HomeMy WebLinkAboutORD 526ORD 526̤<žjh£Ÿj¿…¼IORDINANCE NO. 526 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ADOPTING, BY REFERENCE, CERTAIN CODES, TO WIT: I) THE UNIFORM BUILDING CODE, 1967 EDITION, VOLUME I"$ 2) THE UNIFORM ttECHAN I CAL CODE, 1967 EDITION, VOLUME 11-UNIFORM BUILDING CODE"j 31 THE UNI FORM BUI LDING CODE, 1967 EDITION, VOLUME V ENTITLED SIGNS'^ 4) 1965 NATIONAL ELECTRIC CODE"; and 5) THE UNIFORM PLUMBING CODE, 1967 EDITION", THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY ORDAIN AS FOLLOWS; SECTION I. That Sections 8100 and 8101 of the Baldwin Park Municipal Code are hereby amended to read as follows; 8100. ADOPTION OF THE UNIFORM BUILDING CODE. 1967 EDITION*. Subject to certain changes, delettons and amendments, as hereinafter set forth, the City Council of the City of Baldwin Park does hereby adopt as the building regu- lations for said City the Uniform Building Code, 1967 Edition, Volume I1 copyrighted and adopted by the International Conference of Building Officials), which said Code consists of a published compilation of rules, regulations and standards, pertaining to the erection, construction, enlargement, alteration, repair, moving, demolition, conversion and maintenance of alt buildings and structures, and declaring and establishing the types of buildings which may be constructed In established fire zones* Said Uniform Building Code Is made a part hereof as If set forth In full In this Chapter," 8101. SAKE, AMENDMENTS TO CERTAIN SECTIONS OF THE UNIFORM BUILDING CODE. The following sections of the Uniform Building Code hereafter Code'), adopted by Section 8100 hereof, are hereby deleted, as designated, or amended to read as follows; b) Section 202 f) Occupancy Violations. Whenever any building or structure Is being used contrary to the provisions of this Code, the Building Official shall order such use dis- continued and the structure, or any portion thereof, shall be vacated by the person so using It. Such person shall discontinue the objectionable use within a period of not to exceed ten 10) days after the real I ing of such notice^ or In the alternative, such person shall take the action necessary to Insure that the said building or structure or portion thereof, compiles with the requirements of this Code. d) Section 204 Interpretation of Code. The City Council, upon the recoaroendatlon of the Building Official, shall deterralne the suitability of alternate materials, and types of construction, and shall provide any inter- pretation of any of the provisions of this Code which way be required In the Interest of clarity. The decision of the City Council with respect to any realtor of Interpretation or suitability of alternate materials and types of construction shall be made by majority vote of the Council and shall be final and conclusive, e) Section 302 e) Denial and Revocation. The Building Official shall have the authority to deny the Issuance of building permits or to revoke a building permit under the following drcum- stances; 1) Whenever a building penal t has been Issued In error, or upon the basis of Incorrect Information supplied by the applicant, or In violation of any pro- vision of this Code or of the Baldwin Park Municipal Code, the Building Official shall revoke the same. Revo- cation shall be accomplished by written notice to the licensee by Untied States mall, postage prepaid, return receipt requested, addressed to the licensee at his last known address. Said notice shall contain the basis for the action taken. 2) The Building Official shall deny any application for a building permit where the Issuance would or could result In the violation of any provision of the Code or of the Baldwin Park Municipal Code, or 1f he should find that such Issuance would be detrimental to the public welfare or safety. Any person aggrieved by the action of the BIB] 37946-U01 ORD-U02 526-U02 LI2-U03 FO31549-U03 FO31555-U03 DO31577-U03 C5-U03 ORDINANCES-U03 11/20/2003-U04 ROBIN-U04 ORD 526̤<žjh£Ÿj¿…¼IORDINANCE NO. 526 Page 3 Building Official In denying the application for a building permit or In revoking an existing building permit shall have the right of appeal to the City Council, such appeal shall be made In writing and filed with the City Clerk, Upon receipt of such appeal by the City Clerk, the matter shall be set for hearing before the City Council as soon as Is practical. The City Clerk shall notify the applicant and all other persons requesting such notice of the time and place of such hearing. At such time and place of hearing, the City Council shall review the action of the Building Official and shall afford the applicant or any other Interested person a reasonable opportunity to be heard In connection therewith. If the City Council finds that the action of the Building Official Is reasonable and In conformity with the provisions of this Code, and the Baldwin Park Municipal Code, It shall uphold the decision of the Building Official* if such finding is not made It shall reverse the decision of the Building Official and the action of the City Council shall be final and conclusive, f) Section 505 c) Is hereby added to the Building Code, to read as followst Standard Plans. When an applicant uses an approved standard plan, the plan checking fee shall be one-half of the regular fees, g) Section 506 c). Certificate Issoeda After final inspection when It Is found that the building or structure complies with the provisions of the Municipal Code and with State Law, the Building Official shall Issue a Certificate of Occupancy, h» Section 506 d). Temporary Certificate A temporary certificate of occupancy may be Issued by the Building Official for the use of a portion or portions of a building or structure prior to the completion of the entire building or structure upon the application for a 50-day temporary clearance of connection of the utilities and a payment for the additional Inspections of $15.00 therefor. In the event the building Is not completed and ready for final inspection in the time prescribed by the Building Official the building shall be vacated and utilities disconnected unf? such time that the building is completed and final Inspection Is made and a certificate of occupancy Is issued as set forth above. Mo Certificate of Occupancy shall be Issued, nor shall any approval be given for the connection of any utility, to any building or structure until the owner or contractor shall have removed all debris from the premises and shall have constructed and Installed any required driveways and parking areas In accordance with City standards, J) Section 506 g) Fees, The original Certificate of Occupancy for a new building shall be Issued without a fee* For subsequent certificates a $15*00 fee shall be paid* k) Section 1601 lal* Fire Zones* For the purposes of this Code, all properties within the City are hereby declared to be In the to I lowing: 1) All properties classified, pursuant t® the City's zoning regu- lations, In a C" Zone, shall be Included In Fire Zone 2* 2) All other properties shall be Included In Fire Zone 5," I) Section 2805 d) Is hereby added to the Building Code to read as follows: I) Prior to construction of any Improvements, all underground tanks, storage areas, cellars, septic tanks, or similar structures which Is located within 51 of any structure, shall be removed, 8102* DEFINITIONS, Whenever any of the following names or terms are used In said Uniform Building Code or In this Municipal Code, each such name or term shall be deemed and construed to have the meaning ascribed to It In this section as follows; a) Building Official' shall mean the official In charge of the CIty^ Building Department; b) BUIIding Department1 or Division1 shall mean the Building Department of the City of Baldwin Park; cl Fire Department1 shall mean the Fire Prevention Bureau of Los Angeles County," SECTION 2. That Subparagraph 5) b) 5»a, of Section 8104- of the Baldwin Park Municipal Code Is hereby added to read as follows: a) The maximum width of a commercial drive shall not be In excess of 30' SECTION 5. That Sections 8200,1 and 8202 of the Baldwin Park Municipal Code are hereby repealed and rescinded. ADOPTION OF THE UNIFORM PLUSffilN6 COPE. f967 EDITIONS Subject to certain changes, deletions and amendments, as hereinafter set forth, the City Council of the City of Baldwin Park does hereby adopt, as the plumbing regulations for said City the Uniform Plumbing Code, 1967 Edition' which said Code consists of a published compilation of rules, regulations and standards, pertaining to the regulation of plumbing within the City, Said Uniform Plumbing Code Is roade a part hereof as If set forth In full In this Chapter," 8201. SAfflE. MEKO»ENTS TO CERTAIN SECTIONS OF THE UNIFORM PIUIRB1NG CODE. The following sections of the Uniform Plumbing Code hereafter Code'), adopted by Section 8200 hereof, are hereby deleted, as designated, or amended to read as follows: a) Section 1.1. Administrative Aqthorlty Whenever In the Plumbing Code, reference Is made to City1, It shall mean the City of Baldwin Park} whenever said Code refers to Administrative Authority', such reference shall mean the City's Building Official. b) Section 1.2, 1.5 and 1,7 are hereby deleted. d) Section IIIQ^b), Abandoned Sowers and Sewage PIspbsaI Fac111tIes. Every cesspool, septic tank, unless constructed of concrete, and seepage pit which has been abandoned or has been discontinued otherwise from further use or to which no waste or soil pipe from a plumbing fixture Is connected, shall have the sewage removed therefrom and be completely filled with earth, sand, gravel, concrete or other approved material. SECTION 4. That Sections 8225 and 8226 are hereby added to the Baldwin Park Municipal Code, to read as follows 8225. ADOPTION OF THE UNIFORM MECHANICAL CODE, 1967 EDITION." Subject to certain changes, deletions and amendments, as hereinafter set forth, the City Council of the City of Baldwin Park does hereby adopt as the mechanical regulations for said City the UnIf ores Mechanical Code, 1967 Edition, Volume 11-Unlform Building Code' copy- righted and adopted by the International Conference BIB] 37946-U01 ORD-U02 526-U02 LI2-U03 FO31549-U03 FO31555-U03 DO31577-U03 C5-U03 ORDINANCES-U03 11/20/2003-U04 ROBIN-U04 ORD 526̤<žjh£Ÿj¿…¼IORDINANCE RO. 526 Page 6 of Building Officials!, which said Code consists of a published compilation of rules, regulations, and standards, pertaining to the construction, alteration, repair and maintenance of all mechanical equipment In the City. Said Uniform Mechanical Code Is made a part hereof as If set forth in full In this Chapter." 8226. SAKE. AMENDMENTS TO CERTAIN SECT I ONS OF THE UNIFORft IRECHANICAL CODE. The following sections of the Uniform ffiechanlcal Code hereafter Code'l, adopted by Section 8225 hereof, are hereby deleted, as designated, or amended to read as follows: a) Section 203. Board of Appeals* In order to determine the suitability of alternate materials and types of construction and to provide for reasonable Interpretations of the provisions of this Code, the City Council shall act as the Board of Appeals." SECTION 5. That Section 8500 of the Baldwin Park Municipal Code Is hereby emended to read as follows: 8300. ADOPTION OF 1965 NATIONAL ELECTRIC CODE*. Subject to certain changes, deletions and amendments, as hereinafter set forth, the City Council of the City of Baldwin Park does hereby adopt as the electrical regulations for said City the 1965 National Electric Code*, which said Code consists of a published compilation of rules, regulations and standards, pertaining to the Installation, construction, repair, conversion and roain^- tenance of all electrical equipment and fixtures within the City, Said National Electric Code Is made a part hereof as If set forth In full In this Chapter." SECTION 6. That Section 8400 of the Baldwin Park Municipal Code Is hereby amended to read as follows: 8400. ADOPTION OF THE UNIFORM BUILDING CO&E, 1967 EDITION, VOLOKE V. ENTITLED SIGNS'". Subject to certain changes, deletions and amend- ments, as hereinafter set forth, the City Council of the City of Baldwin Park does hereby adopt as the building regulations for said City the Uniform Building Code, 1967 Edition, Volume V, entitled Signs"', which said Code consists of a published compilation of rules, regulations and standards, pertaining to the erection, construction, enlargement, alteration, repair, moving, demolition, conversion and maintenance of all signs In said City. Said Uniform Building Code, Volume V, Is made a part hereof as If set forth In full In this Chapter." BIB] 37946-U01 ORD-U02 526-U02 LI2-U03 FO31549-U03 FO31555-U03 DO31577-U03 C5-U03 ORDINANCES-U03 11/20/2003-U04 ROBIN-U04 ORD 526̤<žjh£Ÿj¿…¼IORDINANCE NO. 526 Page 7 SECTION 7, That Sections 8195, 8195.1, 8195.2 and 8202, and 8401 through 8407, Inclusive, Sections 8501 through 8506, Inclusive, Sections 8601 through 8607, Inclusive, and Sections 8950 through 8970, inclusive, of the Baldwin Park Municipal Code are hereby repealed and rescinded, SECTION 8. Public Inspection of Codes, That three copies of each Code adopted by this Ordinance are available for public inspection In the City Cleric's office and have been so available for fifteen 151 days prior to the public hearing relating to this Ordinance, SECTION 9. Violations, a Misdemeanor. No person shall violate any provisions, or fall to comply with any of the requirements of this Ordinance or any Code adopted hereby. Any person violating any of the provisions or falling to comply with any of the mandatory requirements of this Ordinance, shall be guilty of a misdemeanor. Any person convicted of a misdemeanor under the provisions of this Ordinance shall be punishable by a fine of not wore than Five Hundred $500,001 Dollars, or by Imprisonment In the City or County Jail for a period not exceeding six 6) months, or by both such fine and imprisonment. Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of this Ordinance Is conroitted, continued or permitted by such person and shall be punishable accordingly In addition to the penalties herelnabove provided, any condition caused or permitted to exist In violation of any of the provisions of this Ordinance or any Code adopted hereby shall be deemed a public nuisance and may be, by this City, suenmrity abated as such, and each day such condition continues shall be regarded as a new and separate offense, SECTION 10. That the City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published in the manner prescribed by law* PASSED, APPROVED AND ADOPTED this 17th day of Y______, 1968.
