ORDINANCE NO. 508
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK AMENDING
SECTION 6152 OF THE BALDWIN PARK
MUNICIPAL CODE, RELATING TO TRANSIENT
OCCUPANCY TAX. URGENCY)
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES
ORDAIN AS FOLLOWS:
SECTION 1. That Section 6152 of the Baldwin Park
Municipal Code is hereby amended to read as follows:
6152. TAX IMPOSED. For the
privilege of occupancy in any hotel, each
transient is subject to and shall pay a
tax in the amount of five 57o) percent of
the rent charged by the operator. Said
tax constitutes a debt owed by the transient
to the City which is extinguished only by
payment to the operator or to the City. The
transient shall pay the tax to the operator
of the hotel at the time the rent is paid.
If the rent is paid in installments, a
proportionate share of the tax shall be paid
with each installment. The unpaid tax shall
be due upon the transient's ceasing to occupy
space in the hotel. If for any reason the
tax due is not paid to the operator of the
hotel, the Tax Administrator may require
that such tax shall be paid directly to the
Tax Administrator."
SECTION 2. That this Ordinance, inasmuch as it
provides for a tax levy for usual and current expenses
of the City, within the meaning of Section 36937 of the
Government Code, shall take effect at 12:01 A.M. on
January 1, 1968.
SECTION 3. That the City Clerk shall certify to
the adoption of this Ordinance and shall cause the same
to be published in the manner prescribed by law.
