HomeMy WebLinkAboutORD 544ORD 544ÜÂh£Ÿjì¿­¼IORDINANCE NO. 544 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ADOPTING BY REFERENCE CERTAIN CODES, TO WIT: 1) THE UNIFORM WIRING CODE, 1968 EDITION; 2) THE NATIONAL ELECTRICAL CODE, 1968 EDITION; 3) THE UNIFORM HOUSING CODE, 1967 EDITION, AND AMENDING VARIOUS SECTIONS OF SAID CODE RELATING TO OTHER BUILDING REGULATIONS, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 8104(a)(2) of the Baldwin Park Municipal Code is hereby amended to read as follows: 2) Curbs and gutters only shall be required on properties located in any M" Zone not abutting streets included on the City Select System of Streets." SECTION 2. That Subparagraph b) is hereby added to Section 8226 of the Baldwin Park Municipal Code, to read as follows: b) Section 1905. Weather Protection. Unless designed for outdoor installation, appliances shall be installed within a building or otherwise adequately protected against the weather." SECTION 3. That Section 8300 of the Baldwin Park Municipal Code is hereby amended to read as follows: 8300. ADOPTION OF 1968 NATIONAL ELECTRIC CODfi^"The City Council of the City of Baldwin Park does hereby adopt as the electrical regulations for said City the 1968 National Electric Code', which said Code consists of a published compilation of rules, regulations and standards, pertaining to the installation, construction, repair, conversion and maintenance of all electrical equipment and fixtures within the City. Said National Electric Code is made a part hereof as if set forth in full in this Chapter." SECTION 4. ADOPTION OF THE UNIFORM WIRING CODE 1968 EDITION.Subject to certain changes, deletions and amendments, as hereinafter set forth, the City Council of the City of Baldwin Park does hereby adopt as the wiring regulations for said City the Uniform Wiring Code, 1968 Edition", which said Code consists of a published compilation of rules, regulations and standards, pertaining to electrical wiring in said City. Said Uniform Wiring Code, is made a part hereof as if set forth in full in this Chapter." 8302. A^ffiNDMENTS. The following sections of the Uniform Wiring Code, adopted by Section 8301 hereof, are amended as follows: 10-1. Electrical Safety Engineer. The City Engineer shall act as tHe Electrical Safety Engineer for the City." SECTION 5. That Sections 8500 and 8501 are hereby added to the Baldwin Park Municipal Code, to read as follows: 8500. ADOPTION OF THE UNIFORM BUILDING CODE, 1967 EDITION, VOLUME III ENTITLED HOUSING'. Subject to certain changes, deletions and amend- ments, as hereinafter set forth, the City Council of the City of Baldwin Park does hereby adopt as the housing maintenance regulations for said City the Uniform Building Code, 1967 Edition, Volume III Housing Code'(copyrighted and adopted by the International Conference of Building Officials) which said Code consists of a published compilation of rules, regulations and standards, pertaining to the alteration, repair, maintenance and relocation of all housing in the City. Said Housing Code is made a part hereof as if set forth in full in this Chapter." 8501. SAME, AMENDMENTS TO CERTAIN SECTIONS OF THE UNIFORfTHSUSiNg CODE.The following sections of the Uniform Housing Code, adopted by Section 8500 hereof, are hereby deleted or amended, as follows: a) Section H-202. All buildings or portions thereof which are determined to be sub- standard as defined in this Code are hereby declared to be public nuisances and shall be abated by repair, rehabilitation, demolition, or removal in accordance with Section 3200 et seq. of the Baldwin Park Municipal Code. 2 BIB] 37946-U01 ORD-U02 544-U02 LI2-U03 FO31549-U03 FO31592-U03 DO31595-U03 C5-U03 ORDINANCES-U03 11/20/2003-U04 ROBIN-U04 ORD 544ÜÂh£Ÿjì¿­¼IORDINANCE NO. 544 b) Section H-203. Interpretation of Code. The City Council, upon the recommendation of the Building Official, shall determine the suitability of alternate materials, and types of construction, and shall provide any inter- pretation of any of the provisions of this Code which may be required in the interest of clarity. The decision of the City Council with respect to any matter of interpretation or suitability of alternate materials and types of construction shall be made by majority vote of the Council and shall be final and conclusive." SECTION 6. Public Inspection of Codes. That three copies of each Code adopted by this Ordinance are avail- able for public inspection in the City Clerk's office and have been so available for fifteen 15) days prior to the public hearing relating to this Ordinance. SECTION 7. Violations. No person shall violate any provisions, or fail to comply with any of the require- ments of this Ordinance or any Code adopted hereby. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of the Uniform Codes adopted hereby shall be punished as prescribed by Section 1200 of the Baldwin Park Municipal Code. SECTION 8. That the City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published in the manner prescribed by law.
