HomeMy WebLinkAboutORD 515ORD 515ÜÂh£Ÿjì¿=¼IORDINANCE NO. 515 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DECLARING A MORATORIUM ON THE ISSUANCE OF BUILDING PERMITS ON CERTAIN REAL PROPERTY PENDING THE CONCLUSION OF CERTAIN PLANNING AW ZONING STUDIES RELATING THERETO. URGENCY ORDINANCE} THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS; SECTION I, That the City Council of the City of Baldwin Park does hereby find, determine and declare, as follows; al That certain real property, located within said city, county of Los Angeles, state of California, more particularly described on Exhibit A" attached hereto, and Incorporated herein by this reference; and b) That the zoning designations relating to said properties are creating hardships upon such property. In that, land development Is restricted due to the substandard lot sizes, building and zoning requirements; and c) That the City has received requests for residential development, which would require the filing of a Zone Variance appli- cation to accomplish the same; and d) That the Planning Conrolssion has determined that they should promptly study this question to determine aether special development standards can be prepared and Inserted In the existing zoning regulations to solve the problems raised by the numerous prop- erties proposed for such uses; and e) That the public convenience, necessity and interest requires that a moratorium be declared preventing construction of new buildings and structures as designated on properties as designated on said Exhibit A", for a period of ninety 90) days; and f) That If this Ordinance Is not adopted as an urgency measure, certain land development may not legally be permitted, and permitted developments may be constructed upon vacant properties, Included In the above area, which might be rendered non-conforming If such regulations are amended, which would render the Planning Coarolsslon studies useless with reference thereto* SECTION 2. That pending the completion of the proceedings, as above described, there Is hereby Imposed a moratorium upon the Issuance of any building permit for the construction of any building or structure on the property described in Exhibit A" hereto. That notwithstanding any of the provisions of the Baldwin Park Municipal Code, authorizing the con- struction and maintenance of any building or structure upon said property, no building permit for any construction of any building or structure shall be Issued with reference to said property during time as this Ordinance Is in full force and effect, SECTION 3. This Ordinance Is hereby declared to be an urgency Interim zoning ordinance within the meaning of Section 65858 of the Government Code of the State of California, and shall take effect immediately upon Its adoption and shall remain In full force and effect for a period of ninety 90) days from and after Its adoption. During the term of this Ordinance the Building Department of the City shall not issue any building permit for the construction or reconstruction of any building or structure upon the property described In SECTION I hereof, A statement of facts constituting the basis for the urgency of this Ordinance Is as above set forth. SECTION 5» That the City Clerk shall certify to the adoption of this Ordinance and cause the same to be published In the manner prescribed by law.
