HomeMy WebLinkAboutORD 504ORD 504ÜÂh£Ÿj쾉 ¼IORDINANCE NO. 504 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE ZONING REGULATIONS OF SAID CITY APPLICABLE TO ZONE M-l CASE NO. AZC-31). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Sections 9630 through 9634, inclusive, of the Baldwin Park Municipal Code are hereby repealed and rescinded. SECTION 2. That the Baldwin Park Municipal Code is hereby amended by adding thereto Sections 9630 through 9636, inclusive, to read, as follows: 9630. SAME. PERMITTED USES. No person shall use any property located in the M-l Zone for any purpose other than those hereinafter specifically set forth: 1. Agricultural or contractors equip- ment yards, storage, sales or service. 2. Auto laundries manual, mechanical, automatic, coin-operated and self-service). 3. Automobile service stations, which shall conform with the standards of Section 9650 et seq. of the Baldwin Park Municipal Code. 4. Automobile assembly plants, body and fender works, and used parts storage. 5. Automobile painting. 6. Banks. 7. Bakeries, wholesale. 8. Bottling plants. 9. Building material sales. 10. Contractor or construction offices, shops and yards, including, but not limited to, the following; a Building b Cement c Electrical d' Heating/'ventilating and air conditioning e) Masonry Painting U Plumbing \h) Refrigeration Roofing n i Z-^.. Cleaning and dyeing establishments, wholesale and retail. 12. Distributing plants, total storage capacity not to exceed 250,000 gallons. 13. Engraving, machine metal engraving. 14. Fabricating, other than snap riveting or any process used in bending or shaping metal which produces any annoying or disagreeable noise. 15. Feed and fuel sales. 16. Flour mills. 17. Garages and parking lots, commercial. 18. Gases. Storage of the following gases are permitted, provided that the same is conducted in accordance with the provisions of all applicable laws, including but not limited to, the Baldwin Park Municipal Code: a) Acetylene b) Butane c) Oxygen 19. Ice and cold storage plants. 20. Knitting mills. 21. Laundries. 22. Lumber yards. 23. Machine shops. 24. Machine storage yards lathes, drop hammers, etc.) 25. Manufacturing, compounding, assembling, processing, packaging or treatment which creates any of the following products: a) Batteries b Beds and bedsprings c Brushes d Candles e Canvas f Casein, the manufacture of casein products, excepting glue. Manufacturing, compounding, assembly, packaging or treatment of articles or merchandise from any of the following materials: Bone products Cellophane Cork Corrugated cardboard Feathers Fiber, including fiberglass Glass Hair i} Horn Iron, not including foundries k) Metal, products of precious metals; steel and brass stamp, including hand and machine engraving; metal fabricating, spinning and storage. 1) Paper, not including the manufacture of paper itself. m Plastics and synthetics n Pottery o Rope p Rubber, fabrication of products made from finished rubber. q) Textiles r) Wire Wood, including a planing mill. Yarn 27. Paints, paint mixing, provided a boiling process is not employed, no tank farm is permitted and above-surface thinner storage is limited to two hundred 200) gallons. Poultry and rabbit slaughter 29. Public utility and public service uses, including: a) Bus terminal, bus garages, bus lots b) Fire stations c Police stat^OTis d Railroad rigt{ts"of-way e Water filtration plants Water pumping stations g' Electric service yards and/or electric dilsTtrJIbution and transmission substations K)Telephone exchanges 30. Sand, gravel, fill dirt, topsoil, sales and storage, not including a quarry operation. 31. Sheet metal shop 32. Tile, wall and floor tile and relating small tile products. 33. Tinsmiths 34. Tire rebuilding, recapping and retreading 35. Trade schools 36. Transfer, moving and storage of furniture and household goods. 37. Truck repairing, overhauling and servicing 38. Truck washing and cleaning 39. Welding shops 40. Wine storage and manufacture 41. Any similar enterprises or businesses or other enterprises or businesses which the Commission finds, by clarification of ambiguity, are similar to, and compatible with, the uses enumerated in this Section." 9631. SAME. USES PERMITTED BY CONDITIONAL USE PERMIT. The following uses shall be permitted in the M-l Zone, provided that a Conditional Use Permit is first obtained as prescribed in Section 9472 et seq. hereof: 1. Automobile dismantling yards 2. Cat and dog hospitals and/or kennels 4. Gas utility service substations 5. Mills, planing 6. Motels and hotels 7. Restaurants, if the same have an On-Sale Alcoholic Beverage Control Board license allowing the sale of liquor in conjunction therewith. 8. Telephone microwave relay towers and telephone transmitting equipment buildings 9. Truck transportation yard 10. Truck terminals 11. Truck storage yard." 9632. SAME. PERFORMANCE STANDARDS. All uses in the M-l Zone shall conform to the following: 1. Enclosed Building. All uses permitted in Zone M-l shall be conducted completely within an enclosed building, except for those uses customarily conducted out of doors, as determined by the Director; such determination by the Director shall be subject to a review by the Planning Commission and Council in the time and manner set forth in Section 9464 hereof. 2. Toxic matter. No person shall, for any period of time, permit or allow the discharge across the boundaries of the lot or parcel whereon the use is located, toxic, noxious or odorous matter in such concentrations, as to be detrimental to the public health, safety, comfort or welfare, or cause injury or damage to adjacent and abutting properties or uses. 3. Fire and explosive hazards. The storage, utilization or manufacture of materials, goods or products, which includes, as part of such process, burning, ranging from free or active to intense burning, as determined by the Fire Chief of Baldwin Park, shall be permitted, subject to compliance with all other performance standards for the M-l Zone, and provided that all buildings or structures in which such burning process takes place, shall be set back at least forty 40) feet from any lot line or in lieu thereof, all such buildings or structures shall be protected throughout by an automatic BIB] 37946-U01 ORD-U02 504-U02 LI2-U03 FO31549-U03 FO31555-U03 DO31556-U03 C5-U03 ORDINANCES-U03 11/20/2003-U04 ROBIN-U04 ORD 504ÜÂh£Ÿj쾉 ¼IORDINANCE NO. 504 Page 6 sprinkler system, complying with installation standards prescribed by the National Board of Fire Underwriters. 4. Glare and heat. Any operation producing intense glare or heat shall be performed in such a manner as not to create a public nuisance or hazard to the adjacent or abutting properties. 5. Required Yard Areas. When an M-l zoned lot, or portion thereof, abuts or is separated from any A or R-zoned property by a street or alley, yard areas shall be required as is shown on Exhibit A" attached hereto, and incorporated herein by this reference. 6. Accessory uses. The following accessory uses may be located in required yard areas: a) Landscaping. b) Passenger vehicle parking or loading, only if surfaced with asphaltic paving or concre te. c) Employees' recreational areas, without structures. d) Driveways, only if surfaced with asphaltic paving or concrete. e) Railroad spur tracks, excluding storage of railroad motor power equipment or rolling stock. f) An ornamental fence or wall not to exceed eight 8) feet in height, of such material as woven wire, wood, welded wire, expanded metal, chain link, wrought iron and pattern block." 9633. SIGNS. On-premise signs shall be permitted subject to the following provisions: 1. Special provisions: a) No sign shall be located within one hundred 100) feet of any or R1 zoned property; and b) No sign located in the M-l Zone shall have or consist of any flashing, blinking, fluctuating or otherwise animated light, or any moving, rotating or otherwise physically animated part; and c) Permanent signs placed on or in any window shall not obscure more than twenty 20%) percent of the total area of such window; and BIB] 37946-U01 ORD-U02 504-U02 LI2-U03 FO31549-U03 FO31555-U03 DO31556-U03 C5-U03 ORDINANCES-U03 11/20/2003-U04 ROBIN-U04 ORD 504ÜÂh£Ÿj쾉 ¼IORDINANCE NO. 504 Page 7 d) Automobile service station signs shall be subject to the provisions of Section 9650 et seq. hereof, exclusively. 2. Types of signs permitted, a) Freestanding signs. 1) Number, The number of free- standing signs permitted on any M-l zoned lot shall be determined as follows: i) For lots having less than one hundred 100) lineal feet of street frontage-- One 1) freestanding sign. ii) For lots having more than one hundred 100) lineal feet of street frontage-- Two 2) freestanding signs. 2) Sign Face Area, No free- standing sign shall have a sign face area in excess of six hundred 600) square feet. 3) Height, The overall height of a freestanding sign shall not exceed sixty 60) feet measured from the finished grade of the lot to the highest projection of the sign; provided that no freestanding sign shall exceed a height of forty-five 45) feet if the same is located with- in six hundred 600) feet of any free- way or adopted freeway route. 4) Projection. No sign shall be placed upon any lot in such a manner that will cause the same to project over or into the public right- of-way. 5) Placement. Freestanding signs shall be located adjacent to the street frontage which is utilized to determine the number of such signs permitted. b) Roof signs. 1) Number. One roof sign shall be allowed in lieu of each permitted freestanding sign. 2) Sign Face Area. No permitted roof sign shall exceed a gross sign face area of six hundred 600) square feet. No roof sign shall exceed an overall height in excess of six 6) feet above the parapet, eaves or building facade. 4) Pro lection. A roof sign shall not project beyond the facade of the building. c) Wall signs. 1) Number. One 1) wall sign shall be permitted on each exterior wall of a building which has a main entrance. 2) Sign Face Area. The sign face area of any permitted wall sign shall not exceed an area equal to thirty 30%) percent of the wall area of the building facade, nor in any event, shall any such sign face area exceed a total of three hundred 300) square feet. d) Temporary signs. Temporary signs advertising property for sale or lease and construction information shall be permitted provided that the same do not exceed in size those signs customarily utilized for this purpose. e) Non-Conforming signs. Notwith- standing any other provision of this Code, any sign which does not conform to the provisions of this Part shall be made to conform or shall be removed within five 5) years after the effective date of these regulations. f) Terminology. 1) Building facade. That portion of any exterior elevation of a building extending from grade to the top of the parapet wall or eaves and the entire width of the building elevation. 2) Sign Face Area. The entire background area of a sign upon which copy could be placed. In computing area of sign face area, only that face or faces which can be seen from any one direction shall be counted. 3) Freestanding sign. A sign which is supported by one or more columns, uprights or braces in or upon the ground. BIB] 37946-U01 ORD-U02 504-U02 LI2-U03 FO31549-U03 FO31555-U03 DO31556-U03 C5-U03 ORDINANCES-U03 11/20/2003-U04 ROBIN-U04 ORD 504ÜÂh£Ÿj쾉 ¼IORDINANCE NO. 5°4 Page 9 4) On premise sign, A sign which carries only advertisements directly related to a lawful use of the premise on which it is located, including sign devices, indicating the business transacted, services rendered, goods sold or produced on the premises, name of the business, or name of the person, firm or corporation occupying the premises. 5) Roof sign> A sign erected upon or above a roof or parapet wall of a building or structure. 6) Wall sign. A sign which is in any manner affixed, including but not limited to, a sign which is painted on such building, to any exterior wall of a building or structure, and which does not extend more than six 6) feet above the parapet, eaves or building facade of the building on which it is located. 7) Sxgn. Sign shall mean a sign as defined in Section 9437 hereof, exclusive of outdoor advertising structures." 9634. SAME, PROPERTY DEVELOPMENT STANDARDS. The following requirements shall apply to the development of any property within the M-l Zone after the effective date hereof; provided, however, that where an existing lot, as defined in Section 9430 2) hereof, has an area or width less than that required in this division, the same may be occupied by permitted uses in Zone M-l, without regard to Subparagraphs 3 and 4 hereof. 1. Building Height« Unlimited, provided that when any building or structure is located within one hundred 100) feet of any R* zoned lot the same shall not exceed a height of thirty-five 35) feet. 2. Required yard area. No front, rear or side yard shall be required except as herein- above set forth. 3« Lot area. The minimum lot area of any lot in the M-l Zone created after the effective date hereof, shall be not less than 10,000 square feet. 4. Lot width. Each lot in the M-l Zone created after the effective date hereof, shall have a minimum lot width of not less than seventy-five 75) feet. There shall be a minimum distance of twenty 20) feet between main buildings or main buildings and accessory buildings. 6. chicle loading area. a) There shall be provided off-street loading spaces which shall be not less than ten 10) feet in width and twenty- five 25) feet in length, exclusive of aisles and maneuvering space and said loading areas shall have a vertical clearance of not less than fourteen 14) feet. b) hvery loading area snail be so locaijed and arranged so that delivery vehicles may be driven upon or into said space. c) No loading space shall be located within twenty 20) feet of any lot line of any A* or R* zoned property. d) All such off-st-reet loading areas shall be inp roved with asphaltic paving not less than three 3) inches thick laid over a base of four 4) inches of crushed rock, and if concrete, not less than six 6) inches thick, 7. Qpen storage area. No outside storage area shall be permitted, unless conpTetely enclosed within a masonry wall or fence, the minimum height of'which shall be'not less than 6) feet; access gates in the wall or fence are peirnitted if the sane are view obscuring: no part of such area shall be counted or used^as fulfilling any requirsd off-stieet loading or parking requiiemenrs. 8. Screening and landscaping. Front and side yard areas, which abut a street, which areas arc not used for vehicular driveways or pedestrian walkways, but which are utilized for permitted open auto- mobile parking areas, shall be effectively screened by a wall or fence, not less than thirty 30) inches in height, nor more than six 6) feet in height. Such fence or wall shall completely enclose such area except for access ways thereto. Said wall or fence shall be set back five 5) feet from any property line abutting a street, or the same may be located on the street frontagp property line, at the option of the developer. Provided, that if the said wall or fence is to be placed on the property line, the same shall be approved as to design, by the Director, to insure ths conpatibility with surrounding and adjacent uses. All landscaped areas shall be provided, and thereafter pennanently maintained, with suitable nursery stock and adequate irrigation system, as approved by the Director. A six 6) foot high solid masonry wall shall be constructed and maintained on each property line of an M-l lot which abuts any A' or R1 zoned property, except therefrom that area of such M-l lot designated as a front yard abutting an A* or R' zoned area, wherein said wall shall not exceed a height of thirty- six 36) inches; said wall shall be constructed prior to the issuance of a certificate of oc'cupancy. 10. Lighting. Any lighting used to illuminate off-street parking areas on any lot or parcel located in the M-l Zone, shall be directed away from any abutting or adjacent A' or R' zoned property in such a manner so as not to constitute a nuisance to said property.11 9635. SAME. APPLICATION OF REGULATIONS, Notwithstanding the adoption of the regulations contained in Sections 9630 through 9634, inclu- sive, hereof, the same shall not have the effect of rendering any conforming M-l use, existing as of the effective date of these said regulations, legally non-conforming. Provided, that such M-l uses may be expanded or reconstructed only if such expansion or reconstruction is accomplished in accordance with regulations contained in Sec- tions 9630 through 9634, inclusive, hereof." 9636. SAME. SITE PLAN REVIEW, Before any permits or licenses may be issued for the construc- tion, alteration, enlargement or occupancy of any building or structure on an M-l zoned lot, a Site Plan pursuant to Section 9460 et seq. hereof, shall be required." SECTION 3. That the City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published in the manner prescribed by law.
