Urgency Ordinance) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 4302 of the Baldwin Park Municipal Code is hereby amended to read as follows; SECTION 4302. GAMES PROHIBITED. No person shall deal, play, carry on, participate in or conduct any game or contest played with cards, dice or any other device, for money, checks, credits or other thing of value; nor shall any pers3n bet at any of said prohibited games or contests. Provided, however, that no provision of this Section shall be deemed or construed as prohibiting any act made unlawful by the provisions of Section 320, or of Section 320a, or of Section 330, or of Section 337a, of the Penal Code, or of any other Code section or general law of the State of California, it being the intent of the City Council to pro- hibit by this Section all games, operations or transactions herein described whether of chance or skill, not prohibited by the pro- visions of any general law of this State." SECTION 2. That Section 4302.1 is hereby added to th<; Baldwin Park Municipal Code, to read as follows: SECTION 4302.1. PERMITTING PROHIBITED GAMES ON PREMISES, No person shaii knowingly permit any game or contest prohibited by Section 4302 of this Code, to be played or conducted in any house or other premises owned by, or in the lawful possession of such person. SECTION 3. That the City Council finds and determines that it is appropriate and necessary to make this Ordinance immediately effective to protect the heal th, safety n.id welfare of the residents of this City, for the reason that the Municipal Code does not now contain adequate provisions relating to the proscription of the activities set forth herein, and the undertaking of ny of such activi ties would be contrary to the welfare and best interests of the residents of this community and would lead to a deterioration of the health and safety of its inhabitants.
