AZC-40) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Division A of Chapter XXI, entitled Outdoor Advertising Structures" is hereby added to Article IX of the Baldwin Park Municipal Code, to read as follows: DIVISION A OUTDOOR ADVERTISING STRUCTURES" 9825. Definitions, Unless it is apparent from the context that another meaning is intended, for the purpose of this Division, the following words or phrases shall be defined as follows: 1) Billboard shall mean an Outdoor Advertising Structure. 2) Building Official shall mean the officer or person charged with the administration and enforcement of the Building regulations of the City, or his duly authorized representative. 3) Central Business District shall mean that area as shown on the Central Commercial Area Plan of the City of Baldwin Park. 4) City shall mean the City of Baldwin Park. 5) Civic Center District, for the purpose of this Division, is defined as follows: That area, as designated by the City Council, within which are located the City's major administrative and cultural buildings and/or activities. 6) Director shall mean the Director of Planning of the City of Baldwin Park. 7) Erect shall mean to build, construct, attach, hang, place, suspend, paint or affix. W Freeway shall mean a divided arterial high- way, designated as a freeway by the State Division of Highways. 9) Highway shall mean roads, streets, boulevards, lanes, courts, places, commons, trails, ways or other rights-of-way or easements used for or laid out and intended for the public passage of vehicles and persons, except Freeways. 10) Sign Area shall mean the total area of the separate areas of the surfaces of each sign. 11) Sign Face Area shall mean the area of a billboard which is designed and used for the location thereon of advertising copy. H»T*q«- h 1'n^ y/y^ A/^ BIB] 37946-U01 ORD-U02 547-U02 LI2-U03 FO31549-U03 FO31592-U03 DO31598-U03 C5-U03 ORDINANCES-U03 11/20/2003-U04 ROBIN-U04 ORD 547ÜÂh£Ÿjì¿º¼IORDINANCE NO. 547 12) Outdoor Advertising Structure shall mean a sign soliciting public support or directing public attention to the sale, lease, hiring or use of any objects, products or service, which are not produced, sold or otherwise available on the premises where such sign is erected and maintained; outdoor advertising structure shall also mean a sign upon which a visual message is delivered to members of the general public concerning candidates for public offices, and other matters relating to elections as well as public service announcements." 9826. Purpose. The purpose of the provisions of this Division is to establish regu- lations pertaining to the location, relocation and maintenance of outdoor advertising structures within the City." 9827. General Provisions. The following provisions shall constitute the zoning regulations applicable to all Outdoor Advertising Structures in the City: 1) Central Business District. No Outdoor Advertising sign shall be located within the Central Business District. 2) Civic Center District. No Outdoor Advertising Sign exceeding 100 square feet in sign face area shall be located within 300 feet of the Civic Center. 3) Setback Lines. a) Front yard areas. Outdoor Advertising Structures, where permitted, shall be set back from the established right-of-way line of any highway, a distance equal to that required for a front yard area in the zone in which it is located, b) Near Street Intersections. No Out- door Advertising Structure shall be erected on any portion of a lot which is within twenty-five 25) feet of the right-of-way lines of a high- way intersection. c) Near A or R Zones. S47 d) Near Intersections, No Outdoor Advertising Structure shall be erected at any highway intersection in such a manner as to obstruct free and clear vision of pedestrians and vehicular traffic, or at any other location where, by reason of the position, shape, color, words, phrases, or symbols, may interfere with, obstruct the view of, or be confused with any authorized traffic sign, signal or device. 4) Lighting. Outdoor Advertising Structures may be indirectly illuminated with a white light, but no other type of lighting shall be permitted. ttei-ght. No Outdoor Advertising Structure shall exceed forty 40) feet in height measured from the average finished grade of the lot to the top of the same. 6) Sign Face Area. The sign face area of any Outdoor Advertising Structure shall not exceed 600 square feet. 7) Location. No Outdoor Advertising Structure shall be placed within 300 feet from another outdoor advertising structure on the same side of a highway except that double face, back to back, or V-type advertising displays shall be exempt from the pro- visions of this Section. 8) Public Right-of-Way. No Outdoor Advertising Structure shall be located in, over or upon any public property or right-of-way without the consent of the City Council. 9) Signs on Walls 3 Fences or Roofs. No Outdoor Advertising Structure stiaii be painted or located on any wall, building, fence or erected upon any roof of a building. 10) Permitted Zones. Outdoor Advertising Structures shall be permitted uses only in the C-2, M-l and M-2 Zones." 9828. Non-Conforming Displays. Notwithslanding any other provision of this Code, any advertising structure which was lawfully maintained as of the effective date of this Division, but which has been rendered non-conforming as a result of the application of the provisions hereof, may be maintained and shall not be required to be removed for a period of three 3) years after the effective date hereof.
