at the location if no retaining wall existed. Where a retaining wall contains a fill, the height of the retaining wall built to retain the fill shall be considered as contributing to the permissible height of a fence, solid wall or hedge, providing that in any event a protective fence or wall not more than thirty-six 36) inches in height may be erected at the top of the retaining wall. SECTION 4. SAME. DEEP LOTS. A deep lot, for the purposes of this Section, shall mean any lot lawfully created prior to the adoption of this Part, having: a) a minimum of 10,000 square feet in lot area; and b) an average depth in excess of 170 feet; and c) is located in an area for which a Specific Plan for street pattern has been approved; and d) is located in an area with an established street pattern. The zoning regulations applicable to deep lots located in an R-l Zone shall be those regulations as contained in Sections 9551 through 9553, inclusive, of this Code, except as such regulations are modified by the provisions hereof. In addition to the regu- lations hereinabove referred to, the following standards of development shall apply to all such deep lots: 1. Additional permitted uses. A total of not to exceed 2 single family dwelling units shall be permitted to be constructed and main- tained on deep lots in the R-l zone; such dwelling units shall not be located closer than 20 feet to one another. 2. Driveways and parking area. Off-street parking facilities shall be located upon the same lot so as to serve the two permitted dwelling units. There shall be provided two off-street parking spaces for each of the two dwelling units permitted on such lot. All required off-street parking facilities shall be enclosed within a garage or garages. Said facilities shall be located so as to adequately serve each of the dwelling units. Vehicular access to said off-street parking facilities shall be by access driveway or driveways which shall be not less than a minimum of 12 feet in width at all points. 3. Site plan review. A site plan review, in accordance with the provisions of Section 9460 et seq. hereof, shall be required prior to the issuance of any building permit for all deep lot developments; orientation of houses to streets shall be subject to approval of the Planning Director in accordance with the applicable Specific Plan of streets. 4. Property must remain one parcel. The property on whicn a deep lot development takes place shall remain as one unsubdivided parcel of property. Such a parcel shall not be divided so as to create two separate lots." That the City Clerk shall certify to the adoption of this Ordinance and shall publish the same in the manner prescribed by law.
